AGENDA ITEM:Consideration of approval of Change Order No. 5 to Larson Construction,
Co., Inc., for the Triumph Park Project increasing the contract in the amount
of $53,889.71.

SYNOPSIS INCLUDING PRO & CON: Change Order No. 5 to Larson Construction, Co., Inc., is
for:
Item #1: (27,229.70)
This is a minor change in the detailed construction of the concrete curbs within the ballpark plaza
areas. The original design called for individually formed curbs throughout the plaza spaces and the
walkways would have been poured up against them. The contractor installed the first ones as an
integral curb with the adjacent walkway. The allowed the color concrete to also be reflected on the
curb. City Staff and design team reviewed the installed portion and agreed that the look and final
product was acceptable, but also agreed that it was less work than the originally designed curb details.
This is a credit for the reduced amount of labor to install these curbs.
Items #2: $81,119.41
During the shop drawing process, the design team received a detail from the playground surface
installer that included an asphalt base under the poured in place surfacing material of the Miracle
Field. The design team previously discussed this with the playground manufacturer and installer and
had understood that this poured in place soft surface could be placed on compacted gravel and detailed
it accordingly in the drawing set. After much debate and additional coordination and research;
everyone is in agreement that the best long-term solution for the field is for it to b have an asphalt base
course. This change is to modify the sub-base to be 5” of Asphalt to be placed in two lifts with 4” of
rock surface below. There is a small credit for grading and a decreased amount of rock. A majority of
this cost is the material and labor necessary to complete the asphalt work.

Dear Mr. Jermier:
Attached please find Change Order #5 totaling the amount of $53,889.71, for approval and signature by
Waukee City Council. Quantities have been reviewed and agreed upon by the contractor, City staff, and
Confluence. The City and the Design Team have been on site reviewing items, attending meetings and
completing site review several times a week for the past months. The two items below are all things that
have been thoroughly reviewed with the team. One of them is a credit that the city and design team are
willing to accept on the change of the installation method of the curb and gutter. It saves time and the
owner money to accept this very similar final product. The second item is beyond the initial scope of
work. As you know, many discussions happen in the field, get approved and we agree to move forward
with no cost changes. Your staff and design team are working hard to keep these change orders to a
minimum.
This Change Order accounts for two items:
Item #1: (Concrete Curb Detail Adjustment) ($27,229.70)

Jeff –
The price of $920 only included the changes to the actual sidewalk elevations around the edge of the field. If we are
giving you grades for the field surface, it will cost an additional $920 for a total of $1,840.00 to restake the sidewalks and
give you adequate grade hubs to lay the asphalt for the playing field.

•The grading is not included in this proposal. Finish sub-grade shall be the responsibility of the grading contractor with final elevations established.
Proper compaction of the top 12 inches of suitable material shall be at 95% of the Standard Proctor Density. Our price includes finish blading prior
to paving. Grimes Asphalt and Paving Corporation may proof roll to verify stability for paving.
•Grimes Asphalt and Paving Corporation is not required to supply material or serivces during inclement weather.
•This work requires a two lift construction procedure. Should clean-up be required between the two lifts due to general construction activities,
Grimes Asphalt shall be paid extra for clean-up work, price to be agreed upon prior to performing the clean-up work. (Except minor brooming)
•General contractor to provide/maintain necessary traffic control through completion of paving work.
•This quotation does not include bonding expenses. If required, we will furnish same at an additional 1% of the bid amount.
•To the fullest extent provided by law, Owner shall indemnify, defend and hold harmless Grimes Asphalt and Paving Corporation, it's officers,
directors, employees, and agents from and against all claims, damages, losses, and expenses, including but not limited to attorneys fees and court
costs resulting from or arising out of Owner or Owner Representative failure to provide accurate information of the existence and location of any
non-public utilities or hazardous materials at the project site.
•Final dollar amounts to be based on actual field measured units installed to complete work at the unit price (s) quoted
•If additional contract documents are required this proposal shall be incorporated into the final contract.
•Based on the unknown composition of the sub-base, and natural ground movement, it cannot be guaranteed that cracking will occur.
•Owner will be responsible for site plans, appropriate permits, and all fees associated with the same as required by city, state, or federal regulations
and statutes.
Payment Terms:
This proposal may be withdrawn by us if not accepted within 30 days.
It is understood that progress payments shall be made as work progresses, final payment due upon completion. A service charge of 1-1/2% will be
added if not paid within 30 days from date of invoice.
This proposal voids all previous proposals.
It is understood that Grimes Asphalt may require credit assurances from the customer and/or owner, including but not limited to bank letters of
guarantee and/or payments deposited into escrow accounts before work commences or at anytime during the performance of work.
