The property owner has requested vacation of this easement if it is no longer in use and has no future City use. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: City staff currently have no use and do not anticipate future use of the water main easement area. Staff recommend vacation of the water main easement. RECOMMENDATION: Hold the public hearing. ATTACHMENTS: I. Notice of Public Hearing PREPARED BY: Beth Richardson REVIEWED BY: Rudy Koester RK PUBLIC NOTICE INFORMATION – NAME OF PUBLICATION: Dallas County News DATE OF PUBLICATION: 08/26/2021 H3 NOTICE OF PUBLIC HEARING CONCERNING THE VACATION OF A WATER MAIN EASEMENT PURSUANT TO IOWA CODE SECTION 354.23 The City Council of the City of Waukee, Iowa will consider a proposal to vacate a Limited Easement recorded in Book 768 Page 466 of the Dallas County Recorder’s office. The City has abandoned a water main within the easement area and no longer is in need of the easement. If approved after hearing, the easement shall be considered vacated, terminated and otherwise of no further effect. A public hearing has been set to consider the vacation of the City’s interest in the aforementioned Water Main Easement for the 7th day of September, 2021 at 5:30 p.m., Waukee City Hall, 230 W. Hickman Road, Waukee, IA 50263. *Due to public health concerns and guidance, in accordance with Iowa Code Sections 21.4(1)(b) and 21.8, this meeting of the Waukee City Council will be conducted with two different options for public participation: 1) Members of the public wishing to attend in person may do so in the Council Chambers at Waukee City Hall. 2) Members of the public wishing to participate electronically may do so via Zoom at the following link or phone numbers: https://zoom.us/j/352651371 Meeting ID: 352-651-371 Or by phone: +1 646-558-8656 or +1 312-626-6799 or +1 301-715-8592 In-person meetings are subject to change under certain circumstances, including but not limited to higher than average participation or changes in health guidelines. The Limited Easement that is being vacated is depicted on a drawing on file with the City Clerk of the City of Waukee, Iowa. If the Limited Easement is deemed by the City Council to be of no benefit to the public, the Council may vacate and terminate the Limited Easement and and otherwise quiet title in the area encumbered by said easement in the Property Owners of the Property over which the easement is situated. The public is invited to attend and participate in the public hearing to provide comment for consideration by the City Council concerning the vacation of the Limited Easement described above.
