Hickman Rd., Waukee, IA 50263; 978-7904 ORDINANCE NO.2774 AN ORDINANCE TO AMEND CHAPTER 300, ZONING ORDINANCE, CITY OF WAUKEE, IOWA BY AMENDING THE ZONING FOR CERTAIN PROPERTY FROM A-1 TO R-1 [DAYBREAK PHASE 11 BE IT ORDAINED by the Council of the City of Waukee: Section 1. Section 301.4 of Chapter 301, Waukee Municipal Code, Zoning Ordinance of the City, adopting the Official Zoning Map, is hereby amended by changing the following real estate from A-1 (Agricultural District) to R-1 (Single Family Residential District), legally described as follows: A PART OF LOT 1, SUGAR GROVE HEIGHTS PLAT 1, AN OFFICIAL PLAT, CITY OF WAUKEE, DALLAS COUNTY, IOWA AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHWEST CORNER OF SAID LOT 1; THENCE SOUTH 45°51'47" EAST ALONG THE NORTH LINE OF SAID LOT 1, A DISTANCE OF 95.71 FEET; THENCE NORTH 88042'20" EAST ALONG SAID NORTH LINE, 672.07 FEET TO THE CENTERLINE OF UTE AVENUE\ COUNTY HIGHWAY R22; THENCE SOUTHERLY ALONG SAID CENTERLINE AND A CURVE CONCAVE EASTERLY WHOSE CHORD BEARS SOUTH 76015'53" WEST, 90.49 FEET; THENCE SOUTH 82°49'28" WEST, 103.55 FEET; THENCE SOUTH 89028'50" WEST, 106.66 FEET; THENCE NORTH 90°00'00" WEST, 197.95 FEET TO THE WEST LINE OF SAID LOT 1; THENCE NORTH 003 3'15" WEST ALONG SAID WEST LINE, 427.05 FEET TO THE POINT OF BEGINNING AND CONTAINING 5.90 ACRES (256,995 SQUARE FEET). A PARCEL TO BE KNOWN AS PART OF DAYBREAK. Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
