Kettlestone Ridge Plat 7
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The applicant, Jerry’s Homes, Inc,, requests approval of a
15.35-acre final plat for a single family residential subdivision. The property
is located north of Ashworth Road and east of SE L.A. Grant Parkway. The
final plat includes 41 lots. All lots meet or exceed the minimum requirements
of the R-2 zoning district. The applicant has completed the public
improvements including street construction and utility extensions. There is a
Developer’s Agreement included with this project as the applicant is working
towards acquiring the east half of the right-of-way for SE Florence Drive.
Until the right-of-way is acquired and dedicated to the City, the applicant has
agreed to not request any building permits on Lots 35, 36, or 37.
COMMISSION/BOARD/COMMITTEE COMMENT:
The Planning & Zoning Commission reviewed the request at their meeting on December 8, 2020,
and recommended approval subject to remaining staff comments.
Approval of a Final Plat for Kettlestone Ridge Plat 7
Senior Planner, Andy Kass, introduced the request for approval of a final plat for a single
family residential subdivision as submitted by the applicant, Jerry’s Homes, LLC. The subject property
is generally located east of SE L.A. Grant Parkway and south of SE Tallgrass Lane, and contains
approximately 15.35 Acres.
Mr. Kass explained that the plat indicates a total of 41 Single Family lots ranging in size from
8,945 square feet to 27,756 square feet. All represented lots meet or exceed the minimum zoning
requirements of the R-2 zoning district. SE Esker Ridge Drive and SE Florence Drive will be extended
as part of this plat and a new cul-de-sac, SE Moraine Court, will be created. Five foot wide sidewalks
will be extended with each lot as they develop. No trails are anticipated with this plat. Public utilities
exist to provide service to the lots and Stormwater detention is managed by the existing basin to the
south. Parkland dedication has already been satisfied with previous plats of the development.
At this time staff would recommend approval of the final plat for Kettlestone Ridge Plat 7,
subject to any remaining staff comments, review of the legal documents, and completion of all public
improvements.
Commissioner Hoifeldt moved to approve the final plat for Kettlestone Ridge Plat 7 subject to any
remaining staff comments, review of legal documents, and completion of all public improvements.

Hoifeldt. Nays: None. Motion Carries.

IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, JERRY’S HOMES, INC., has requested final plat approval of Kettlestone Ridge Plat 7
(the “Plat”); AND,
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of the Plat
on December 8, 2020, subject to remaining staff comments and review of the legal documents; AND,
WHEREAS, the Final Plat for Kettlestone Ridge Plat 7 and the documents relating thereto will
comply with Section §303 - Land Subdivision Ordinance of the Waukee Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee, Iowa on this
4th day of October, 2021, that the Final Plat for Kettlestone Ridge Plat 7 be and the same is hereby
accepted and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following easements
and documents to be filed with the Plat:

HISTORY
The Kettlestone Ridge neighborhood began developing is 2015. Since 2015 the developer, Jerry’s Homes, Inc., has
completed six phases of the single family residential neighborhood for a total of 123 lots. Public improvements for the
seventh phases are currently under construction.
PROJECT DESCRIPTION
LOTS
The final plat identifies a total of 41 lots. All planned lots are intended for single family residential development and meet
the minimum requirements of the R-2 zoning district. The lots range in size from 8,941 square feet to 27,756 square
feet. All lots meet the minimum lot width of 65-feet. Table 1 lists the minimum requirements for the R-2 zoning district.

STREETS AND TRAIL
As part of the public improvements, the developer will install extensions of SE Esker Ridge Drive, SE Florence Drive, and
SE Moraine Court. Sidewalks will be extended along each lot as they are developed.

UTILITIES
Utilities have been extended throughout the plat. Each lot will be served by public water, sanitary sewer, and storm
sewer. Storm water detention is provided for in an existing basin to the south.
PARKLAND
Parkland dedication was satisfied with previous phases of development.
STAFF RECOMMENDATION
Staff recommends approval of the final plat for Kettlestone Ridge Plat 7 subject to remaining staff comments, review of
the legal documents, and completion of public improvements.

DEVELOPER’S AGREEMENT
This Agreement, entered into between the City of Waukee, an Iowa municipal corporation
in the State of Iowa (hereinafter referred to as “City”); Jerry’s Homes, Inc, an Iowa Corporation
with its principal place of business in the City of West Des Moines, Dallas County, Iowa
(hereinafter referred to as “Developer”); and
WHEREAS, Developer owns Property legally described on Exhibit A (the “Property”),
and in in the process of platting the Property as Kettlestone Ridge Plat 7; and
WHEREAS, as part of the platting process Developer is responsible for constructing streets
and other public improvements necessary to serve the developed Property and to address the
burdens on public infrastructure that will be used to serve the Property; and
WHEREAS, Developer has requested that the City approve the final plat before some of
the necessary property has been acquired for the improvement and the dedication of SE Florence
Drive adjacent to Lots 35, 36 and 37 of the final plat to be known is Kettlestone Ridge Plat 7, (see
page 3 of Exhibit A) which Developer represents will be acquired, and SE Florence Drive serving
those lots will be completed by Developer, and available for dedication to the City not later than
30th day of June 2022, and
WHEREAS, the City is willing to approve Kettlestone Ridge Plat 7 as requested by
Developer provided it is understood and agreed by the parties that no site plans, building permits,
or any other City permits will be issued for any activity on Lots 35, 36 and 37 until such time as
Developer aquires the necessary property to construct and complete SE Florence Drive in
accordance with the construction drawings and plans and specs approved by the City; Developer
constructs and completes said improvements in that location; and dedicates the improvements to
the City with required bonds after inspection and approval by the City; and
WHEREAS, the City and the Developer desire to enter into an agreement setting forth their
respective obligations and the parties agree as follows:

1. Scope. The parties agree that this Agreement only addresses the completion and
dedication of SE Florence Drive by Developer in front of lots 35, 36, and 37 of the
Kettlestone Ridge Plat 7 after final plat approval. The Developer has other
obligations associated with the Platting, Site plan and development of the Property
and this Agreement does not in any way effect the obligations of the Developer to
satisfy the obligations imposed by Federal, State and Local laws and regulations.
2. Developer SE Florence Drive Street Improvements
A. The Developer agrees to undertake and complete the SE Florence Drive
Improvements including but not limited to paving a 31 foot PCC street, curb
and gutter, water and sewer main and other associated infrastructure (Also
referred to as “Infrastructure”) in front of lots 35, 36 and 37 of Kettlestone
Ridge Plat 7 on or before the 30 day of June, 2022 in the area generally
depicted on Exhibit A in accordance with the plans and specifications,
construction drawings approved by the City and requirements imposed by
applicable Federal, State and Local authorities.
B. Until such time as Developer completes said Infrastructure, causes them to
be inspected by the City, and dedicates the same to the City free and clear
of any and all liens and encumbrances, and this agreement is released of
record by the City, in its discretion, the parties agree that the City shall not
issue any building permits, or any other permits, concerning any activity
whatsoever on Lots 35, 36, and 37 of Kettlestone Ridge Plat 7. In addition,
Developer agrees not to sell, or otherwise convey, lots 35, 36, or 37 of
Kettlestone Ridge Plat 7 until this agreement is released by the City as
provided herein.
3. Property Dedication. Developer, upon acceptance of Infrastructure by the City,
will dedicate to the City, free and clear of any encumbrances or liens, the property
including ROW, Fee Title, and necessary public easements associated with required
Infrastructure. As part of the dedication process, Developer will provide all
necessary documents including, but not limited to, Warranty Deed, Groundwater
Hazard Statement and Declaration of Value for the purpose of effectuating the
dedication to the City. In addition, all required maintenance bonds shall be
provided to the City by Developer.
4. This Agreement (including all exhibits attached or be attached to this Agreement
by reference), is subject to the prior approval of the City Council of the City of
Waukee, as well as the officers or partners of the Developer and thereafter all
parties shall be bound by this Agreement.
5. Binding Effect. This agreement shall inure to the benefit of and be binding upon
all parties their successors and interests or assigns, if any.

6. Jurisdiction. The parties agree that this Agreement and amendments hereto, if any,
shall be governed by the laws of the State of Iowa. The parties consent and agree
that the proper venue and jurisdiction relative to the enforcement of the terms,
conditions and provisions of this Agreement and amendments hereto, if any, is the
Iowa District Court in and for Dallas County, Iowa.
