HomeMy WebLinkAbout2021-12-20-I09 Purchase Agreeement_Prairie Rose Waukee, LLC AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: December 20, 2021 AGENDA ITEM: Consideration of approval of a resolution approving Offer to Buy Real Estate and Acceptance (Nonresidential) [Prairie Rose Waukee, LLC] FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: As a part of the strategic planning process, the City Council identified opportunities for affordable housing development as a top priority of the City. One of the action steps that was identified was for the City to secure the acquisition of property which would allow for coordination with the development community on new affordable housing units based upon parameters, guidelines and requirements that would be established by the City. City staff identified a number of potential properties that could be acquired and is recommending proceeding forward with a Purchase Agreement with Prairie Rose Waukee, LLC for the acquisition of 16.41 acres which is located west of Warrior Lane and both north and south of the future extension of Douglas Parkway. The property is currently zoned rowhouse and townhome dwelling district and can support the development of up to 12 units per acre. The proposed acquisition price is $55,000 per acre and the purchase agreement and sale is subject to completion of an appraisal on the property. Upon successful completion of the additional provisions within the Agreement, it is expected that the City would close on the property on March 1, 2022. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: $902,550.00 COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the resolution. Purchase Agreeement PREPARED BY: Brad Deets REVIEWED BY: I9 THE CITY OF WAUKEE, IOWA RESOLUTION 2021- RESOLUTION APPROVING PURCHASE AGREEMENT FOR CERTAIN PROPERTY LOCATED IN THE CITY OF WAUKEE IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND WHEREAS, the City desires to enter into a Purchase Agreement (hereinafter referred to as the “Agreement”) and said Agreement has been accepted by the Seller, for certain property generally located west of Warrior Lane and both north and south of Douglas Parkway as it is extended; AND WHEREAS, the City Council of the City of Waukee deems it to be in the best interest of the City to purchase the property; AND WHEREAS, the proposed Agreement between Prairie Rose Waukee, LLC and the City of Waukee is attached as Exhibit “A.” NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee that the Purchase Agreement attached hereto as Exhibit A is approved. BE IT FURTHER RESOLVED that City Staff is directed to proceed in accordance with the Agreement. Upon the determination of the City Attorney that the conditions of the offer have been satisfied and title delivered staff is authorized and directed to proceed with closing.
