BEER AND LIQUOR
AN ORDINANCE TO AMEND CHAPTER 606, BEER AND LIQUOR, WAUKEE
MUNICIPAL CODE, BY DELETING SAID CHAPTER AND INSERTING IN LIEU
THEREOF SECTIONS 606.1, AND SUBSECTIONS INCORPORATING SECTIONS OF THE
CODE OF IOWA, IOWA ALCOHOLIC BEVERAGE CONTROL ACT BY REFERENCE
THERETO, TO THE EXTENT THAT VIOLATIONS THEREOF CONSTITUTE A SIMPLE
MISDEMEANOR.

§606.12 Prohibiting the Dispensing of Unlimited Alcoholic
Servings for a Fixed Price. A person shall not sell, offer to sell,
dispense or serve for on-premises consumption an unlimited number

of servings of alcoholic liquor, wine or beer for a fixed price.
Nothing in this subsection shall be construed to prohibit a holder of a
liquor control license or wine or beer permit, or its employees or
agents, from: (a) including servings or drinks of alcoholic liquor,
wine or beer as part of a hotel or motel package which includes
overnight accommodations, (b) providing a fixed price for an
unlimited or indefinite amount of drinks for a private event, which is
defined as an event restricted to a particular group or persons,
provided that the licensee or permittee shall provide means or
method by which to identify persons participating in the private
event, such as the use of a separate room or a means to identify such
participants; or (c) as otherwise permitted for a special event by the
City Council (provided, however, that no permit holder shall be
allowed to hold such a special event under this subparagraph (c)
more than twice per year.)

Only those sections above which are listed as simple misdemeanors by the Code of Iowa, shall be
enforced as violations of the Waukee Municipal Code. If the punishment for violation of such
section under the Code of Iowa, shall be different from that provided by the Waukee Municipal
Code for a simple misdemeanor, the punishment set out in the Code of Iowa shall prevail.
