HomeMy WebLinkAbout2021-02-01-Resolution 2021-062_Set Public Hearing Date, Bonds, Golf Course Equipment Lease Purchase AgreementRESOLUTION NO. 2021-062 RESOLUTION SETTING TIME AND DATE OF HEARING ON THE AUTHORIZATION OF A LEASE PURCHASE AGREEMENT IN THE AMOUNT OF NOT TO EXCEED S50,000 FOR THE ACQUISITION OF GOLF COURSE EQUIPMENT WHEREAS, it is deemed necessary and advisable that the City of Waukee, State of Iowa, should provide for the authorization and issuance of a Lease Purchase Agreement to the amount of not to exceed $50,000, for the purpose of acquiring equipment for the City's golf course enterprise, as authorized by Section 364.4 of the Code of Iowa; and WHEREAS, the Lease Purchase Agreement shall be payable from the Debt Service Fund; and WHEREAS, the proposed equipment acquisition constitutes a general corporate purpose of the City for general obligation financing. The City has a population of more than 5,000, but not more than 75,000, and the amount of the lease for this purpose does not exceed $700,000; and WHEREAS, before the Lease Purchase Agreement may be authorized, it is necessary to comply with the provisions of the Code of Iowa, as amended, and to publish a notice of the proposal and the right to petition for an election. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WAUKEE, STATE OF IOWA: Section 1. That the City Council, at a meeting to be held commencing at 5:30 P.M. on February 16, 2021, in Council Chambers, Waukee City Hall, 230 W. Hickman Road, Waukee, Iowa, will hold a hearing for the purpose of taking action on the matter of the authorization of a General Obligation Lease -Purchase Agreement for a general corporate purpose of the City, the proceeds of which will be used to acquire equipment for the City golf course enterprise. Section 2. The City Clerk is hereby directed to cause at least one publication to be made of a notice of the meeting, in a legal newspaper, printed wholly in the English language, published at least once weekly, and having general circulation in the City. The publication to be not less than ten nor more than twenty days before the date of public meeting on the proposal to enter into the Lease Purchase Agreement, and to be substantially in the following form: I'o be published on or before February 2, 2021 NOTICE OF MEETING OF THE CITY COUNCIL OF THE CITY OF WAUKEE, STATE OF IOWA, ON THE PROPOSITION TO AUTHORIZE NOT TO EXCEED $50,000 GENERAL OBLIGATION LEASE PURCHASE AGREEMENT FOR GOLF COURSE EQUIPMENT PAYABLE FROM THE DEBT SERVICE LEVY PUBLIC NOTICE is hereby given that the Council of the City of Waukee, State of Iowa, will hold a public hearing on the 16"' day of February, 2021, at 5:30 P.M., in the Council Chambers, Waukee City Hall, 230 W. Hickman Road, Waukee, Iowa, at which meeting the City Council proposes to take additional action for the authorization of a lease purchase agreement in the principal amount of not to exceed $50,000 to provide for the acquisition of equipment for the City's golf course enterprise. The lease shall be secured by the debt service levy of the City. At any time before the date of the meeting, a petition, asking that the question of entering into such lease be submitted to the legal voters of the City, may be tiled with the Clerk of the City, including the drop box at City Hall during non -business hours, in the manner provided by Section 362.4 of the Code of Iowa. Also, at the above meeting the City Council shall receive oral or written objections from any resident or property owner of the City to the above action. After all objections have been received and considered, the Council will at this meeting or at any adjournment thereof, take additional action for the authorization of the lease agreement or abandon the proposal. This Notice is given by order of the Council of the City of Waukee, State of Iowa, as provided by Sections 364.4 of the Code of Iowa, as amended. Dated this Is' day of February, 2021. Rebecca D.
