AGENDA ITEM: Consideration of approval of a resolution approving development
agreement for Waukee Crossing Plat 2
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON:
The plans for Waukee Crossing Plat 2 include the extension of NW 6th Street from where it ends
today just north of the Shottenkirk development to NW Sunrise Drive. A portion of the
improvements fall adjacent to undeveloped or previously developed property to which the City
has no existing development agreements with those property owners for future improvements to
NW 6th Street. A development agreement has been prepared which reimburses the developer for
the incremental costs of those improvements that are required to be completed adjacent to the
undeveloped properties along the west side of NW 6th Street which would be above and beyond
the obligations of the developer of Waukee Crossing Plat 2.
As a part of the development agreement, the developer is responsible for obtaining to bids for the
proposed improvements which City staff will review and approve of the lowest responsible
bidder. Upon completion of the improvements, the City will be obligated to reimburse the
developer for those costs that have been determined to be City of Waukee costs.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: $143,188.21
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: The City Attorney and the attorney for the Developer
are currently finalizing edits to the development agreement which will be provided prior to the
City Council Meeting.
RECOMMENDATION: Staff recommends approval of the resolution

RESOLUTION 2021-
APPROVING DEVELOPER’S AGREEMENT FOR WAUKEE CROSSING PLAT 2
[WAUKEE CROSSING, LLC]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, Waukee Crossing, LLC (“Developer”) has submitted construction drawings and a final plat
for Waukee Crossing Plat 2 (“Property”) which include the construction of a portion of NW 6th Street;
AND,
WHEREAS, Developer has communicated with the City about the requirements associated with NW 6th
Street Improvements and has indicated there may be some delay in the development of their Property as a
result of the public improvements they are required to undertake as part of the development of the
Property; AND,
WHEREAS, after some discussion the parties have reached an agreement to expedite the completion and
mitigate the burdens associated with the development of the Property as it pertains to the NW 6th Street
Improvements Developer is required to undertake.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that the
Developer’s Agreement with Waukee Crossing, LLC regarding Waukee Crossing Plat 2 is hereby
approved.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute any and all documents to
effectuate the development agreement, and that the City Clerk shall cause the originals of the agreement
to be recorded upon the properties by submitting the original to the Dallas County Recorder with the
appropriate recording fees.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 30th day of August,
2021.
