HomeMy WebLinkAbout2021-08-02-H03 KeeTown Loop Rezoning_PH AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: August 2, 2021 AGENDA ITEM: Public Hearing on an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from K- RC Kettlestone Retail Community to K-RR Kettlestone Retail Regional and PD-1 Planned Development Overlay (KeeTown Loop) FORMAT: Public Hearing SYNOPSIS INCLUDING PRO & CON: The applicant is requesting approval of a rezoning of approximately 24.5 acres of property located at the northwest corner of Grand Prairie Parkway and Ashworth Road form Kettlestone Community Retail to Kettlestone Regional Retail. In addition to the zoning change, the applicant is requesting a Planned Development Overlay due to some of the unique characteristics of the proposed development. The proposed rezoning is necessary to accommodate the proposed KeeTown Loop Entertainment Project. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission reviewed the request at their meeting on July 27, 2021 and recommended approval. Approval of a Rezoning related to a change from K-RC (Kettlestone Retail Community District) to K-RR (Kettlestone Retail Regional District)/ PD-1 (Planned Development Overlay)[KeeTown Loop] Director of Development, Brad Deets, introduced the rezoning as submitted by the applicant, The Quarter at Waukee, LLC, for a concert venue and surrounding related development. The subject property is generally located north of Ashworth Road and west of Grand Prairie Parkway, containing approximately 24.5 acres. The applicant has submitted consent from 63.51% of the surrounding property within a 200 foot radius of the subject property. Notification of the rezoning was mailed on July 16th, 2021 and rezoning signs were erected July 20th, 2021. Mr. Deets advised that the purpose for the rezoning is due to the fact that the K-RR district allows for larger and taller buildings as opposed to the K-RC district even though the uses between the two districts are very similar. The proposed request maintains an approximate 12 acre area of K- RC zoning located west of Parkview Crossing Drive which provides a more compatible transition for the residential properties to the west while allowing for the larger buildings to be built at the intersection of Grand Prairie Parkway and Ashworth Road. The purpose of the added Planned Development aspect further defines the “entertainment establishment” use and provides clarity to site specific details related to loading docks/screening, drive thru establishments, parking and architectural intent, as well as signage. H3 The proposed rezoning request is generally consistent with the approved Kettlestone master Plan and Kettlestone Design Guidelines and staff would recommend approval. Future platting and site plan approval will be required prior to any individual development within the subject property. • Commissioner Koshy questioned what the parking looks like for a project of this size. Mr. Deets advised there is a minimum of 1700 parking stalls needed for the development as it has been presented on the concept plan. • Commissioner Koshy questioned how the development will effect traffic and the surrounding residential areas. Mr. Deets advised that there will be signals installed as well as turn lanes. Traffic studies have shown that currently, Grand Prairie Parkway will support this development. • Commissioner Koshy questioned if there are going to be any additional amendments that change landscaping and open space requirements. Mr. Deets advised that all other requirements will still need to be met with no additional amendments. • Commissioner Broderick questioned if it was the entire development that created the 0.7 Floor ratio hotel use calculation. Mr. Deets advised that was correct. • Matthew Graham of 2665 SE Willowbrook Drive, questioned what the new zoning height allow for. Mr. Deets advised that the new height maximums would equal 8 stories or 40 Feet in height. Commissioner Broderick moved to approve the Rezoning related to a Change from K-RC (Kettlestone Retail Community District) to K-RR (Kettlestone Retail Regional District)/ PD-1 (Planned Development Overlay) [KeeTown Loop], subject to a remaining staff comments and review of any legal documents. The property is located at the northwest corner of the intersection of Grand Prairie Parkway and Ashworth Road. The applicant is requesting that the property be rezoned from K-RC (Kettlestone Community Retail) to K-RR (Kettlestone Regional Retail). The applicant is also requesting approval of a Planned Development Overlay to accommodate the unique aspects of the proposed development. The centerpiece of the proposed development is an approximately 50,000 square foot indoor concert venue which is proposed to be surrounded by restaurants, retail and drinking establishments. There are certain aspects of the proposed concert venue which require the need for a Planned Development Overlay. The applicant has submitted consent from 63.51% of the surrounding property within a 200 foot radius of the area proposed to be rezoned. Notification to surrounding property owners were mailed on July 16, 2021. Rezoning signs have also been placed on the property and were erected on July 20, 2021. At this time, staff has not received any correspondence either for or against the proposed rezoning request. The subject property was originally rezoned to K-RC (Kettlestone Retail Community) in 2016. PROJECT DESCRIPTION: The proposed rezoning request is from Kettlestone Retail Community to Kettlestone Retail Regional. Per the Kettlestone Master Plan, the area designated for regional retail was intended to be located directly south of the subject property (south of Ashworth Road). While the uses are not inherently different between the K- RC and K-RR districts, the bulk regulations within the K-RR district do allow for larger and taller buildings. The Kettlestone Master Plan is intended to act as a guide for land use while at the same time allowing for flexibility of land uses. The intent is that the land use designations can move based upon market demands and the type of development. The proposed rezoning request maintains an approximately 12 acre area of K-RC zoning located west of Parkview Crossing Drive which provides a more compatible transition for the residential properties to the west while allowing for the larger buildings to be built at the intersection of Grand Prairie Parkway and Ashworth Road. The Planned Development Overlay proposed for the project further defines the unique aspects of the intended use of the property specifically related to the concert venue. The Planned Development includes July 23, 2021 3 of 3 further definition of the “entertainment establishment” use and provides clarity to some of the site specific details including loading docks/screening, drive thru establishments, parking and architectural intent. The Planned Development also includes language that is specific to the “entertainment establishment” signage. The proposed language will allow for the construction of two marquee signs, one of which will be located at the intersection of Grand Prairie Parkway and Ashworth Road. The intersection sign will be required to be designed so that it incorporates Kettlestone intersection signage elements which ties the event sign into the overall intent and sign theme intended for the Kettlestone Development area. This sign language is written exclusively for the “entertainment establishment” and without such venue as defined within the Planned Development, this signage would not be permitted. STAFF RECOMMENDATION The proposed rezoning request is generally consistent with the approved Kettlestone Master Plan and Kettlestone Design Guidelines and staff would recommend approval. The property included within the rezoning will be required to go through platting and site plan approval prior to any individual development within the property.
