RESOLUTION 19-031
APPROVING GAS MAIN EASEMENT(S) FOR THE NORTHWEST AREA WATER
MAIN EXTENSION PHASE 2 PROJECT [PHILLIPS-HAMILTON, INC.]
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA UKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, it has been determined that a Gas Main Easement is necessary for the purpose of
construction of the Northwest Area Water Main Extension Phase 2 Project; AND,
WHEREAS, said easement shall be located on a portion of the property owned by Phillips -
Hamilton, Inc., and legally described as referenced in Exhibit A, Easement Area, of the Gas
Main Easement(s) which is attached hereto.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
21 St day of January, 2019, that it hereby approves the Gas Main Easement(s) for the Northwest
Area Water Main Extension Phase 2 Project [Phillips -Hamilton, Inc.] in the amount of $1.00.

thereof, to construct. replace. locate. rebuild, enlarge, reconstruct, patrol, repair (including the ri,aht

appurtenances thereto) and to freer maintain the Gas %Lain whenever necessary within the
Kasement(s) granted herein. NO structure or huildin" of any kind whatsoever shall he erected upon

After the initial construction of the Gas Mak. and acceptance by the City. the C iq agrees, as part
of the reconstruction, maintenance and patrolling of the Gas Vain. to restore and replace the
I-;ascment arca(s) to suhstantially the same condition as prior to the time ofenq or as agreed upon
by the Cite and the Gra law(s). except the Cite shall not be required to replace landscaping, trees.
shrubs. bushes, landscape elements, structurev or underground water systems nor shall the Cite he
required to restore the f-.asentent area by reason ol, settlement, depression. or any unkno\yn
conditions which arise subsequent to the restoration and/or replacing cif the casement area: any
subsequent restoration by reason of settlement. depression or any unkno" n conditions shall be the
sole responsibility ol'thc Grantor(s) at the Grantor(s)' sole expense.
4. Right of Access.
