AN ORDINANCE TO AMEND CHAPTER 169, ZONING ORDINANCE, CITY OF
WAUKEE, IOWA BY AMENDING THE ZONING FROM A-1 (AGRICULTURAL
DISTRICT) TO K-MF STACKED MED (KETTLESTONE MULTI-FAMILY STACKED
MEDIUM DISTRICT) AND K-MF STACKED HIGH (KETTLESTONE MULTI-
FAMILY STACKED HIGH DISTRICT) FOR CERTAIN PROPERTY [ARAC, LLC]
BE IT ORDAINED by the Council of the City of Waukee:
Section 1. Section 160.02 of Chapter 169, Waukee Municipal Code, Zoning
Ordinance of the City, adopting the Official Zoning Map, is hereby amended by amending the
following real estate (Property) from A-1 (Agricultural District) to K-MF Stacked Med
(Kettlestone Multi-Family Stacked Medium District), legally described as follows:
A PORTION OF GOVERNMENT LOT 14, SECTION 4 TOWNSHIP 78 NORTH, RANGE 26
WEST OF THE 5th P.M., CITY OF, WAUKEE, DALLAS COUNTY, IOWA, AND PARCEL
'CC' OF THE PLAT OF SURVEY RECORDED IN BOOK 2013, PAGE 20096, DESCRIBED
AS FOLLOWS: COMMENCING AT THE SOUTHEAST CORNER OF GOVERNMENT LOT
14; THENCE S00°18'34"W, 10.68 FEET CENTERLINE OF S.E. PARKVIEW CROSSING
DRIVE TO THE POINT OF BEGINNING; THENCE N29°21'03"W, 114.71 ALONG SAID
CENTERLINE OF S.E. PARKVIEW CROSSING DRIVE TO A 1000.00 FOOT RADIUS
CURVE CONCAVE TO THE NORTHEAST, A DISTANCE OF 248.14 FEET ALONG SAID
CENTERLINE OF S.E. PARKVIEW CROSSING DRIVE, SAID CURVE HAVING A
CHORD BEARING OF N22°14'031"W, AND A CHORD LENGTH OF 247.51 FEET;
THENCE N89°47'24"E, 151.69 329.64 FEET ALONG THE EAST LINE OF GOVERNMENT
LOT 14 TO THE POINT OF BEGINNING.
SAID TRACT OF LAND CONTAINS 0.643 ACRES MORE OR LESS.
SAID TRACT OF SUBJECT TO ALL EASEMENTS OF RECORD.

Ordinance of the City, adopting the Official Zoning Map, is hereby amended by amending the
following real estate from A-1 (Agricultural District) to K-MF Stacked High (Kettlestone Multi-
Family Stacked High District), legally described as follows:

WEST OF THE 5th P.M., CITY OF, WAUKEE, DALLAS COUNTY, IOWA, AND PARCEL
'CC' OF THE PLAT OF SURVEY RECORDED IN BOOK 2013, PAGE 20096, DESCRIBED
AS FOLLOWS:
COMMENCING AT THE SOUTHEAST CORNER OF GOVERNMENT LOT 14; THENCE
N00°18'34"E, 318.96 FEET ALONG THE EAST LINE OF SAID GOVERNMENT LOT 14 TO
THE POINT OF BEGINNING; THENCE S89°47'24"W, 151.69 FEET TO THE CENTERLINE
OF S.E. PARKVIEW CROSSING DRIVE; THENCE NORTHERLY ALONG A 1000.00
FOOT RADIUS CURVE CONCAVE TO THE NORTHEAST, A DISTANCE OF 270.67 FEET
ALONG SAID CENTERLINE OF S.E. PARKVIEW CROSSING DRIVE, SAID CURVE
HAVING A CHORD BEARING OF N07°22'45"W, AND A CHORD LENGTH OF 269.84
FEET TO A POINT OF TANGENCY; THENCE N00°22'29", 713.36 FEET ALONG SAID

WESTOWN PARKWAY; THENCE N83°33'26"E, 188.26 ALONG SAID CENTERLINE OF
S.E. WESTOWN PARKWAY; THENCE S00°18'24"W, 1331.18EET ALONG SAID EAST
LINE OF GOVERNMENT LOT 14 TO THE POINT OF BEGINNING.
SAID TRACT OF LAND CONTAINS 4.194 ACRES MORE OR LESS.
SAID TRACT OF SUBJECT TO ALL EASEMENTS OF RECORD.
Section 3. Repealer. All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 4. Severability Clause. If any section, provision or part of this ordinance
shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section 5. Effective Date. This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
