HomeMy WebLinkAbout2021-11-15-G01 ARAC LLC Rezoning_PH AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: November 15, 2021 AGENDA ITEM: Public hearing on an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 Agricultural District to K-MF Stacked Med Kettlestone Multi-Family Stacked Medium District and K-MF Stacked High Kettlestone Multi- Family Stacked High District [ARAC, LLC] FORMAT: Public Hearing SYNOPSIS INCLUDING PRO & CON: Staff has received a request for rezoning of approximately 4.83 acres of property from A-1 to various zoning districts associated with development within the Kettlestone defined area. The property is located east of SE Parkview Crossing Drive and south of SE Westown Parkway. Notices were mailed to surrounding property owners on October 30, 2021 and rezoning signs were placed at various locations along the property with the Planning and Zoning Commission and City Council public hearing dates. To date, staff has not received any written correspondence either for or against the proposed rezoning request. After an extensive master planning process, the City Council approved the Kettlestone Master Plan in 2014 followed by the Kettlestone Design Guidelines and Kettlestone Zoning Districts in 2015. The proposed rezoning request generally follows the recommendations of the Kettlestone Master Plan and includes rezoning for 0.64-acres of medium density multi-family and 4.19-acres of high-density multi-family. In early 2021, the adjacent property to the east was rezoned and the applicant wishes to match the zoning on the subject property with the zoning boundaries that were approved as part of the LOLOWAU Property rezoning. Staff anticipates that the property will be combined with the property to the east as it would be difficult to develop the subject property on its own given its shape and dimensions. The northern point of the subject property is 188-feet wide and begins to narrow as the property continues south. In the future, when development occurs a 25- foot landscape buffer will be required along the west line to buffer future development from the existing townhomes and single-family to the west. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: G1 COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission reviewed the rezoning request on November 9, 2021 and recommended approval: Approval of a Rezoning related to a change from A-1 (Agricultural District) to K- MF Stacked Medium (Kettlestone Multi-Family Stacked Medium District) and K- MF Stacked High (Kettlestone Multi-Family Stacked High District) [ARAC, LLC] Planning Coordinator, Andy Kass, introduced the request for rezoning as submitted by the applicant ARAC, LLC. The subject property is generally located east of SE Parkview Crossing Drive and South of SE Westown Parkway, Containing Approximately 4.83 acres. Notices regarding the rezoning were mailed October 30th, 2021. To date Staff has answered one inquiry regarding the rezoning but no comment for or against the rezoning has been made. The Applicant has obtained approximately 53% of adjacent property owners. No specific user of the property has been identified at this time and Staff anticipates that the subject property will eventually be combined with the property to the east as it would be difficult to develop alone due to shape and size. As the rezoning is consistent with the Kettlestone Master Plan, staff would recommend approval with all platting and site plan approval processes required prior to any individual development within the property.  Kristina Johnson of 2445 SE Sawyer Pt. expressed concern at having a high density product so close to her residential home, specifically in regards to child safety, privacy, and preserving the character and value of her neighborhood. Ms. Johnson questioned if there were buffer requirements for the subject property. Mr. Kass advised that the “buffer” wasn’t shown on this map as there is no project at this time for the property, the rezoning is to align the small parcel with the eastern zoning. Regarding traffic, Mr. Kass advised that additional traffic will be added regardless of what development occurs, until a project is submitted staff is unable to provide detailed input on the potential effect as it is variable depending on what type of product develops. When asked about a time frame, Mr. Kass reiterated that there is no time frame as there is no project currently in the works for this parcel, this is just rezoning the land for potential future use.  Subhamony Pal of 2435 SE Sawyer Pt. questioned the width of the parcel. Mr. Kass advised it was approximately 188 feet wide, and that a buffer in this zone would be the required 25 foot width bordering SE Parkview Crossing Drive. Mr. Kass also advised that the Kettlestone Guidelines would require additional plantings from what was required for the residential development to the west, however, what the landscape buffer could contain is dependent upon linear frontage measurements, which are unknown without a project in place.  Commissioner Koshy took the time to explain that the “stacked” indication for the zoning district does not always indicate height, rather it is in regards to density which can be accomplished in different ways. Mr. Kass added that the height requirements allow for a 3(medium) and 5 (high) story development to occur, however it is only a potential not a given. Residential homes are allowed to be 40 feet in height within the zoning district to the west however one has not been built to that extent, for example.  Mr. Pal questioned if Staff could notify homeowners of upcoming commission review of this property. Mr. Kass advised that staff is not required to do that outside of rezoning requests, however he advised that residents can make the request to the City Council and at the Council’s direction, staff would send notices. The next City Council meeting is scheduled for 11/15/2021 at 5:30 pm via zoom or in person at the Waukee City Hall. Commissioner Inman moved to approve the Rezoning request from A-1 (Agricultural District) to K-MF Stacked Medium (Kettlestone Multi-Family Stacked Medium District) and K-MF Stacked High (Kettlestone Multi-Family Stacked High District). The motion was seconded by Commissioner Broderick. Ayes: Inman, Koshy, Broderick, Hoifeldt, and Ward. Nays: none. Motion Carried. STAFF REVIEW AND COMMENT: Staff believes the proposed rezoning request is consistent with the previous planning efforts that have been undertaken within the overall Kettlestone defined area and would recommend approval of the rezoning request. BACKGROUND The subject property is located within the Kettlestone Corridor and includes approximately 4.83 acres of property that is generally located west of Grand Prairie Parkway. As a part of the planning and construction of Grand Prairie Parkway, the City invested in the development of the Kettlestone Master Plan to provide a tool for development of the property adjoining both east and west of Grand Prairie Parkway from Interstate 80 to University Avenue. This planning document has been utilized as a guide for the rezoning of various properties over the last five years that adjoin Grand Prairie Parkway. As a part of the master plan process, the City also adopted new zoning districts which were specific for properties located within the Kettlestone Master Plan. Comprehensive design standards were also adopted which detail building placement, parking lot location, building design and architecture, access management and open space components among other things. The applicant has submitted a rezoning request that includes approximately .064 acres proposed to be rezoned to the Kettlestone Multi-Family medium density district and 4.19 acres proposed to be rezoned to the Kettlestone Multi-Family high density district. The proposed rezoning request is generally consistent with the Kettlestone Master Plan. The applicant received 53% consent from adjoining property owners within 250-feet of the area proposed to be rezoned. Notice regarding the rezoning request was mailed to the surrounding property owners on October 30, 2021. Additionally, signs regarding the rezoning date and time for Planning and Zoning Commission and City Council have been placed at various locations where the property adjoins public streets. While the Kettlestone Master Plan was intended to function as a guideline for future development, it did not establish specific zoning boundaries, which is what is proposed with this process. The proposed rezoning boundaries as shown in the image above on the right in general follow the recommended land uses of having multi-family residential development along SE Parkview Crossing Drive to provide a transition between the adjoining single-family residential to the west and the future commercial and office development to the east. No specific user of the property has been identified at this time. Staff anticipates that the property will be combined with the property to the east as it would be difficult to develop the subject property on its own given its shape and dimensions. STAFF RECOMMENDATION The proposed rezoning request is generally consistent with the approved Kettlestone Master Plan and Kettlestone Design Guidelines and staff would recommend approval.
