HomeMy WebLinkAbout2021-12-06-I02 Voting Precincts_Clive MOU AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: December 6, 2021 AGENDA ITEM: Consideration of approval of a resolution approving a Memorandum of Agreement between the Cities of Clive and Waukee regarding combined voting precincts FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: Following the federal decennial census, and after the redistricting of congressional and legislative districts, city councils and county boards of supervisors are required to complete any changes in precinct and supervisor districts (for counties). Election precincts which are composed partially of unincorporated territory within a county and partially of part of a city may be established, if an agreement which is mutually satisfactory to the board of supervisors of the county and to the city council of the city is adopted and submitted to the state commissioner as part of the certification of precinct boundaries. Dallas County has approached the City of Waukee to include a small portion of the City of Clive at the corner of NW 142nd Street because it is not contiguous with the remaining portions of the City of Clive within Dallas County. The City of Clive is expected to take action on the proposed Memorandum of Agreement at their City Council Meeting on December 9, 2021. This is a similar memorandum to the one that was approved in 2011 for the same purpose. The inclusion of these areas within Waukee precincts would only impact general and county elections and not local municipal elections. Map of Included Areas PREPARED BY: Brad Deets, Assistant City Administrator I2 THE CITY OF WAUKEE, IOWA RESOLUTION 2021- APPROVING THE MEMORANDUM OF AGREEMENT BETWEEN THE CITIES OF CLIVE AND WAUKEE REGARDING A COMBINED VOTING PRECINCT IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, following the federal decennial census, and after the redistricting of congressional and legislative districts, city councils and county boards of supervisors are required to complete any changes in precinct (for cities) or precinct and supervisor districts (for counties); AND, WHEREAS, election precincts which are composed partially of unincorporated territory within a county and partially of part of a city may be established, if an agreement which is mutually satisfactory to the board of supervisors of the county and to the city council of the city is adopted and submitted to the state commissioner as part of the certification of precinct boundaries; AND, WHEREAS, Dallas County has requested that a portion of the City of Clive be incorporated within the precincts for the City of Waukee due to the area not being contiguous with the rest of the City of Clive. Lyon Ben Sinclair Memorandum of Agreement The parties to this agreement are the City of Clive, Iowa and the City of Waukee, Iowa. This agreement is entered into as of _______________________, 2021. Whereas: 1. Following the federal decennial census, and after the redistricting of congressional and legislative districts, city councils are required to complete any changes in precinct and ward boundaries. 2. Election precincts must be composed of contiguous territory within a single county. 3. The City of Clive and the City of Waukee desire to have a combined precinct, namely: Waukee Precinct 7 (Insert name and/or number of precinct on line above) Therefore, the parties agree to the provisions set forth below. 1. The above-named and/or numbered precinct shall be composed of incorporated territory of the City of Waukee and an incorporated island of the City of Clive lying south of Belfry Drive in Waukee and not contiguous to the remainder of the City of Clive in Dallas County. 2. The boundaries of the precinct shall be described by the City of Waukee by ordinance. Dated this _____ day of ____________, 2021.
