In conformity with published and posted notice of hearing and
letting, the Mayor announced that the hearing would now be held on
objections to the proposed plans, specifications and form of contract
for or cost of proposed extensions and improvements to the sewage works
and facilities, as set out in said notice.
Upon investigation it was found that no persons had appeared
or filed objections to the proposed plans, specifications and form
of contract for or cost of said improvements. Whereupon, the Mayor
declared the hearing closed.
Thereupon, Councilman — Line introduced and caused

sions and improvements to the present sewage works and facilities".
Councilman �� moved that said resolution be adopted,
Seconded by ouncilman "Y son ; and after due consideration

Whereupon, the Mayor declared said motion duly carried and
said resolution duly adopted, as follows:

Approving plans, specifications and form of
contract for the construction of extensions
and improvements to the present sewage works
and facilities.
WHEREAS, proposed plans, specifications and proposed form of
contract for the construction of extensions and improvements to
the present sewage works and facilities in and for the Town of
Waukee, Iowa, have heretofore been prepared by McClure & Culver,
Consulting Engineers of Jefferson, Iowa, and were filed with the
Town Clerk on the _ 7 day of AuglIst , 1961; and
WHEREAS, notice of hearing on said proposed plans, specifica-
tions and proposed form of contract was duly published and posted
in the manner and form required by law; and
WHEREAS, no persons have appeared or filed objections to the
proposed plans, specifications and form of contract; now therefore
BE IT RESOLVED by the Town Council of the Town of Waukee, Iowa,
as follows:
Section 1. That the plans and specifications and form of
contract re erred to in the preamble hereof be and the same are
hereby approved.
Section 2. That all resolutions or orders or parts thereof
in con is herewith are hereby repealed.

In conformity with said published and posted notice of hearing
and letting, the Mayor thereupon announced that bids would now be
considered for the construction of said extensions and improvements
to the sewage works and facilities in said Town as prescribed in
said notice. The Town Clerk placed on file proof of publication
and posting of said notice of hearing and letting.
It was moved by Councilman and seconded by
Councilman that t e Mayor and Clerk proceed with
the opening ouchoAuch proposals as had been filed, after first
ascertaining that the required certified check accompanied each such
proposal.
The Mayor put the question on the motion, and the roll being

WHEREAS, bids have been received for the construction of the
proposed extensions and improvements to the sewage works and
facilities, consisting in general of Section I, II and III; and
WHEREAS, after full consideration of all bids for said proposed
improvements, it is found by the Town Council that the bid of

and instructed to enter into written contract on behalf of said

this resolution, said contract not to be binding upon said Town until
executed by the parties thereto and construction bonds furnished and
said executed contract and construction bonds have been approved by
the Town Council.

construction of extensions and improvements to the sewage works and

certificate of completion being as follows:

Accepting Work.
WHEREAS, the work of constructing extensions and improvements
to the sewage works and facilities in and for the 'Town of Waukee,
Iowa, has been completed by Douglas Construction Company, Inc., of
Des Moines, Iowa, under the contract between said contractor and said
Town, approved by resolution passed and approved by the Town Council
on October 2, 1961; and
WHEREAS, said improvements as completed appear in the judgment
of this Council to meet the requirements of the 'Town Council, and
the plans and specifications heretofore adopted for the construction
of said improvements, all as evidenced by the Engineer's final
estimate of costs and certificate of completion executed by the
Engineers for said Town and placed on file with the Town Clerk on the
llth day of June , 1962; now therefore
IT IS RESOLVED by the Town Council of the Town of Waukee, Iowa,
as follows:
That the work as completed be and the same is hereby approved
and accepted on behalf of the Town of Waukee, Iowa, and the total cost
of said improvements, described in general as Section I, II and III,
is hereby determined to be 4178,851.14 of which $144,139.49
is due the contractor.

WHEREAS, the work of constructing extensions and improvements
to the sewage works and facilities in and for the Town of Waukee, Iowa,
generally described as Sections I, II and. III, has been completed by
Douglas Construction Company, Inc., of Des Moines, Iowa, and accepted
by resolution of this Council, dated June 11 • 1962, and the
total cost of said improvements has been determined to be 9)128,8.5.1_14
of which 144 ygq_g is due the contractor.
.� IT IS RESOLVED by the Town Council of the Town of Waukee, Iowa,
as follows:
That the total cost which is determined as being properly
assessable against abutting and adjacent property is �.117,_2.82.74
Any and all costs over and above assessable total shall be paid from
funds of the '-own usable for said purposes, or from the proceeds of
the issuance of such bonds as may be legally issued for such purposes; and
IT IS .FURTHER RESOLVED that the Engineers for said Town be and
they are hereby directed to prepare and place on file a plat and
schedule of assessments indicating the correct division of the assess-
able costs as among the several benefited properties, all in accordance

with the prior proceedings of this Council and the law governing
said work, which plat and schedule of assessments shall be subject

Whereupon, the Mayor declared said motion duly carried and said

Tentatively approving plat and schedule
of assessments and ordering posting of
notice.
WHEREAS, the Town Council of the Town of Waukee, Iowa, by
resolution adopted on the lath day of tune 1962, did
accept certain sewer improvements constructed from and to certain
points and along and upon portions of certain streets and avenues
in said Town, including a sewage treatment lagoon in connection
therewith, described in general as Section I, II and III, said
improvements having been constructed as more specifically
described in the resolution ordering the construction of said improve-
ments, passed and approved by the Town Council on August 7, ig61,
and as set forth in the Resolution of Necessity as finally passed and
approved on August 7, 1961, the type of such improvements having been
definitely and specifically described and located in the plans
and specifications governing the construction of the improvements,
which were by reference made a part of the contract providing for
said improvements; and
WHEREAS, this Council did by resolution passed and approved m
the _ 11th day of�, 1962, instruct the Engineers for
said Town to prepare a plat and schedule of assessments showing all
the property subject to assessment for the cost and expense of said
improvements and showing each lot, part of lot and parcel of ground,

in excess of twenty-five per cent of the actual value of each of such
tracts; now therefore
IT IS RESOLVED by the Town Council of the incorporated Town of
Waukee, Iowa, that said plat and schedule of assessments be approved
and ordered placed on file with the Town Clerk for public examination,
and the Town Clerk be and he is hereby authorized and instructed
to advertise by the posting of notices along the line of work, and by
posting copies of notices in three public places within the limits
of the Town of Waukee, Iowa, there being no newspaper published in
the Town of Waukee, Iowa, all as required by the statutes of the
State of Iowa; that the work has been completed, the schedule and
assessments drawn, and the same may be examined by interested persons
at the office of the Town Clerk, and that owners of property may file
written objections to the method of making the assessment, the amount
of any such assessment, or objections to prior proceedings upon which
the assessments are based, or to errors, irregularities, inequalities,
or illegalities, or any other objection they may have.
IT IS FURTHER RESOLVED, that in addition to the foregoing, the
Town Clerk be and he is hereby instructed to send by certified mail,
without return receipt, to each property owner listed on the plat
and schedule of assessments, as shown by the records in the office
of the County Recorder, whose property is subject to assessment
for said improvements, a copy of said notice of hearing on assess-
ments, said notice to be deposited in the United States mails, properly
stamped and addressed, at least twenty days prior to the date herein-
after fixed for the hearing on assessments.
IT IS FURTHER RESOLVED, that the notice be posted in three
public places within the limits of said Town of Waukee, Iowa, there
being no newspaper published in the Town of Waukee, Iowa, and that
the Council of said Town will meet on the 13th day of Augy-1-
1962, at g o'clock -P M., at the mown Haig
Waukee, Iowa,after the posting and mailing of said notice, for the
purpose of reviewing such objections as may have been filed, said
meeting being not less than twenty days after the date of said first
posting of said notice, and being not less than twenty days after the
date of posting handbill notices and being not less than twenty days
after the date of mailing a copy of said notice to each property owner,
as herEk above directed, at which time or such later time as may
then be fixed, a resolution making, or amending and making such
assessments will be adopted.

Notice is hereby given to the owners of property subject to
assessment for improvements and extensions constructed to the
sewage works and facilities in the Town of Waukee, Iowa, described
in general as Sections I, II and III, along and upon portions of
certain streets, avenues and from and to the points in said Town,
as follows:
Section I:- Sewers
On Laurel Street beginning 201 east of the east edge of loth
Street, thence east along Laurel Street with an 8" VSP for a distance
of 2901 to the intersection of Laurel Street and 9th Street.
On 9th Street beginning at Laurel Street thence north along 9th
Street with an 811 VSP for a distance of 1391 to the intersection of
9th Street and Adel Avenue.
On Adel Avenue beginning at 9th Street thence Southeast along
Adel Avenue with a 10" VSP for a distance of 24301 to the intersection

Correcting, altering and revising
assessments and overruling objections.
WHEREAS, notice of hearing has been duly given on plat and
schedule of assessments, filed with the Town Clerk of the Town of
Waukee, Iowa, on the 9 day of Jul , 1962, for
defraying the cost of sewer improvements, descry e in general as
Section I, II and III, constructed in said Town from and to the
points as described in the Resolution Ordering Construction thereof
passed and approved by the Town Council on August 7, 1961, and as
described in the Resolution of Necessity as finally adopted on
August 7, 1961, under a contract with Douglas Construction Company,
Inc„ of Des Moines, Iowa, duly approved by resolution passed and
approved by the Council of said Town on October 2, 1961, the said sewer
improvements having been completed and accepted by the Council of said
Town by resolution duly passed and approved on June 11 , 1962,
and all objections have been heard by the Council; and
WHEREAS, except for the corrections, alterations and revisions
of said plat and schedule of assessments hereinafter set out, all
objections should be overruled; now therefore

the resolution of this Council passed and approved on the 28th day

IT IS RESOLVED by the Town Council of the Town of Waukee, Iowa,
as follows:
Section 1. That after full consideration, appraisal and
apportionment of the special benefits conferred upon the property
shown in said plat and schedule of assessments, this Council finds
that the said property is especially benefited by said sewer improve-
ments in the amounts shown on said plat and schedule of assessments,

as corrected, altered and revised by aforesaid resolution, and
that said amounts are in proportion to the number of linear front feet
of each lot abutting on said sewers and in proportion to the special
benefits conferred upon the property by said sewer improvements, and
that said amounts are not in excess of twenty-five per cent of the actual
value of the lots, parts of lots, and parcels of real estate shown in
said schedule, and that no special assessment against any lot, or part
of lot is more than ten per cent in excess of the estimated cost.
Section 2. That the schedule of assessments and accompanying
plat as corrected, altered and revised by aforesaid resolution be and
the same are hereby approved, and that there be and there is hereby
assessed and levied as a special tax assessment against and upon each
of the lots, parts of lots and parcels of real estate, including rail-
road property, and the owner or owners thereof liable to assessment for
the cost and expense of said sewer improvements shown in said schedule,
the respective sums expressed in figures set opposite to each of
thesame on account of the cost and expense of the construction of said
sewer improvementsand the said assessments against said lots, parts of
lots, and parcels of -real estate, are hereby declared to be in propor-
tion to the number of linear front feet of each lot abutting on said
sewers and 'in proportion to the benefits conferred upon said properties
by said sewer improvements and not in excess thereof and not in excess
of twenty-five per cent of the actual value thereof.
Section 3. That said special assessment is payable within
thirty days after the date of said levy with interest at the rate of
six per cent per annum until paid from the //,;tZ day of r� ,
1962, the date of acceptance of said sewer improvai3 ements, when
certified to the County Auditor of said County of Dallas, is payable
at tile office of the Treasurer of said County.
Section 4. That where any owner of any lot or parcel of land
has not within thirty (30) days after the said assessment filed written
objection to the regularity or legality of such assessment, such assess-
ment of y>25.00 or more is payable with interest thereon as hereinafter
provided in ten equal annual installments, and the first installment
or the total amount of the assessment if such assessment is less than
$25.00 shall mature and be payable thirty (30) days from the date of
said levy without interest, and the other installments of assessments
with interest thereon from the date of levy by the Council on the
whole amount unpaid, at the -rate of six per cent per annum, shall
mature and be payable annually thereafter at the same time,and in the
same manner as the March payment of ordinary taxes. However, the
total assessments may be paid without interest thirty days after levy
by the Council.

We, George Kramer, Mayor, Remo Nizzi, Town Clerk, and
Hannah Weil, Treasurer, do hereby certify that we are the
officers respectively above indicated, of a municipal corpora-
tion duly incorporated, organized and existing under and by
virtue of the general laws of the State of Iowa, and known as
the Town of Waukee, in the County of Dallas, State of Iowa; and
that in pursuance of Section 396.6 et seq. of the Code of Iowa,
and laws amendatory thereof and supplemental thereto, there have
been heretofore lawfully authorized, issued and sold and this day
by us duly delivered to the purchaser thereof, and paid for, in-
cluding accrued interest, at a price not less than par, Fifty-
three (53) negotiable Sewer Bonds (special assessment) of the
said municipality, numbered consecutively from One (1) to
fifty-three (53), both numbers inclusive, in the aggregate
amount of $53,000, bearing date of January 1, 1963, each of
said bonds being executed with the genuine signature of said
Mayor and said Clerk, and with the genuine seal of said
municipality, the certificate on the back of each bond being
executed with the genuine signature of said Clerk; and each of
the coupons attached to each of said bonds being executed with
the facsimile signature of said Clerk; said bonds being issued
to defray the cost of sewer improvements in said municipality.
We further certify that as shown by the records of said
municipality, assessments of not less than $58,925.87 remain
outstanding and unpaid, out of assessments levied on the 28th
day of August, 1962, for the assessed cost of sewer improvements
in said municipal corporation as described in the resolution
referred to in said bonds.
And we, the aforesaid officers, do hereby certify that no
controversy or litigation is pending, prayed or threatened in-
volving the proceedings incident to the authorization of said
bonds or in any way concerning the validity of said bonds, issued
in anticipation of the collection of unpaid assessments heretofore
levied in said municipality for the improvements as ordered con-
structed, and that no controversy or litigation is pending, ,prayed
or threatened involving the regularity of the levy of said assess-
