AGENDA ITEM: Consideration of Approval of a resolution approving and accepting Quit
Claim Deed for Street Lot A of Legacy Pointe at Waukee Plat 6 and
Street Lot A of Legacy Pointe at Waukee Plat 5.
FORMAT: Resolution
SYNOPSIS: It has been brought to the City’s attention that street deeds for a portion
of SE Laurel Street adjacent to Legacy Pointe at Waukee Plat 5 as well
as the cul de sac of SE Golden Harvest Drive adjacent to Legacy Pointe
at Waukee Plat 6 were never provided for recording following
acceptance of the improvements.

RECOMMENDATION: Staff would recommend approval of the resolution

RESOLUTION 16-
APPROVING AND ACCEPTING QUIT CLAIM DEED FOR
STREET LOT A OF LEGACY POINTE AT WAUKEE PLAT 5 AND STREET LOT A
OF LEGACY POINTE AT WAUKEE PLAT 6
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, Ewing Land Development & Services, L.L.C. (the “Developer”), has previously
submitted and received approval of a final plat for Legacy Pointe at Waukee Plat 5 and Legacy
Pointe at Waukee Plat 6; AND
WHEREAS, the public improvements associated with the Plat including the streets have
previously been accepted by the City; AND,
WHEREAS, it has recently been brought to the attention of the City of Waukee that a deed for
the previously accepted public streets had never been provided by the Developer;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa on
this 19th day of September 2016 that the quit claim deed associated with the public streets within
the Plats is hereby accepted and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to file the
quit claim deed for the streets within the Plats, as well as any other documents related thereto,
with the Dallas County Recorder.
