Home My WebLink About2021-12-06-I01 Voting Precincts_Dallas Co MOU AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: December 6, 2021 AGENDA ITEM: Consideration of approval of a resolution approving a Memorandum of Agreement between Dallas County and City of Waukee regarding combined voting precincts FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: Following the federal decennial census, and after the redistricting of congressional and legislative districts, city councils and county boards of supervisors are required to complete any changes in precinct and supervisor districts (for counties). Election precincts which are composed partially of unincorporated territory within a county and partially of part of a city may be established, if an agreement which is mutually satisfactory to the board of supervisors of the county and to the city council of the city is adopted and submitted to the state commissioner as part of the certification of precinct boundaries. Dallas County has approached the City of Waukee to include portions of Boone, Van Meter and Walnut Townships both north and south of Interstate 80. Due to Waukee’s unique City limits, there are portions of Boone, Van Meter and Walnut Townships that are no longer contiguous with other parts of the individual township. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the resolution. Map of Included Areas PREPARED BY: Brad Deets, Assistant City Administrator I1 THE CITY OF WAUKEE, IOWA RESOLUTION 2021- APPROVING THE MEMORANDUM OF AGREEMENT BETWEEN DALLAS COUNTY AND CITY OF WAUKEE REGARDING COMBINED VOTING PRECINCTS IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, following the federal decennial census, and after the redistricting of congressional and legislative districts, city councils and county boards of supervisors are required to complete any changes in precinct (for cities) or precinct and supervisor districts (for counties); AND, WHEREAS, election precincts which are composed partially of unincorporated territory within a county and partially of part of a city may be established, if an agreement which is mutually satisfactory to the board of supervisors of the county and to the city council of the city is adopted and submitted to the state commissioner as part of the certification of precinct boundaries; AND, WHEREAS, Dallas County has requested that portions of unincorporated territory in Walnut Township, Boone Township and Van Meter Township be incorporated within the precincts for the City of Waukee. Lyon Ben Sinclair Memorandum of Agreement The parties to this agreement are the City of Waukee, Iowa (“City”), and Dallas County, Iowa (“County”). This agreement is entered into as of _____________, 2021. Whereas: 1. Following the federal decennial census, and after the redistricting of congressional and legislative districts, city councils and county boards of supervisors are required to complete any changes in precinct and ward boundaries (for cities) or precinct and supervisor districts (for counties). 2. Election precincts which are composed partially of unincorporated territory within a county and partially of part of a city may be established, if an agreement which is mutually satisfactory to the board of supervisors of the county and to the city council of the city is adopted and submitted to the state commissioner as part of the certification of precinct boundaries. 3. The City and County desire to have a combined precinct, namely: a: Waukee 2; b: Waukee 1; c: Waukee 8; d: Waukee 10 (Insert name and/or number of precincts on line above) Therefore, the parties agree to the provisions set forth below. 1. The above-named and/or numbered precinct shall be composed of incorporated territory of the City of Waukee and unincorporated territory listed below: a. That portion of unincorporated Walnut Township lying along N. Warrior Lane AND that portion of unincorporated Walnut Township lying along 300th St. AND that portion of unincorporated Walnut Township lying south of 270th St. and east of T Ave. b. That portion of unincorporated Boone Township lying north of Ashworth Rd., west of Ute Ave. c. That portion of unincorporated Boone Township lying north of Ashworth Rd, east of Ute Ave. d. That portion of unincorporated Boone Township lying south of Ashworth Rd, north of I- 80 AND that portion south of I-80, west of Ute Avenue and north of extended Napa Valley Dr. AND that portion of unincorporated Van Meter Township not contiguous with the remainder of Van Meter Township, lying south of 340th Trail and north of the Raccoon River. 2.
