Hickman Rd., Waukee, IA 50263; 978-7904 ORDINANCE NO. 2783 AN ORDINANCE TO AMEND CHAPTER 300, ZONING ORDINANCE, CITY OF WAUKEE, IOWA BY AMENDING THE ZONING FOR CERTAIN PROPERTY FROM A-1 TO C-IA [HERMANN PROPERTY] BE IT ORDAINED by the Council of the City of Waukee: Section 1. Section 301.4 of Chapter 301, Waukee Municipal Code, Zoning Ordinance of the City, adopting the Official Zoning Map, is hereby amended by changing the following real estate from A-1 (Agricultural District) to C-IA (Neighborhood Commercial District), legally described as follows: A TRACT OF LAND IN GOVERNMENT LOT 9, IN THE NORTHEAST FRACTIONAL QUARTER OF SECTION 5, TOWNSHIP 78 NORTH, RANGE 26 WEST OF THE FIFTH PRINCIPAL MERIDIAN, CITY OF WAUKEE, DALLAS COUNTY, IOWA, AND MORE PARTICULALRY DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF GOVERNMENT LOT 9 IN THE NORTHEAST FRACTIONAL QUARTER OF SECTION 5, TWONSHIP 78 NORTH, RANGE 26 WEST OF THE FIFTH PRINCIPAL MERIDIAN, WAUKEE, DALLAS COUNTY, IOWA; THENCE ALONG THE SOUTH LINE OF SAID GOVERNMENT LOT 9, SOUTH 83'01'22" WEST, 438.28 FEET; THENCE NORTH, 03°58'45" WEST, 453.20 FEET; THENCE NORTH 85'00'47" EAST, 468.25 FEET TO THE EAST LINE OF SAID GOVERNMENT LOT 9; THENCE SOUTH 00'00'00", 439.57 FEET TO THE POINT OF BEGINNING. SAID TRACT OF LAND CONTAINS 4.630 ACRES (201,682 SQUARE FEET) INCLUDING 0.640 ACRES (27,878 SQUARE FEET) OF COUNTY ROAD RIGHT-OF-WAY. SAID AMENDMENT ALSO ENCOMPASSES THE NORTH RIGHT-OF-WAY FROM THE CENTERLINE OF SE WESTOWN PARKWAY ALONG SAID PROPERTY AND THE WEST RIGHT-OF-WAY FROM THE CENTERLINE OF SE L.A.GRANT PARKWAY ALONG SAID PROPERTY. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
