Supplemental Agreement No. 3 with Confluence [Triumph Park]

SYNOPSIS INCLUDING PRO & CON: The Request for Additional Services is related to the
additional scope on the civil design portion of Triumph Park, specifically the
SWPPP Plan. Foth Engineering was asked to adjust the plans once the high
school completed the initial mass grading of the site and then became
Triumph Park. This work clarified basins that would stay in place and ones
that would have to be removed. Confluence was billed an additional $6,500
for the work. Change Order #2 also included an adjustment from a 4” water
line, to a 6” water line for the maintenance building. Foth agreed that they
were partially responsible for some of those costs and have requested that we
deduct $2,372.50 from the payment owed. The original billing from FOTH is
attached and has not been marked up by Confluence.

RESOLUTION 2021-
APPROVING PROFESSIONAL SERVICES SUPPLEMENTAL AGREEMENT NO. 3
WITH CONFLUENCE [TRIUMPH PARK]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on February 20, 2018, the Waukee City Council approved an Agreement for
Professional Consulting Services with Confluence, Inc., for design services related to the
Waukee Youth Sports Complex/Triumph Park (Resolution #18-076); AND,
WHEREAS, on April 20, 2020, the Waukee City Council approved Supplemental Agreement
No. 1 for additional work (Resolution #2020-157); AND,
WHEREAS, on September 21, 2020, the Waukee City Council approved Supplemental
Agreement No. 2 for construction administration services (Resolution #2020-358); AND,
WHEREAS, the City recommends approval of a Professional Services Supplemental Agreement
No. 3 with Confluence for additional services related to the civil design portion of Triumph Park,
specifically the Stormwater Pollution Prevention Plan (SWPPP);
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Professional Services Supplemental Agreement No. 3 with Confluence [Triumph Park] is hereby
approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 6th day of December,
2021.

Supplemental Services Agreement # 3 – Site SWPP Plan adjustments and Waterline Design Credit
Dear Tim and Matt,
As you know we have been working with FOTH Engineering of the civil portion of the Triumph Park project. Early on it the process they were asked to make
some adjustments to the SWPPP Plan that were outside of our original scope. It had to do with some of the transition from what was the High School project
and then became the Triumph Park project. Clarifying basins that would stay in place and ones that would be removed. We were billed $6,500 last fall for
this work. At the time we had several other changes being made with the project and we agreed to sit on this additional fee until those things were finalized.
In the meantime, work was progressing on the project. As part of this work there was a water line that was shown in the drawing to be a 4” water line, but
in order to truly function with the equipment specified; this line needed to be a 6” water line. FOTH felt somewhat responsible for this discrepancy in the
drawings and generously offered to reimburse the City for this change. The cost and labor for this change was $2,372.50.
We are asking that the City amend our original design contract by the balance of the two numbers. ($6,500 SWPPP Amendments) – ($2,372.50 Water Line
Credit) = $4,127.50. The original billing from FOTH is attached and has not been marked up.
