AGENDA ITEM:Consideration of approval of a resolution approving funding pursuant to
the 28E Agreement with Waukee Area Arts Council, Inc.
FORMAT:Consent Agenda
SYNOPSIS INCLUDING PRO & CON: On Sept. 7, 2021, the Waukee City Council approved
a 28E agreement outlining certain obligations of the City and the
Waukee Area Arts Council. A resolution to approve the funding amount
for the current fiscal year must now be considered.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:$15,000
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: Following council approval, payment will be issued to
the organization.
RECOMMENDATION: Approve the resolution.

RESOLUTION 2021-___
APPROVING FUNDING PURSUANT TO THE 28E AGREEMENT WITH THE
WAUKEE AREA ARTS COUNCIL, INC.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the Waukee Area Arts Council, Inc (“Agency”) is a private agency as defined in
Iowa Code Section 28E.2, and is a nonprofit corporation duly formed and existing pursuant to
the laws of the State of Iowa; AND,
WHEREAS, the City is a public municipal corporation duly formed and existing pursuant to the
laws of the State of Iowa and is a public agency as defined in Iowa Code Chapter 28E; AND,
WHEREAS, Iowa Code Chapter 28E authorizes public agencies to enter into agreements for
joint or cooperative action with public or private entities; AND,
WHEREAS, the Agency is a not-for-profit organization dedicated to enhancing the quality of
life through the fine arts in Waukee and the western suburbs of Des Moines and the surrounding
area; AND,
WHEREAS, the Agency has undertaken to provide opportunities for Waukee residents and the
general public to experience the arts in various forms in Waukee through sponsoring and
conducting various activities throughout the city including but not limited to the Waukee Arts
Festival, Tuesdays on the Triangle, Sundays in Centennial, Imagine… Create… Experience,
among others; AND,
WHEREAS, the City desires to assure that its recreational programing available for the citizenry
to experience, use and enjoy includes programming for culture and the arts; AND,
WHEREAS, the Agency and the City desire to enter into an agreement pursuant to Iowa Code
Chapter 28E creating a cooperative contractual relationship to ensure cultural/arts programming
is available to residents within the City and assure the endeavor serves this very important public
purpose; AND,
WHEREAS, the City has an existing 28E agreement with the Waukee Area Arts Council, Inc
establishing the procedures and mechanisms for the administration of a fund to ensure
cultural/arts programming is available to residents within the City.
NOW THEREFORE BE IT RESOLVED that a contribution in the amount of $15,000.00 be
made to the Waukee Area Arts Council, Inc. for fiscal year 2022 to be administered pursuant to
the 28E agreement with the Agency.
BE IT FURTHER RESOLVED that payment shall be made upon receipt by the City of
Waukee of an invoice from the Agency for the amount designated above.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 20th day of
September, 2021.
