M., at the Town Hall , Waukee, Iowa. The meeting was called to order by the Mayor, and the roll being called, there were Present, James Billingsley , Mayor, in the chair, and the following named Councilmen: Joe Neubauer, Merle Rees. Richard Inman Bill 1lilson, Lawrence Linn Absent; None The Council took up and considered proposed sanitary sewer improvements in said Town. It was moved by Councilman Neubauer , and seconded by Councilman Rees that McClure & Culver, Consulting Engineers, of Jef erson, Iowa, be and they are hereby employed as Engineers in connection with proposed sanitary sewer improvements in said Town. After due consideration thereof, the Mayor put the ques- tion on the motion,and the roll being called, the following named Councilmen voted: Ayes: Neubauer, Rees. Inman Wilson Linn Nays: None. Whereupon, the Mayor declared said motion duly carried. Whereupon, the Mayor declared said motion duly carried and said resolution adopted as follows: RESOLUTION Ordering preparation of plans, spec- ifications and form of contract, es- timate of cost, plat and schedule of assessments. IT IS RESOLVED by the Town of Waukee, Iowa, that McClure & Culver, Consulting Engineers, of Jefferson, Iowa, said Engineers having been heretofore employed by this Council to serve as Engineers in charge of proposed sanitary sewer improvements in portions of certain streets and avenues in said Town, including a sewage treatment lagoon in connection therewith, be and they are hereby instructed to prepare plans, specifications, form of contract, estimate of cost, plat and schedule of assessments for said improvements. IT IS FURTHER RESOLVED that said Engineers are instructed hereby to deliver said matters to the Town Clerk for filing as soon as completed, all in conformity with Chapter 391 of the Code of Iowa, 1958. The meeting was called to order by the Mayor, and the roll being called, there were Present, lam c R' linasl Mayor, in the Chair, and the f ollowing named Councilmen: Bill Wilson, Lawrence Linn Absent: The Town Clerk announced that McClure & Culver, Con- sulting Engineers, of Jefferson, Iowa, had delivered to him plat and schedule of assessments, and an estimate of cost of the pro- posed sewers on portions of certain streets and avenues in said Town, including a sewage treatment lagoon in connection therewith, as heretofore directed by the Town Council. It was moved by Councilman Linn , and seconded by Councilman Neubauer that said matters be placed on file with the Town Clerk. The Mayor put the question on the motion, and the roll being called, the following named Councilmen voted: Ayes: Neubauer Rees Inman Wilson Linn Nays: None. Whereupon, the Mayor declared said motion duly carried and said matters were placed on file with the Town Clerk. The Council then proceeded to a consideration of said estimate of cost, plat and schedule of assessments. Councilman Linn introduced and read the fol- lowing resolution and moved its adoption; seconded by Councilman Neubauer and after due consideration thereof by the Coun- cil, the Mayor put the question upon the motion, and the roll be- ing called, the following named Councilmen voted: Nays: None. Whereupon, the Mayor declared said motion duly carried and said resolution adopted, as follows: RESOLUTION Approving plat and schedule of assessments and estimate of costs. WHEREAS, this Town did heretofore employ McClure & Culver, Consulting Engineers, of Jefferson, Iowa, to render such engineering services as may be necessary in connection with the Town's proposed sewage improvements, including a sewage treatment lagoon in connection therewith, and to prepare estimate of cost, plat and schedule of assessments in portions of certain streets and avenues, including sewage treatment lagoon, all as more par- ticularly described in proposed resolution of necessity hereinafter set out; and WHEREAS, said engineers have completed the preparation of said matters, and have delivered the same to the Town Clerk, and upon examination of this Council same appears to be correct and suitable for the purpose intended; NOW, THEREFORE, IT IS RESOLVED by the Town Council of the Town of Waukee, Iowa, that the plat and schedule of assessments, and the estimate of cost of proposed sewers, including a sewage treatment lagoon in connection therewith, be and the same are hereby approved and placed on file for public examination. M., at Town Hall Waukee, Iowa, at which time and place the Council will hear objections and take ac- tion upon said resolution, and further that the Town Clerk be and is hereby intucted to post notice of hearing on said Resolution of Necessity in accordance with the requirements of law; and said Clerk be and is further instructed to mail by certified mail, with- out return receipt, a copy of said notice of hearing on said Resolu- tion of Necessity to all record titleholders, as shown by the rec- ords in the Office of the County Auditor of Dallas County, Iowa, as of the First day of Mav , 1961, and whose properties are includes in the preliminary sche ule of assessments as approved and passed by resolution of this Council at this meeting; seconded by Councilman Rees ; and after due consideration thereof by the Council, the Mayor put the question upon the motion, and the roll being called, the following named Councilmen voted: Ayes: meubauer, Rees Wilson Inman, Linn Nays: None. That the method of construction shall be by contract in accordance with the plans and specifications and general stipula- tions for said sewer improvements approved by the Town Council. Section 4. That so much of the cost and expense of said sewer improvements as can under the law be assessed to abutting and adjacent property, including railroad property within the cor- porate limits of said Town of Waukee, Iowa, will be so assessed and such cost shall be assessed against the property abutting on such sewers in proportion to the number of lineal front feet of each lot thereof, and upon adjacent property in amounts respectively in pro- portion to the benefits conferred upon said respective properties on account of said improvements. Said assessments shall not be in excess of such benefits and shall not exceed twenty-five per cent of the actual value of the respective lots or tracts at the time of levy, and any excess of said cost or expense of said sewers above and the benefits conferred upon said adjacent and abutting property by reason of said sewer improvements, and over and above the limita- tions hereinbefore referred to, shall be paid out of such funds of said Town as are legally available for such purposes or from the proceeds of the issuance of such bonds as may be legally is- sued for such purposes. Section 5. That a plat and schedule of assessments are now on file in the office of the Town Clexk,showing the sewer improvements to be constructed, the size of the sewers, each lot or tract proposed to be assessed, together with a valuation fixed by the Council, an estimate of cost of the proposed sewer improvements giving an estimate of the cost of each different type of construction and kind of material to be used, and also showing an estimate of that part of the cost which will be assessed against each lot or tract. Section 7. That the Town Council by this resolution gives notice of its intention to issue bonds as provided by Section 396.6 of the Code of Iowa, 1953, for the purpose of providing for the pay- ment of the assessed cost of said sewer improvements; and bonds to be issued in anticipation of the deferred payment of the assessments levied therefor, and that said bonds will be sold at public sale in the manner provided by lava, but shall not be sold for less than their par value with accrued interest from date of bonds to the time of delivery thereof. Section 8. IT IS FURTHER RESOLVED that the foregoing resolu- tion is hereby proposed and all of the matters as herein set forth, and that the foregoing proposed resolution and action thereon be and the same is hereby set down for further and final hearing, considera- tion and determination on the 241-n day of _ July 1961, at g o'clock p M., at Town Hall , Waukee, Iowa, and that the Town Clerk be, and is hereby instructed to give not less than fourteen (14) days' notice of the time when said. resolution will be finally considered for passage, such notice to be given by posting in not less than three (3) public places within the limits of the Town and such posting to be on a day not less than fourteen (14) days prior to the date above set, all as is provided by law, and the Clerk be and is further instructed to mail by certi- fied mail, without return receipt, a copy of said notice of hearing on said Resolution of Necessity to all record titleholders, as shown by the records in the office of the County Auditor of Dallas County, Iowa, as of the First day of May , 1961, and whose properties are inched in the preliminary se-Redule of assessments as approved and passed by resolution of this Council on the 29th day of June 1961; and that this resolution except this paragraph, be and the same is hereby provisionally adopted, subject to the further and final consideration at the time above stated, at which time this resolution may be adopted as proposed or amended and adopted as amended. Section 9. That unless property owners at the time of final con- sideration of this resolution have on file with the Town Clerk objec- tions to the amount of the proposed assessment, they shall be deemed to have waived all objections thereto. That the Town Council by this resolution gives notice of its intention to issue bonds as provided by Section 396.6 of the Code of Iowa, 1958, for the purpose of providing for the payment of the assessed cost of said sewer improvements- and bonds to be issued in anticipa- tion of the deferred payment of the assessments levied therefor, and that said bonds will be sold at public sale in the manner provided by law, but shall not be sold for less than their par value with accrued interest from date of bonds to the time of delivery thereof.
