AN ORDINANCE TO AMEND CHAPTER 300, ZONING ORDINANCE, CITY OF
WAUKEE, IOWA, BY REZONING AND CHANGING CERTAIN PROPERTY THEREIN
FROM A -I ]AGRICULTURAL DISTRICT] TO R-2 [ONE AND TWO FAMILY
RESIDENTIAL DISTRICT]; AND AMEND THE OFFICIAL ZONING MAP TO SHOW
REZONING
BE IT ORDAINED by the Council of the City of Waukee:
Section 1. Section 301.4 of Chapter 301, Waukee Municipal Code, Zoning Ordinance of
the City, adopting the Official Zoning Map, is hereby amended by changing the following real estate
from A-1 (Agricultural District) to R-2 (One and Two Family Residential District), legally described
as follows:
BEGINNING AT THE WEST QUARTER CORNER (W 1/4) OF SECTION 33, TOWNSHIP 79
NORTH, RANGE 26 WEST OF THE 5T" P.M., DALLAS COUNTY, IOWA; THENCE SOUTH
89°(DEGREES) 49'(MINUTES) 31"(SECONDS) EAST (ALL BEARINGS REFERENCED TO
GRID NORTH IOWA STATE PLANE COORDINATE SYSTEM SOUTH ZONE), A DISTANCE
OF 1,637.87 FEET ALONG THE NORTH LINE OF THE SOUTHWEST QUARTER (SW 1/4) OF
SAID SECTION 33 TO THE CENTERLINE OF 6T11 STREET; THENCE SOUTH 00°09' 14" EAST,
A DISTANCE OF 157.43 FEET ALONG SAID CENTERLINE OF 6 "' STREET TO THE
CENTERLINE OF NORTHVIEW DRIVE; THENCE NORTH 89°49'41" WEST, A DISTANCE OF
1,639.87 FEET ALONG SAID CENTERLINE OF NORTHVIEW DRIVE TO THE WEST LINE OF
SAID SW 1/4; THENCE NORTH 00°34'32" EAST, A DISTANCE OF 157.53 FEET ALONG SAID
WEST LINE TO THE POINT OF BEGINNING.
CONTAINING 5.92 ACRES, MORE OR LESS.

Section 2. Further Zoning Restriction. Development of the real estate shall be limited to
single family residential only.
Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 4. Severability Clause. If any section, provision or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as
a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.
Section 5. Effective Date. This ordinance shall be in effect upon its final passage, approval
and publication as provided by law.
Passed by the City Council of the City of Waukee, Iowa, this 20`" day of April 2009, and approved this
