AN ORDINANCE TO AMEND CHAPTER 300, ZONING ORDINANCE, CITY OF WAUKEE,
IOWA BY AMENDING CERTAIN PROPERTY FROM A-1 TO R-2 [ALYVIA PLAT 11
BE IT ORDAINED by the Council of the City of Waukee:
Section 1. Section 301.4 of Chapter 301, Waukee Municipal Code, Zoning Ordinance of
the City, adopting the Official Zoning Map, is hereby amended by changing the following real estate
from A-1 (Agricultural District) to R-2 (One & Two Family Residential District), legally described as
follows:
BEGINNING AT THE NW CORNER OF SAID NW1/4 N1/4; THENCE N89°54' 13"E, 577.27 FEET
ALONG THE NORTH LINE OF SAID NW1/4 NW1/4 TO A POINT, SAID POINT ALSO BEING
THE NW CORNER OF SAID FUTURE LOT 7; THENCE S02°03'26"E, 233.54 FEET ALONG THE
WEST LINE OF SAID FUTURE LOT 7 TO THE SW CORNER OF SAID FUTURE LOT 7;
THENCE EASTERLY ALONG A NON -TANGENT CURVE TO THE RIGHT HAVING A RADIUS
OF 280.00 FEET AND A CHORD BEARING S81011'20"W, AN ARC LENGTH OF 72.60 FEET
ALONG THE SOUTH LINE OF SAID FUTURE LOT 7 TO A POINT ON THE EAST LINE OF
SAID WEST 658.75 FEET OF THE NORTH 661.25 FEET OF THE NW1/4 NW1/4; THENCE
S00021'16"W, 438.76 FEET ALONG SAID EAST LINE TO THE SE CORNER OF SAID WEST
658.75 FEET OF THE NORTH 661.25 FEET OF THE NWl/4 NW1/4; THENCE S89°54'31"W,
658.89 FEET ALONG THE SOUTH LINE OF SAID WEST 658.75 FEET OF THE NORTH 661.25
FEET OF THE NW1/4 NW1/4 TO THE SW CORNER OF SAID WEST 658.75 FEET OF THE
NORTH 661.25 FEET OF THE NWI/4 NW1/4, SAID POINT ALSO BEING ON THE WEST LINE
OF SAID NWl/4 NW1/4; THENCE N00°2256"E, 661.14 FEET ALONG SAID WEST LINE TO
THE POINT OF BEGINNING.
Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as
a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval
and publication as provided by law.
