The meeting was called to order by the Mayor, and the roll being called, there were Present, ..��aammcc Mayor, in the chair, and the fol- lowing named mem ers� o� u l Absent: None After further considering all objections to the proposed sewer improvements in said Town as provided by resolution of necessity provisionally adopted by the Town Council of said Town on the 29th day of June, 1961, it was moved by Councilman and seconded by Councilman N that the �oil5�ning resolution amending said resolution o necess y be adopted. Whereupon, the Mayor put the question upon the motion, and the roll being called, the following named. Councilmen voted: Ayes: Joe Newbauer, E,awrence Linn, RiII Id I sort, Richard Inman Merle Rees Nays: None. Whereupon, the Mayor declared said amending resolution adopted, as follows: R E S O L U T I O N Amending resolution of necessity for sewer improvements. WHEREAS, the Town Council after full investigation deems it advisable to amend the proposed resolution of necessity for sewer improvements provisionally adopted on the 29th day of June, 1961; now therefore IT IS RESOLVED by the Town Council of the Town of Waukee, Iowa, as follows: Section 1. Whereupon, the Mayor declared said motion duly carried and said resolution adopted, as follows: R E S O L U T I O N Overruling objections WHEREAS, the Town Council of Waukee, did in a proposed resolution of necessity, provisionally adopted on June 29, 1961, declare the necessity of constructing sanitary sewer improvements and including a sewage lagoon in connection therewith for said Town, and after posting and mailing proper notice of hearing on said resolution of necessity, proof of posting and mailing thereof being now on file in the office of the Town Clerk, did on the 24th day of July, 1961, receive and hear objections to the adoption of said resolution and having this day given consideration to said objections and having this day determined that it is to the best interests of said Town to provide said proposed sewer improvements, as described in said resolution of necessity, as amended; and WHEREAS, after examination of all objections, the Town Council finds that no remonstrance was filed with the Council, signed by sixty per cent or more of the property owners and by owners of property subject to pay seventy-five per cent or more of the assessable cost of the proposed improvements; now therefore IT IS RESOLVED by the Town Council of the Town of Waukee, Iowa, that all objections filed to the construction of said sewer improvements, described in general as sanitary sewer improvements, including a sewage lagoon in connection therewith, as described in said resolution of necessity, as amended, are found by this Council to be without merit and that said objections be and the same are hereby overruled. That the `.?'min Cound..i by this resolution gives notice Of its intention to issue bonds as provided by Section 395.6 Of the Code of lowa., 1956, for she purpose of providing for the payment of the assessed cost of said, sewer it provemenns, and bonds t0 he issued in anticipation of the deferred payment of the assessments levied therefor, and that said bonds will be sold at public sale in the manner provided by law, .Out shall not be sold for less than their par 'value with accrued interest fr0m date of bonds to the time of delivery thereof. :Section d. 'T 1S FURTHER RESOLVED that the foregoing resolution is hereby proposed and all of the matters as herein set forth, and that the foregoing proposed resolution and action thereon he and the same is hereby set dawn for further and final hearing, consideration and determination on the 24th day of July, 1961, at 8 o'clock_ P.M., at 'town Hall, Waukee, Iowa, and that the `town Clerk be, and is hereby instructed to give not less than fourteen (14) days' notice of the time when said resolution will be finally considered for passage, such notice to be given by posting in not less than three (3) public _laces within the limits of the Town and such posting to be on a day not less than fourteen (14) days prior to the date above set, all as is provided hv law, and the Clerk be and is further instructed to mail by certified _..ail, .+7ithOut return receipt, a copy Of said notice of hearing on said Resolution of Necessity to all record titleholders, as shown by the records in the Office Of the County Auditor of Dallas County,. The Town Clerk announced that McClure & Culver, Consulting Engineers of Jefferson, Iowa, had delivered to him plans and specifications and form of contract for the construction of the proposed sewer improvements. It was moved by Councilman Inman and seconded by Councilman Wilson that said plans and fications and form of contract be p ace on file with the Town Clerk. The Mayor put the question on the motion, and the roll being called, the following named Councilmen voted: Ayes: Joe Newbauer, Lawrence Linn Bill Wilson Richard Inman Merle Rees Nays: None. Whereupon,the Mayor declared said motion duly carried, and said matters were placed on file with the Town Clerk. The Council then proceeded to a consideration of said plans, specifications and form of contract. Councilman Newbauer introduced and read the following resolution and moved its a op ion, seconded by Councilman Rees and after due consideration thereof by the Council, the Mayor put the question upon the motion and the roll being called, the following named Councilmen voted: Ayes: Joe Newbauer, Lawrence Linn Bill Wilson Richard Inman & Merle Rees Nays: None. WHEREAS, the Town Council of the Town of Waukee, Iowa, did by resolution heretofore employ and direct McClure & Culver, Consulting Engineers of Jefferson, Iowa, to prepare plans, specifications and form of contract for proposed sewer improvements in said Town on portions of certain streets, avenues and alleys, and from and to points in said Town, and the construction of a sewage lagoon in connection therewith, all as described in the Resolution of Necessity finally passed and approved on the 7th day of August, 1961; and WHEREAS, said Engineers have completed the preparation of said plans, specifications and proposed form of contract and have delivered the same to the Town Clerk and the same appear to be correct and suit- able for the purpose intended, and have been filed with the Town Clerk by order of the Town Council; now therefore IT IS RESOLVED by the Town Council of the Town of Waukee, Iowa, as follows: Section 1. That the plans, specifications and proposed form of contract referred to in the preamble hereof, be and the same are hereby approved. Passed and approved this 7 day of A„aiisr , 1961. IT IS RESOLVED by the Town Council of the incorporated Town of Waukee, Iowa, that pursuant to the resolution of necessity proposed at a meeting of this Council held on June 29, 1961, amended and finally adopted at a meeting of this Council held on the 7th day of August, 1961, it is hereby ordered upon motion of this Council, without petition of property owners, that the sewer improvements described in said resolution of necessity, including a sewage lagoon in connection therewith, be constructed in strict compliance with the plans and specifications therefor heretofore approved and now on file with the Town Clerk. Said sewer improvements shall be constructed as set forth in the Resolution of Necessity as finally passed and approved on the 7th day of August, 1961. IT IS FURTHER RESOLVED that proposals received for the con- struction of said sewer improvements will be opened by this Council at a meeting to be held in the Town Hal , in said Town, on the 11 day o , , at .. Town Irlerk (SEAL) unpaid special assessments and from the sale of special assessment bonds shall be paid from the proceeds of the issuance of such other bonds as may be legally issued for such purposes or such other funds of the Town as may legally be used for such purposes, including federal grants. Any combination of the above methods of payment may be used. By virtue of statutory authority, preference will be given to products and provisions grown and coal produced within the State of Iowa, and to Iowa domestic labor. The successful bidder will be required to furnish a bond in an amount equal to 100% of the contract price, said bond to be issued by a responsible surety approved by the Town Council and shall guarantee the faithful performance of the contract and the terms and conditions therein contained and the maintenance of said sewer improvements in good repair for not less than two years from the time of acceptance of the improvements by the Town. The Town will receive bids and enter into one contract on Sections I, II and III. The work shall be commenced promptly after award of said contract, and the contractor shall proceed continuously with said construction and complete same on or before the day of _�_ril 19 gZ The Town reserves the right �ject any—MT141l proposals. Plans and specifications governing the construction and the proposed improvements have been prepared by McClure & Culver, Engineers of Jefferson, Iowa, which plans and specifications and, also the prior proceedings of the Town Council, referring to and defining said proposed improvements, are hereby made a part of this notice and the proposed contract by reference and the proposed contract shall be executed in compliance therewith. Copies of said plans and specifica- tions are now on file with the Town Clerk at his office at Waukee, Iowa, and with the engineers at their office in Jefferson, Iowa, and may be examined by the bidder. Plans and specifications for private use may be obtained from the engineers upon a deposit of $20, all of which will be refunded to anyone filing a complete and bona fide bid and to all others $10 will be refunded, providing in all cases that such plans and specifications are returned in good order to the engineer within one week after the date of receiving bids.
