Hickman Rd. and electronically via Zoom. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members Anna Bergman Pierce (electronically), R. Charles Bottenberg, Chris Crone, Larry R. Lyon, Ben Sinclair. Absent: None. Also in attendance: City Administrator Tim Moerman, Assistant City Administrator Brad Deets, Planning Coordinator Andy Kass, Finance Director Linda Burkhart, Public Works Director/City Engineer Rudy Koester, Human Resources Director Michelle Lindsay, Marketing & Communications Director Summer Evans, Parks & Recreation Director Matt Jermier, Police Lt. Jeff Mellencamp, Police Officer Kathryn Guess, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Open Forum – Chad Brewbaker, SE Bishop Dr. (no specific address given), addressed the council concerning allegations he has asserted against multiple parties in litigation he has filed. (E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council Member Crone. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (F) Monthly Mayor’s Report – Mayor Clarke thanked the Parks & Recreation Department and Park Board for a successful WinterFest event on Dec. 3. She reminded all of the City’s snow ordinance and when it goes into effect. The Waukee Police Department has some holiday safety tips and offers house checks. Mayor Clarke then reviewed Christmas and New Year’s Day closures for City offices and wished everyone a safe and happy holiday season. (G) Presentations: None (H) Public Hearings: 1) On an ordinance to amend Chapter 6, City Elections, by repealing Section 6.07, Voting Precincts, and enacting new election precincts as specified – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Assistant City Administrator Deets reviewed a proposed precinct map, explaining that redistricting is required following every decennial U.S. census. He reviewed the requirements for drawing precinct borders, then discussed population distribution within each proposed precinct. No comments were made by the public in attendance. 2) On plans, specifications, form of contract and estimate of cost [NW Douglas Parkway Culvert and Pond Improvements Project] – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Public Works Director/City Engineer Koester reviewed the project, including grading for future recreational trail extensions. He then reviewed the proposed project budget and construction schedule. No comments were made by the public in attendance. (I) Public Hearing Action Items: 1) Resolution: Consideration of approval of a resolution approving Memorandum of Agreement between the City of Waukee and Dallas County regarding combined election precincts – Council Member Sinclair moved to approve the resolution; seconded by Council Member Bottenberg. Assistant City Administrator Deets reviewed the agreement concerning unincorporated areas of the county that are no longer contiguous with other parts of the township. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2021-492) I1B 2 2) Resolution: Consideration of approval of a resolution approving Memorandum of Agreement between the City of Waukee and City of Clive regarding a combined election precinct – Council Member Crone moved to approve the resolution; seconded by Council Member Sinclair. Assistant City Administrator Deets reviewed the agreement concerning a small area within Clive city limits that would be incorporated into a Waukee election precinct. The proposed agreement is identical to one currently in effect between the two cities. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2021-493) 3) Ordinance: Consideration of approval of a resolution approving the annexation of consenting property by the City of Waukee, Iowa [Bormann property of approval of an ordinance to amend Chapter 6, City Elections, by repealing Section 6.07, Voting Precincts, and enacting new election precincts as specified [introduction; first reading] – Council Member Lyon introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Sinclair. Mayor Clarke thanked City staff for their work on the proposed precinct areas. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. 4) NW Douglas Parkway Culvert and Pond Improvements Project A. Resolution: Consideration of approval of a resolution approving plans, specifications, form of contract and estimate of cost – Council Member Crone moved to approve the resolution; seconded by Council Member Lyon. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2021-494) B. Resolution: Consideration of approval of a resolution awarding contract – Council Member Sinclair moved to approve the resolution; seconded by Council Member Lyon. Public Works Director/City Engineer Koester reviewed the bid tabulation, recommending award to low bidder Elder Corporation of Des Moines, IA, in the amount of $2,514,850.00. Results of vote: Ayes: Bergman Pierce, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2021-495) (J) Action Items: 1) Consent Agenda: Council Member Lyon moved to approve the Consent Agenda; seconded by Council Member Bottenberg. Council Member Lyon asked for clarification on Consent Agenda Item #J1G1; Public Works Director/City Engineer Koester reviewed the scope of the proposed change order.
