October 4, 2021
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members
Anna Bergman Pierce, R. Charles Bottenberg, Larry R. Lyon, Ben Sinclair. Absent: Council
Member Chris Crone.
Also in attendance: City Administrator Tim Moerman (electronically), Public Works Director/City
Engineer Rudy Koester, Planning Coordinator Andy Kass, Finance Director Linda Burkhart,
Human Resources Director Michelle Lindsay (electronically), Marketing & Communications
Director Summer Evans, IT Director Son Le (electronically), Police Chief John Quinn, Police
Officer Kathryn Guess, City Clerk Rebecca D. Schuett, City Attorney Steve Brick.

(E) Agenda Approval – Council Member Sinclair moved to approve the agenda; seconded by
Council Member Lyon. Results of vote: Ayes: Bergman Pierce, Bottenberg, Lyon, Sinclair.
Nays: None. Absent: Crone. Motion carried 4 – 0 – 1.
(F) Monthly Mayor’s Report – Mayor Clarke designated Oct. 3-9 as Fire Prevention Week in
Waukee. She then reviewed upcoming Halloween events such as the Public Safety “Trunk or
Treat” and Beggars’ Night. LIHEAP applications are currently being accepted at City Hall.
Mayor Clarke then noted the City’s Aa2 general obligation credit rating from Moody’s Investors
Service.
(G) Presentations: None
(H) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to R-2, R-2/PD-1, R-3, R-4, and C-1, a property
known as Leach Farm – Mayor Clarke opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied that none had been received
in the clerk’s office. Planning Coordinator Kass reviewed the rezoning application, noting
that the applicant had received consent from owners of 55% of surrounding property. The
development concept plan shows some smaller single family lots as part of the proposed
PD-1 overlay; some concessions for the smaller lots include specific home size, garage
requirements, exterior building materials and landscaping. Mr. Kass reviewed planned street
extensions, as well as a T Ave. paving requirements that will be addressed in a future
development agreement. A portion of the required parkland dedication will be as
greenspace, while the remaining requirement will be as recreational trail development. The
proposed rezoning application is consistent with the City’s Comprehensive Development
Plan. Brandon Stubbs with Stubbs Engineering (participating electronically), representing
the applicant, introduced himself in the event of questions of the council. Council Member
Sinclair asked about the process and timeline for the installation of traffic signals on Hickman
Rd.; Mr. Kass noted a recent corridor development agreement with the Iowa Department of
Transportation that designates those intersections planned for traffic signals and added that
installation was dependent on traffic patterns and counts. No comments were made by the
public in attendance.

1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning

seconded by Council Member Bottenberg. City Attorney Brick noted that the ordinance
would enact a $250 minimum penalty for animal neglect, adding that the court had the

3) Resolution: Consideration of approval of a resolution directing sale of $19,760,000
(subject to adjustment per terms of offering) General Obligation Urban Renewal
Bonds, Series 2021B – Council Member Lyon moved to approve the resolution; seconded
by Council Member Sinclair. Matt Stoffel with PFM Financial Advisors, LLC (participating
electronically) reviewed the bid tabulation, adding that the sale would generate a nice
premium to be applied to next year’s City budget. He recommended sale to Morgan Stanley
& Co., LLC, of New York, NY, at a true interest rate of 1.8468% and net interest cost of
$4,540,513.64. Finance Director Burkhart stated that she was pleased to see such a
competitive bid. Council Member Bottenberg stated that he would abstain from voting due to
a professional conflict of interest. Results of vote: Ayes: Bergman Pierce, Lyon, Sinclair.
Nays: None. Abstentions: Bottenberg (professional conflict of interest). Absent: Crone.

4) Resolution: Consideration of approval of a resolution approving preliminary plat for
Ashley Acres Plat 3 – Council Member Lyon moved to approve the resolution; seconded by
Council Member Sinclair. Planning Coordinator Kass reviewed the plat, which currently
shows several outlots that are currently within the Federal Emergency Management Agency
(FEMA) flood plain. The developer is working with FEMA to reclassify those outlots and if
successful, the outlots will be platted as additional lots. Mr. Kass then reviewed proposed
street extensions and noted the parkland dedication requirement as part of the area
greenway corridor for recreational trails. Results of vote: Ayes: Bergman Pierce, Bottenberg,

5) Resolution: Consideration of approval of a resolution approving preliminary plat for
Glynn Village Plat 12 – Council Member Bottenberg moved to approve the resolution;

plat, final plat and site plan. He noted that the subject plat would be the final phase of the
Glynn Village development. The proposed plat is for townhome development with rear-
loaded units. Exterior building elevations were reviewed. Council Member Bergman Pierce
asked if the units would be owner occupied; Mr. Kass replied in the affirmative. Council
Member Sinclair wondered if the buildings would be of a design similar to existing units to
the north; Mr. Kass responded that the proposed plat included building designs that are a

WORK SESSION MEETING
October 11, 2021
A. Call to Order – The work session meeting of the Waukee City Council was called to order by
Mayor Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd.
B. Roll Call – The following members were present: Mayor Courtney Clarke; Council Members
Anna Bergman Pierce, R. Charles Bottenberg, Chris Crone, Larry R. Lyon, Ben Sinclair. Absent:
None.

1) Red Flag Policy review – Utility Customer Service Supervisor Kathy Ostring reviewed
proposed policy updates to improve customer service and convenience, including the
installation of an outdoor payment kiosk.
2) Purchase cards and policy – Accounting Manager Rachel Bruns discussed the proposed
policy.
3) FY2021-2022 Strategic Plan: Safe Routes to School – Marcus Coenen with Snyder &
Associates presented a guide outline, including the City’s role, potential partners, funding
sources, traffic calming measures, next steps and timeline.
4) FY2021-2022 Strategic Plan: Public Safety Facilities RFP review – Assistant City
Administrator Deets reviewed the RFP process and timeline, including the necessity for a
public referendum.
5) West Des Moines annexation moratorium agreement – Assistant City Administrator
Deets noted a request by certain property owners with a preference for annexation into
Waukee. Mr. Deets reviewed certain considerations related to the request and discussed
council options moving forward.
6) Annexation Services professional services agreement – Assistant City Administrator
Deets reviewed the proposed scope of agreement for continued conversations with property
owners.
7) Public Works Cold Storage Facility update – Public Works Director/City Engineer Koester
reviewed proposed plans, project budget and construction schedule.
8) Public Works Facility Second Floor reconfiguration – Public Works Director/City
Engineer Koester reviewed proposed plans, project budget and construction schedule.
9) Northeast Outfall Sewer professional services agreement – Public Works Director/City
Engineer Koester reviewed proposed plans, project budget and construction schedule.
10) FY2021-2022 Strategic Plan: Sustainability Plan discussion – Mayor Clarke proposed a
framework for council review of sustainability priorities.
11) FY2021-2022 Strategic Plan: Gas hedging strategy update – Public Works Director/City
Engineer Koester discussed past natural gas pricing history, global supply and demand as a
contributing factor in market volatility, and how the City proposes to respond to that volatility.
There was some discussion on proactive communication strategies regarding gas usage and
prices.
12) Road and infrastructure project updates – Public Works Director/City Engineer Koester
provided an update on various projects under construction.
13) 2022 lobbying services and legislative priorities – City Administrator Moerman discussed
a proposed lobbying strategy and priorities.
