HomeMy WebLinkAbout2021-06-30-5041 ESTABLISHING CONTROLLED ACCESS AND ESTABLISHING PARKING RESTRICTIONS ALONG IOWA HIGHWAY 6 AND UNIVERSITY AVENUE IN THE CITY OF WAUKEE, IOWA, DEFINING THE LIMITS AND POINTS OF ACCESS, THE USE OF THE LIMITED ACCESS FACILITIES, AND THE RESTRICTIONS ON PARKING. §504.1 Definition of a Controlled Access Facility. For the purposes of this Chapter, a controlled access facility is defined as a highway or street especially designed for through traffic, and over, from or to which owners or occupants of abutting land or other persons have no right or easement or only a controlled right or easement of access, light, air, or view by reason of the fact that their property abuts upon such controlled access facility or for any other reason. §504.2 Authority to Establish Controlled Access Facilities. The provisions to this Chapter relating to control of access, shall be deemed an exercise of the police power of the City of Waukee pursuant to Chapter 306A, Code of Iowa, as amended. §504.3 Establishment. There is hereby fixed and established controlled access within the City of Waukee, the center line of such access facilities being described as follows: A. Iowa Highway 6 from a point 1320' west of the center line of East Street at its intersection with Iowa Highway 6, east at intervals of 1320' to the east city limits; and west from a point 1320' west of the East Street of 600' intervals to the west city limits. B. University Avenue from a point on the centerline of Ashworth Drive at its intersection with University Avenue east at intervals of 1320' to the east city limits. §504.4 Right of Access Limited. No person shall have any right of egress and ingress to, from or across the controlled access facility herein before established except, at existing points of access, or at such points as may be hereafter jointly established by the Iowa Department of Transportation and the City of Waukee. The existing points of access are: 2 UNIVERSITY AVENUE A. Stationing along University Avenue: The centerline intersection of University Avenue and Ashworth Drive is Station 34+50. Stationing increase from West to East. B. Stationing along Iowa Highway 6: The centerline intersection of Iowa Highway 6 and Sixth Street is Station 257+51. Stationing increases from West to East. D. The following are existing points of access along Iowa Highway 6 from the west Waukee Corporate Limits to the east Waukee Corporate Limits: STATION: 241+79 Ashworth Drive north 241+83 Ashworth Drive south 243+94 Driveway south 246+56 Driveway south 250+92 Driveway north 251+53 Driveway south 525+60 Driveway north 253+68 Driveway north 253+83 Driveway south 257+31 Driveway north 257+51 6th Street south 261+86 Driveway south 263+91 Driveway south 265+81 Driveway south 265+90 4th Street south 267+71 Driveway south 267+99 Driveway north 291+84 Driveway south 294+47 East Street 310+25 Driveway south 312+73 Driveway south 313+31 Driveway south 332+67 Driveway south 347+25 162nd Street 264+25 Driveway south 371+25 Driveway south 4 §504.5 Points of Access Defined. The points of access shall consist of access ways from abutting property to the adjacent traffic lane or roadway and their location shall be expressed in terms of "stations", each representing a distance of one hundred [100] feet measured along the center line of the controlled access facility from the points of reference stated above. Such measurements shall refer to the center of the access ways which shall be a maximum of 18 feet for agricultural purposes and a maximum of 35 feet in width for commercial purposes, and 80 feet in width for public street purposes. §504.6 Exceptions. The foregoing controlled access facilities shall be subject to possible future public street access opening as approved by the Iowa Department of Transportation and the city council of said Iowa Highway 6 and University Avenue. Said access points may be located no closer than one-fourth (1/4) of one mile intervals on University Avenue and Iowa Highway 6 (except as provided herein.) §504.7 Unlawful Use of Facilities. It shall be unlawful for any person to: A. Cross Dividing Lines. Drive a vehicle over, upon or across any curb, central dividing section or other separation or dividing line on said controlled access facilities. B. Turns. Make a left turn or semicircular or U-turn except through an opening provided for that purpose, the dividing curb section, separation or line. C. Use of Lanes. Drive any vehicle except in the proper lane provided for that purpose and in that property direction and to the right of the central dividing curb, separation section or line. D. Enter facility. Drive any vehicle into controlled access facility from a local service road except through an opening provided for that purpose and the dividing curb or dividing section or dividing line which separates said service road from the controlled access facility property. §504.8 Parking Restricted. The parking of vehicles on or along controlled access facilities are restricted as follows: A. Iowa Highway No. 6 Parking of any nature is prohibited on Iowa Highway 6 on both sides from the west city limits to the east city limits. This includes all portions of the highway including the traveled portion as well as the shoulders. B. University Avenue. Parking of any nature is prohibited on University Avenue on both sides from the west city limits to the east city limits. This includes all portions of the highway including the traveled portion as well as the shoulders. 5 §504.9 Repealer. All ordinances or parts of ordinances in conflict with provisions of this Ordinance are hereby repealed. §504.10 Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not effect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged inviolate or unconstitutional.
