Hickman Rd. and electronically via Zoom. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members Anna Bergman Pierce, R. Charles Bottenberg, Chris Crone, Larry R. Lyon, Ben Sinclair. Absent: None. Also in attendance: City Administrator Tim Moerman, Assistant City Administrator Brad Deets, Planning Coordinator Andy Kass, Finance Director Linda Burkhart, Human Resources Director Michelle Lindsay (electronically), Marketing & Communications Director Summer Evans, IT Director Son Le (electronically), Police Lt. Jeremy Long, Police Officer Kathryn Guess, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Open Forum (E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council Member Sinclair. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (F) Monthly Mayor’s Report – Mayor Clarke reminded all of Election Day on Nov. 2. The week of Nov. 8, Waukee residents will receive phone calls as part of a gas safety survey. Registration is open for the Waukee Police Department Citizens Academy. Mayor Clarke then reviewed City office closings for Veterans Day and Thanksgiving, noting holiday changes in garbage and recycling collection. She added that yard waste pick-up continues through Nov. 29. (G) Presentations: None (H) Public Hearings: 1) On consideration of an annexation moratorium agreement between the City of Waukee, Iowa, and the City of Van Meter, Iowa – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Assistant City Administrator Deets reviewed the 10-year moratorium agreement, including proposed borders and minor adjustments to the agreement currently in effect. The City of Van Meter is expected to hold their public hearing on the agreement on Nov. 8. No comments were made by the public in attendance. 2) On consideration of an annexation moratorium agreement between the City of Waukee, Iowa, and the City of West Des Moines, Iowa – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Assistant City Administrator Deets reviewed the 10-year moratorium agreement, noting that there is currently no moratorium agreement between Waukee and West Des Moines as the previous agreement expired in 2016. The proposed agreement does not include the Napa Valley development; those residents have the option to annex to either city when the development requires public water or sewer. Mr. Deets then referenced an earlier request from residents along the I-80 corridor, stating their desire to be part of a Waukee annexation and not West Des Moines. Staff from both cities met on the request, with West Des Moines staff noting that future roadway and utility access was already planned by that city. Also, including those neighborhoods in Waukee’s area would limit West Des Moines’ ability to annex other properties without creating an “island”. As a result, Waukee staff recommends approval of the moratorium agreement as presented. No comments were made by the public in attendance. 3) On the annexation of consenting property by the City of Waukee, Iowa [Bormann property] – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received I1B 2 in the clerk’s office. Assistant City Administrator Deets gave a brief history of annexation efforts between Waukee and Clive along N. Warrior Ln. Following Waukee’s annexation of the Bormann and Brcka properties, Clive can annex a strip along N. Warrior Ln. to facilitate development in their city. The proposed Bormann annexation is through voluntary consent. Council Member Bottenberg referenced an email received by mayor and council [from resident Jan Blazanin] and asked Mr. Deets to reiterate City staff’s position on some of her comments. Mr. Deets clarified that preannexation agreements are typical and are consistent with past practices to allow for City tax transitioning as allowed by State code. Mr. Deets noted that such agreements are tailored to individual properties and needs. Regarding an open burning concern, Fire Chief Robinson had spoken with the Bormanns about ceasing open burning once housing starts to develop to the north. Mr. Deets then noted that the Bormann property was already connected to certain City utilities. Mayor Clarke stated that she had additional conversations with Ms. Blazanin about her open burning concerns. No comments were made by the public in attendance. 4) On the annexation of consenting property by the City of Waukee, Iowa [Brcka property] – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Assistant City Administrator Deets reviewed the application, adding that a preannexation agreement had been previously approved by council. The proposed Brcka annexation is through voluntary consent. No comments were made by the public in attendance. (I) Public Hearing Action Items: 1) Resolution: Consideration of approval of a resolution approving a 28E agreement providing for an annexing moratorium between the Cities of Waukee and Van Meter – Council Member Crone moved to approve the resolution; seconded by Council Member Bottenberg. Assistant City Administrator Deets stated that the agreement aligned with Waukee’s comprehensive development plan. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2021- 458) 2) Resolution: Consideration of approval of a resolution approving a 28E agreement providing for an annexing moratorium between the Cities of Waukee and West Des Moines – Council Member Lyon moved to approve the resolution; seconded by Council Member Sinclair. Assistant City Administrator Deets recognized that the proposed agreement does not address all concerns of impacted residents but clarified that the agreement does not necessarily mean annexation will occur. The City of West Des Moines is expected to hold their public hearing on the agreement tonight [Nov. 1]. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. (Resolution #2021-459) 3) Resolution: Consideration of approval of a resolution approving the annexation of consenting property by the City of Waukee, Iowa [Bormann property] – Council Member Crone moved to approve the resolution; seconded by Council Member Bergman Pierce. Assistant City Administrator Deets noted that, following approval, the annexation would be presented to the City Development Board in tandem with the City of Clive’s annexation of the N. Warrior Ln. properties. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2021- 460) 4) Resolution: Consideration of approval of a resolution approving the annexation of consenting property by the City of Waukee, Iowa [Brcka property] – Council Member Sinclair moved to approve the resolution; seconded by Council Member Lyon. Warrior Lane Traffic Signalization professional services agreement – Assistant Public Works Director of Engineering Kappos reviewed the proposed project area, construction timeline and budget estimate. 11) Meredith Drive Overlay professional services agreement – Assistant Public Works Director of Engineering Kappos reviewed the proposed project area, construction timeline and budget estimate. 12) Road and infrastructure project updates – Assistant Public Works Director of Engineering Kappos provided an update on various projects under construction. 2 13) Bird Scooter program discussion – Parks & Recreation Director Jermier discussed a proposed pilot program for e-scooters in the community, including concerns, a potential launch date, and needed ordinance revisions. 14) Swimming pool fencing requirements – Assistant City Administrator Deets reminded the council of a resident request for the allowance of automatic pool covers in lieu of fencing. Mr. Deets had discussed the request with some area insurance agents, who stated that their policies would still require a fence, with or without a pool cover. Mayor Clarke stated that she also spoke with insurance providers, who stated their coverage would vary on a case- by-case basis.
