AN ORDINANCE PROHIBITING DISCARD OF ANY LITTER IN ANY WATER
OR LAND WITHIN THE CITY OF WAUKEE, IOWA, AND PROVIDING FOR
PENALTIES FOR VIOLATIONS THEREOF.
§612.1 Definitions of Terms.
A. "Discard" means to place, cause to be placed, throw, deposit or drop.
B. "Litter" means any garbage, rubbish, trash, refuse, waste materials, paper,
or debris and all other putrescible and non-putrescible wastes, except sewage and water-
carried trade wastes.
§612.2 Litter. No person shall discard any litter onto or in any water or
land within the City of Waukee, Iowa, except that nothing in this section shall be
construed to affect the authorized collection and discarding of such litter in or on areas or
receptacles provided for such purpose. Provided further, however, newspapers, flyers,
bulletins, notices, sale bills, and other printed matter may be deposited in receptacles
provided for such purpose. If a person places or distributes newspapers, flyers, bulletins,
notices, sale bills, or other printed matter on the property of another, outside receptacles
provided for such purposes, after a written request has been sent to the last known
address of such person by the property owner not to do so, such person shall be guilty of
a violation of this section. Persons, firms or other entities causing such distribution of
litter by their agents, servants or employees, shall be guilty of a violation of this section.
§612.3 Washing of concrete trucks and mixers on public property
prohibited. Except as done as part of construction activities undertaken by the City, the
washing of concrete trucks and/or mixers onto public streets, alleys, sidewalks, “parking”
or public property is prohibited. A person who violates this section shall be guilty of a
simple misdemeanor and a scheduled fine of $250.00 dollars per violation, plus all
applicable surcharges and court costs.
§612.4 Manner of washing concrete trucks and mixers. Concrete
trucks and mixers shall be washed such that the runoff and/or waste water from such
activity is received and contained in a an Environmental Protection Agency or Iowa
Department of Natural Resources approved Best Management Practices concrete washout
containment device. A person who violates this section shall be guilty of a simple
misdemeanor and a scheduled fine of $250.00 dollars per violation, plus all applicable
surcharges and court costs.
§612.5 Disposal of residue and material in a concrete washout
containment device. Except as done as part of construction activities undertaken by the
City, no person shall empty, dump or clean out the material, residue or waste contained in
a concrete washout containment device onto public streets, alleys, sidewalks, “parking”
or public property. A person who violates this section shall be guilty of a simple
misdemeanor and a scheduled fine of $250.00 dollars per violation, plus all applicable
surcharges and court costs.

§612.6 Violations. A violation of this chapter shall constitute a simple
misdemeanor and, unless otherwise specified herein, be subject to a fine of up to $750.00
and/or 30 days in jail as allowed by law.
