RESOLUTION 19-146
RESOLUTION ADOPTING AND LEVYING FINAL SCHEDULE OF ASSESSMENTS,
AND PROVIDING FOR THE PAYMENT THEREOF
IN THE NAME AND BY THE A UTHORITY OF THF., CITY OF WA UKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council that after full
consideration of the final schedule of assessments and accompanying plat showing the assessments
proposed to be made for the construction of the Waukee, Iowa, North Little Walnut Creek Drive
Improvement Project, within the City, under contract with OMG Midwest, d/b/a Des Moines
Asphalt & Paving of Des Moines, IA, which final plat and schedule was filed in the office of the
Clerk on the 27°i day of February, 2019; said assessments are hereby adopted and incorporated
herein by this reference.
BE IT FURTHER RESOLVED by the City of Waukee City Council that the said schedule of
assessments and accompanying plat, be and the same are hereby approved and adopted; and that
there be, and is hereby assessed and levied, as a special tax against and upon each of the lots, parts
of lots and parcels of land, and the owner or owners thereof liable to assessment for the cost of
said improvements, the respective sums expressed in figures set opposite to each of the same on
account of the cost of the construction of the said improvements. Provided, further, that the
amounts shown in said final schedule of assessments as deficiencies are found to be proper and
are levied conditionally against the respective properties benefited by the improvements as shown
in the schedule, subject to the provisions of Section 384.63, Code of Iowa. Said assessments
against said lots and parcels of land are hereby declared to be in proportion to the special benefits
conferred upon said property by said improvements, and not in excess thereof, and not in excess
of 25% of the value of the same.
BE IT FURTHER RESOLVED by the City of Waukee City Council that said assessments of
$100.00 or more shall be payable in ten equal annual installments and shall bear interest at the rate
of 3.25% percent per annum from the date of the acceptance of the improvements; the first
installment of each assessment, or total amount thereof, if it be less than $100.00, with interest on
the whole assessment from date of acceptance of the work by the Council, shall become due and
payable on July 1, 2019; succeeding annual installments, with interest on the whole unpaid amount,
shall respectively become due on July 1st annually thereafter, and shall be paid at the same time
and in the same manner as the September semiannual payment of ordinary taxes. Said assessments
shall be payable at the office of the City Clerk, in full or in part and without interest within thirty
days after the date of the first publication of the notice of the filing of the final plat and schedule
of assessments to the County Treasurer of Dallas County, Iowa.
BE IT FURTHER RESOLVED by the City of Waukee City Council that the Clerk be and is
hereby directed to certify said final plat and schedule to the County Treasurer of Dallas County,
Iowa, and to publish notice of said certification once each week for two consecutive weeks in the
"The Dallas County News", a newspaper printed wholly in the English language, published in
Adel, Iowa, and of general circulation in Waukee, Iowa, the first publication of said notice to be
made within fifteen days from the date of the filing of said schedule with the County Treasurer,
the Clerk shall also send by ordinary mail to all property owners whose property is subject to
assessment a copy of said notice, said mailing to be on or before the date of the second publication
of the notice, all as provided and directed by Code Section 384.60, Code of Iowa.
BE IT FURTHER RESOLVED by the City of Waukee City Council that the Clerk is directed to
certify the deficiencies for lots specially benefited by the improvements, as shown in the final
schedule of assessments, to the County Treasurer for recording in the Special Assessment
Deficiencies Book and to the city official charged with responsibility for the issuance of building
permits. Said deficiencies are conditionally assessed to the respective properties under Code
Section 384.63 for the amortization period specified by law.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 15t' day of April,
2019.

TO THE PERSONS OWNING LAND LOCATED WITHIN THE DISTRICT
DESCRIBED AS THE WAUKEE, IOWA, NORTH LITTLE WALNUT CREEK DRIVE
IMPROVEMENT PROJECT, WITHIN THE CITY OF WAUKEE, IOWA:
Lots 1 through 14 SAHU ACRES, a plat included in and forming a part of the City
of Waukee, Iowa; Parcel B Lot 4 SAHU ACRES, a plat included in and forming a part of the City
of Waukee, Iowa; Parcel A Lot 4, SAHU ACRES, a plat included in and forming a part of the City
of Waukee, Iowa; Lots 1 and 2 MILO RIDGE, a plat included in and forming a part of the City of
Waukee, Iowa; and Lots 1 and 2 RAMSEY HEIGHTS, a plat included in and forming a part of
the City of Waukee, Iowa. The owners and parcel numbers of the properties being more
particularly identified in the preliminary and final plat and schedule filed with the City Clerk and
County Treasurer.

The extent of the work completed on the Waukee, Iowa, North Little Walnut Creek Drive
Improvement Project, is as follows:
All labor, materials and equipment necessary for reconstructing the existing gravel
roads known as North Little Walnut Creek Drive and Walnut Lane. The
improvements include but not limited to roadway grading, HMA paving, ditch
improvements, and site restoration.
You are hereby notified that the final plat and schedule of assessments against benefited
properties within the District described as the Waukee, Iowa, North Little Walnut Creek Drive
Improvement Project, for the construction of sanitary sewer improvements, has been adopted and
levied by the Council of Waukee, Iowa, and that said plat and schedule of assessments has been
certified to the County Treasurer of Dallas County, Iowa. Assessments of $100.00 or more are
payable in ten (10) equal annual installments, with interest on the unpaid balance, all as provided
in Section 384.65, Code of Iowa. Conditional deficiency assessments, if any, may be levied against
the applicable property for the same period of years as the assessments are made payable.
You are further notified that assessments may be paid in full or in part without interest at
the office of the City Clerk, at any time within thirty days after the date of the first publication of
this notice of the filing of the final plat and schedule of assessments with the County Treasurer.
Unless said assessments are paid in full within said thirty day period all unpaid assessments will
draw annual interest computed at 3.25% percent (commencing on the date of acceptance of the
work) computed to the December I st next following the due dates of the respective installments.
Each installment will be delinquent on September 30th following its due date on July 1 st in each
year. Property owners may elect to pay any annual installment semiannually in advance.
All properties located within the boundaries of the Waukee, Iowa, North Little Walnut
Creek Drive Improvement Project, above described have been assessed for the cost of the making
of said improvements, the amount of each assessment and the amount of any conditional deficiency
assessment having been set out in the schedule of assessments and plat accompanying the same,
which are now on file in the office of the County Treasurer of Dallas County, Iowa. For further
information you are referred to said plat and schedule of assessments.
This Notice given by direction of the Council of the City of Waukee, Iowa, as prescribed
by Code Section 384.60 of the City Code of Iowa.
