HomeMy WebLinkAbout2021-06-30-2081 REGULATION OF THE LICENSING, IMPOUNDING, IMMUNIZATION AND KEEPING OF DOGS. §208.1.Definitions. For use within this ordinance the following are defined: A. The term "dogs" includes both male and female dogs whether altered or not. B. The term "at large" refers to any dog running otherwise than upon the premises of its owner when the dog is not attached to a leash held by a competent person, restrained within a motor vehicle, or in an animal hospital, or kennel. C. The term "owner" includes any person, firm or corporation owning, harboring, sheltering or keeping a dog. §208.2 License. All dogs shall be licensed. Every owner of a dog shall procure a license from the Police Department on or before the first day of January of each year. The annual license fee for both an altered and unaltered dog shall be set by resolution of the city council. Upon payment of the license fee, the Police Department shall issue to the owner a license which shall contain the name of the owner, his place of residence, and a description of the dog. The Police Department shall keep a duplicate of each license issued as a public record. Upon issuance of the license, the Police Department shall deliver to the owner a metal tag stamped with the number of the license and the year for which it was issued. The license tag shall be securely fastened to a collar or harness which shall be worn by the dog for which the license is issued. Any dog found running at large without the license tag attached to its collar or harness shall be deemed unlicensed. It shall be a violation of this ordinance for any owner to own or possess a dog within the city of Waukee without obtaining a license in compliance with this section. Ordinance 2817 – July 18, 2016 §208.3 Immunization. Every owner of any dog over the age of three (3) months shall, when procuring a dog license from the Police Department, present a certificate from a qualified doctor of veterinary medicine that such dog has had immunization against rabies, and such certificate shall show the date of such immunization and the term of such immunization. The Police Department shall not issue any dog license until evidence is shown certifying a rabies vaccination of the dog by a licensed veterinarian. If any dog for which a license has been obtained shall not have attained the age of three (3) months at the time of the licensing of such dog, the owner shall, not less than ten (10) days after such dog attains the age of three (3) months, secure immunization against rabies for such dog and present a certificate as required in this section to the Police Department who shall enter such certification in the records of the city. 2 It shall be a violation of this ordinance for any owner to own or possess a dog within the City of Waukee without furnishing a certificate of immunization against rabies in compliance with this section. Ordinance 2817 – July 18, 2016 §208.4 Kennel Dogs. Kennel dogs which are kept or raised solely for the bona fide purpose of sale and which are kept under constant restraint are not subject to the provisions of this ordinance. §208.5 Dogs Disturbing Persons. A. It shall be unlawful for an owner of a dog to allow or permit such dog to run at large. B. It shall be unlawful for an owner of a dog to allow or permit such dog to pass upon the premises of another thereby causing damage to, or interference with, the premises. C. It shall be unlawful for an owner of a dog to allow or permit such dog to cause serious annoyance or disturbance to any person or persons by frequent and habitual howling, yelping, barking or otherwise. §208.6 Impounding. A. Any dog found at large shall be seized and impounded. B. The owners of licensed dogs, if known, shall be notified in writing not less than two (2) days following impoundment that upon payment of impounding costs such dogs will be returned. If the impounded licensed dogs are not recovered by their owners within ten (10) days after notice, the dogs shall be disposed of by the Marshall. C.Impounded unlicensed dogs may be recovered by the owner, upon proper identification, by payment of the license fee and impounding costs. If such dogs are not claimed within ten (10) days after impounding, they shall be disposed of by the Marshall. Ordinance 2823 – September 6, 2016 §208.7 Owners of Animals Shall Clean and Dispose of All Excrement From Such Animals on Property Other Than Property of Owners. Owners of animals, whether running at large or on leash or restraints, shall clean all excrement from such animals from property, including structures, other than the property of the owner. 3 §208.8 Penalty. Anyone violating any of the provisions of this ordinance shall, upon conviction, be subject to imprisonment not exceeding thirty (30) days, or a fine not exceeding one hundred dollars ($100.00).
