THE CITY OF WAUKEE, IOWA
RESOLUTION 2021-
A RESOLUTION AUTHORIZING THE DISPOSAL OF REAL ESTATE IN
ACCORDANCE WITH IOWA CODE 364.7(2021)
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS, the City caused notice of a public hearing to be published in accordance with Iowa
Code 364.7 Code of Iowa (2017) concerning the disposal of certain real estate owned by the City
to Temple Holdings, LP; AND
WHEREAS, on September 7, 2021, the Waukee City Council held a public hearing pursuant to
Iowa Code §364.7 regarding the transfer of property legally described as:
Parcel 21-66 of the Northeast Quarter (NE ¼) of the Northwest Quarter (NW ¼)
of Section Twenty-eight (28), Township Seventy-nine (79) North, Range Twenty-
six (26) West of the 5th P.M., Dallas County, Iowa as shown on Plat of Survey
recorded in Book 2021 Page 22785,
subject to all easements and restrictions of record.
WHEREAS, after the public hearing, and consideration of the proposal concerning the disposal
of said real estate to Temple Holding, LP as contemplated by 364.7 Code of Iowa, and other
good and valuable consideration from said Temple Holdings, LP, the City Council of the City of
Waukee determines that it is in the best interest of the City to authorize the disposal by transfer
of said property to Temple Holdings, LP.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
7th day of September, 2021, that, following public hearing as required by Iowa Code 364.7 Code
of Iowa (2021), hereby approves the transfer of property to the Temple Holdings, LP legally
described as:
Parcel 21-66 of the Northeast Quarter (NE ¼) of the Northwest Quarter (NW ¼)
of Section Twenty-eight (28), Township Seventy-nine (79) North, Range Twenty-
six (26) West of the 5th P.M., Dallas County, Iowa as shown on Plat of Survey
recorded in Book 2021 Page 22785,
subject to all easements and restrictions of record.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 7th day of
September, 2021.
