Hickman Rd., Waukee, IA 50263; 978-7904 ORDINANCE NO. 2874 AN ORDINANCE TO AMEND CHAPTER 300, ZONING ORDINANCE, CITY OF WAUKEE, IOWA BY AMENDING CERTAIN PROPERTY FROM C-IA TO M-IA [GILCREST JEWETTI BE IT ORDAINED by the Council of the City of Waukee: Section 1. Section 301.4 of Chapter 301, Waukee Municipal Code, Zoning Ordinance of the City, adopting the Official Zoning Map, is hereby amended by changing the following real estate from C-IA (Neighborhood Commercial District) to M-1A (Limited Industrial District), legally described as follows: ALL THAT PART OF PARCEL "C" OF THE EAST '/2 OF THE SOUTHEAST 1/4 OF SECTION 34, "TOWNSHIP 79 NORTH, RANGE 26 WEST OF THE 5TH P.M., WAUKEE, DALLAS COUNTY, IOWA AS RECORDED WITH THE DALLAS COUNTY RECORDER'S OFFICE BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHWEST CORNER OF SAID PARCEL "C"; THENCE S63'I3'31"E ALONG THE SOUTH LINE OF SAID PARCEL "C", SAID LINE ALSO BEING THE NORTH RIGHT-OF-WAY LINE OF THE CHICAGO NORTHWESTERN RAILROAD, A DISTANCE OF 800.39 FEET TO THE POINT OF BEGINNING; THENCE N00°04'00"W, A DISTANCE OF 331.00 FEET; THENCE N89'56'00"E, A DISTANCE OF 60.00 FEET; THENCE S00°04'00"E, A DISTANCE OF 361.46 FEET TO A POINT ON THE SOUTH LINE OF SAID PARCEL "C", THENCE N63°13'31"W, ALONG THE SOUTH LINE OF SAID PARCEL "C", A DISTANCE OF 67.25 FEET TO THE POINT OF BEGINNING. SAID TRACT OF LAND CONTAINS 0.48 ACRES MORE OR LESS. Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
