Schuett, City of Waukee, 230 Highway 6, Waukee, IA 50263; 987-4522 ORDINANCE NO. 2629 AN ORDINANCE TO AMEND CHAPTER 300, ZONING ORDINANCE, CITY OF WAUKEE, IOWA, BY REZONING AND CHANGING CERTAIN PROPERTY THEREIN FROM A-1 [AGRICULTURAL DISTRICTI TO C-1 [COMMUNITY AND HIGHWAY SERVICE COMMERCIAL DISTRICT]; AND AMEND THE OFFICIAL ZONING MAP TO SHOW REZONING BE IT ORDAINED by the Council of the City of Waukee: Section 1. Section 301.4 of Chapter 301, Waukee Municipal Code, Zoning Ordinance of the City, adopting the Official Zoning Map, is hereby amended by changing the following real estate from A-1 [Agricultural District] to C-I [Community and Highway Service Commercial District], legally described as follows: AN IRREGULAR SHAPED PORTION OF THE SOUTHEAST QUARTER OF SECTION 28, TOWNSHIP 79 NORTH, RANGE 26 WEST OF THE 5TH P.M., IN THE CITY OF WAUKEE, DALLAS COUNTY, IOWA, DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF SAID SECTION 28; THENCE N8903I'20"W ALONG THE SOUTH LINE OF THE SOUTHEAST QUARTER OF SAID SECTION 28, A DISTANCE OF 471.72 FEET; THENCE N00°00'00"E, A DISTANCE OF 574.07 FEET; THENCE N26031'38"E, A DISTANCE OF 100.82 FEET; THENCE SOUTHEASTERLY ALONG A 750.00 FOOT RADIUS CURVE, CONCAVE NORTHEASTERLY, A DISTANCE OF 96.59 FEET , THE CHORD FOR WHICH HAS A LENGTH OF 96.52 FEET AND BEARS S67°09'44"E; THENCE N29°05'47"E, A DISTANCE OF 406.38 FEET; THENCE S89°37'32"E, A DISTANCE OF 146.55 FEET TO THE EAST LINE OF THE SOUTHEAST QUARTER OF SAID SECTION 28; THENCE S00°22'28"W ALONG THE EAST LINE OF THE SOUTHEAST QUARTER OF SAID SECTION 28, A DISTANCE OF 984.91 FEET TO THE POINT OF BEGINNING; CONTAINING APPROXIMATELY 385,767 SQ. FT. (OR 8.86 ACRES). A parcel also known as Broderick Property, Phase I. Book 2008 Page 6698 J 1 of 2 Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Provision for Planned Development. Prior to approval of a site plan pertaining to Broderick Property, Phase I, property owner shall receive approval of a Planned Development Overlay District which shall identify the character and minimum design requirements for the property. Section 4. Severabili , Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 5. Effective Date. This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
