AGENDA ITEM: Consideration of approval of a resolution approving a final plat for
Timber Creek Plat 1
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The applicant is requesting approval of a final plat
for a 17.76-acre residential development located north of Ashworth Road
and east of R-22/Ute Avenue. The plat includes 11 lots. All lots meet or
exceed the minimum requirements of the R-1/PD-1 zoning district. All
lots will be access via a private street, Timber Creek Lane. All lots will
have access to public sanitary sewer and water.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the request at their meeting on October 12,
2021, recommended approval subject to remaining staff comments:
Approval of a Final Plat for Timber Creek Plat 1
Planning Coordinator, Andy Kass, introduced the request as submitted by the applicant,
31495 Ashworth Road, LLC, for approval of a single family residential subdivision. The
subject property is generally located north of Ashworth Road and east of R-22/Ute
Avenue, containing approximately 17.76 acres.
Mr. Kass advised that the final plat identified a total of 10 lots that are intended for single
family residential development under the R-1/PD-1 zoning regulations. The lots range in
size from 0.74 acres to 2.81 acres in area. The existing home on the property will remain,
and the horse barn located in outlot Y will not be owned by lots 6 and 7 for personal use
only. Timber Creek Lane will be a private street built to a public street standard and five
foot sidewalks on either side of it.
Public utilities will serve each lot and Stormwater detention is managed by outlot Z
which will be owned and maintained by a Homeowners Association. Parkland dedication
of 0.19 acres will be satisfied with a fee in lieu of additional dedication. All Outlots
located in the 100 year flood plain will be owned by the adjoining lot owner.

At this time staff would recommend approval of the Final Plat for Timber Creek Plat 1
subject to any remaining staff comments.
Commissioner Streit questioned if this was the development that had originally
proposed having a gated entrance. Mr. Kass advised that was correct, however the
applicant has decided against a gated entry.
Commissioner Hoifeldt questioned if additional concrete would be required at the
entrance of the development and along Ashworth Road. Mr. Kass advised that
usually that would be the case, however Ashworth Road has yearly improvements
slated for the next few years and it seems redundant to have someone install it just
for it to be ripped out and replaced in the near future.
Commissioner Streit moved to approve a final plat for Timber Creek Plat 1 subject to any
remaining staff comments. Commissioner Hoifeldt seconded the motion. Ayes: Streit,
Inman, Koshy, Hoifeldt, Ward, and Conley. Nays: none. Motion Carried.
STAFF REVIEW AND COMMENT: All comments have been addressed related to the final
plat.
RECOMMENDATION: Staff recommends approval of the Final Plat for Timber Creek Plat 1.

IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, 31495 Ashworth Road, LLC, has requested final plat approval of Timber Creek Plat 1
(the “Plat”); AND,
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of the Plat
on October 12, 2021, subject to remaining staff comments and review of the legal documents; AND,
WHEREAS, the Final Plat for Timber Creek Plat 1 and the documents relating thereto will comply
with Section §303 - Land Subdivision Ordinance of the Waukee Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee, Iowa on this
1st day of November, 2021, that the Final Plat for Timber Creek Plat 1 be and the same is hereby
accepted and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following easements
and documents to be filed with the Plat:
1. Warranty Deed (Street Lot A);
2. Public Utility Easement;
3. Public Ingress/Egress Easement;
4. Gas Main Easement;
5. Public Sanitary Easement;
6. Public Water Main Easement;

HISTORY
The Commission recently reviewed a rezoning required of the subject property at their meeting on January 26, 2021.
The Commission recommended approval of the request to rezone the property from A-1 to R-1/PD-1. The City
Council approved the rezoning at their meeting on March 1, 2021.
PROJECT DESCRIPTION
LOTS
The final plat identifies a total of ten (10) lots that are intended for single family residential development. The lots range
in size from 0.74-acre to 2.81-acres in area. The existing home on the property that will remain and be located on Lot 6.
Outlots A, B, and C are areas within the 100-year floodplain that will be owned by each adjoining lot owner. Outlot Y is
2.15-acres in area and has an existing horse barn located on it. The barn will not be utilized for commercial or
agricultural purposes, but will be owned jointly by the owners of Lots 6 and 7 for storage.
The bulk regulations for the R-1/PD-1 zoning district are included below in Table 1. All proposed lots comply with the
regulations of the proposed R-1/PD-1 district.

STREETS AND TRAIL
Timber Creek Lane, will be a private street. Five foot sidewalks will be extended along Timber Creek Lane as each lot is
developed.

UTILITIES
Public utilities will serve each lot. Stormwater detention for the project will be provided within Outlot Z, which will be
owned and maintained by the homeowners association.
EASEMENTS
All proposed easements have been indicated on the final plat. Landscape buffer easements have been indicated along
Outlot Z adjacent to Ashworth Road.
PARKLAND DEDCIATION
Parkland dedication requirements apply to the project because of its residential nature. The required amount of
parkland is 0.19-acre. The applicant has proposed to satisfy the remaining balance of parkland with a fee in lieu of
additional land dedication.
STAFF RECOMMENDATION
All proposed lots meet the minimum requirements of the Zoning Ordinance and Planned Development, the final plat is
in general conformance with the Subdivision Ordinance, and the proposed land use of the property is consistent with
the Comprehensive Plan. Staff recommends approval of the final plat for Timber Creek Plat 1 subject to remaining staff
comments.
