AGENDA ITEM: Public hearing on an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1
Agricultural District to R-2 One & Two Family Residential District [Fox
Valley Phase 2]

SYNOPSIS INCLUDING PRO & CON: Staff has received a request for rezoning of
approximately 17.86-acres of property from A-1 to R-2. The property is
located south of NW Meredith Drive and west of N. Warrior Lane. The
area proposed to be rezoned is located within the developing Fox Valley
neighborhood.
The applicant received greater than 50% consent from property owners
within 250-feet of the area proposed to be rezoned.
The concept plan provided shows 50 single family lots to be developed
and incorporated into the Fox Valley neighborhood. All lots comply with
the minimum requirements of the R-2 district. Landscape buffers will be
required on lots located south of NW Hillside Boulevard. The concept
plan identifies and additional 1.31-acres of property to be dedicated to
the City for future parkland development. This land will be combined
with land that is already planned to be dedicated to the City to the west.
The subject property is classified as Single Family Residential in the
Imagine Waukee 2040: Comprehensive Plan. The proposed densities for
single family of 2.8 units per acre complies with the range indicated in
the Comprehensive Plan
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the rezoning request on July 27, 2021 and
recommended approval:
Approval of a Rezoning related to a change from A-1 (Agricultural District) to R-2 (One
and Two Family Residential District) [Fox Valley Phase 2]
Planning Coordinator, Andy Kass, introduced the request for approval of a rezoning for a single
family residential district as submitted by the applicant, Fox Valley Development LLC. The
subject property is generally located south of NW Meredith Drive and west of N. Warrior Lane,
containing approximately 17.86 acres. The applicant has submitted consent from approximately

68.68% of property owners within 250-feet of the area subject property, and staff has not received
any correspondence for or against the request.
Mr. Kass advised that the concept plan identifies 50 shingle family lots to be incorporated into the
already developing Fox Valley neighborhood. This project takes the place of an outlot that was to
housing a potential future school location that has since relocated. All lots conform to the
standard R-2 district requirements and a landscape buffer will be required along the south sides of
NW Hillside Boulevard. Three street extensions are identified as well as a 10 foot wide trail along
the south side of NW Hillside Boulevard and 5 foot sidewalks on all other streets. Utilities exist
to serve the site and Stormwater will be managed within Outlot Y which will be owned and
maintained by a homeowners association. Additional parkland is being dedicated with this
development which will add an additional 1.31 acres to the previously dedicated 2.44 acres from
the initial Fox Valley preliminary plat.
At this time staff recommends approval of the rezoning for Fox Valley Phase 2 as the zoning
district is generally consistent with the land uses identified in the Comprehensive Plan.
Commissioner Koshy questioned if there is an entry into the park from the residential
properties. Mr. Kass advised there is intention for the installation of a trail into the park
from the street. The entry is approximately 20-30 feet wide at the narrowest point.
Commissioner Streit moved to approve the Rezoning related to a Change from A-1 (Agricultural
District) to R-2 (One and Two Family Residential District) [Fox Valley Phase 2], subject to any
remaining staff comments and review of all legal documents. Commissioner Broderick seconded
the motion. Ayes: Streit, Ward, Broderick, and Koshy. Nays: None. Motion Carries.
STAFF REVIEW AND COMMENT: Staff would recommend approval of the proposed
rezoning request based on its conformance with the Comprehensive Plan.
RECOMMENDATION: Hold the Public Hearing.

BACKGROUND
The subject property is located south of NW Meredith Drive and west of N. Warrior Lane. The property is
approximately 17.86-acres in area and is currently in agricultural use. The applicant and property owner request that the
property be rezoned from A-1 to R-2.
The applicant has submitted consent from 68.68% of property owners within 250-feet of the area proposed to be
rezoned R-2. Notification to adjacent property owners was mailed on July 16, 2021. Staff has not received any
correspondence regarding this request.
PROJECT DESCRIPTION
The concept plan provided shows 50 single family lots to be developed. These lots will be incorporated into the already
developing Fox Valley neighborhood. All proposed lots within the R-2 district comply with the standard R-2 district
requirements. Table 1 below summarizes the standards for the R-2 district. Landscape buffers will be required along the
south sides of NW Hillside Boulevard.

Parkland dedication requirements will apply to the project because of its residential nature. The required amount of
parkland is 0.97-acres. Outlot Z is shown in the southwest corner of the development and is 1.31-acres in area. This
parkland will be combined with the 2.44-acres that the applicant has indicated to dedicate on the initial Fox Valley
preliminary plat.
COMPREHENSIVE PLAN
The subject property is classified as Single Family Residential in the Imagine Waukee 2040: Comprehensive Plan. Single Family
Residential is defined as traditional forms of single-family housing with lot sizes ranging from 8,000 square feet to 0.50-acres
in area with an average density of 2 to 4 units per acre. The proposed density of the project would be approximately 2.8
units per acre. In addition, the proposed concept demonstrates a variety of lots sizes for homes to be built upon.
STAFF RECOMMENDATION
The proposed zoning district is generally consistent with the land uses identified in the Comprehensive Plan. Based on
the conformance with the Comprehensive Plan staff recommends approval of the rezoning for Fox Valley Phase 2.
