HomeMy WebLinkAbout2022-02-07-Regular Minutes►, � V/aukee Iry THE KEY TO GOOD LIVING WAUKEE CITY COUNCIL MINUTES February 7, 2022 (A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor Clarke at 5:31 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom. (B) Pledge of Allegiance (C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members R. Charles Bottenberg, Chris Crone, Anna Bergman Pierce (electronically), Ben Sinclair. Absent: Council Member Larry R. Lyon. (Council Member Lyon began participating electronically at 6:10 P.M.) Also in attendance: City Administrator Tim Moerman, Assistant City Administrator Brad Deets, Community Development Director Andy Kass, Finance Director Linda Burkhart, Parks & Recreation Director Matt Jermier, Public Works Director/City Engineer Rudy Koester (electronically), Human Resources Director Michelle Lindsay, IT Director Son Le, Marketing & Communications Director Summer Evans (electronically), Police Lt. Scott Cunningham, Police Officer Kathryn Guess, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Open Forum — 1) Bruce Kalisek, 14425 University Ave., noted that the City has historically removed the snow from his and his neighbors' sidewalks but that they recently received notice from the City that they themselves need to now remove the snow. He asked why the policy changed after so many years, adding that he wished they could've been involved in some discussion on the matter. He added that it is a six-foot sidewalk/trail and that City plows along University Ave. throw a lot of snow onto that sidewalk. Mayor Clarke thanked Mr. Kalisek for his comments, adding that elected officials and staff would discuss the matter. 2) Joan Ross, 450 SE Rosenkranz Dr., in response to Mr. Kalisek's concerns, suggested that the City should take care of all snow removal from 6-foot-wide sidewalks/trails. (E) Agenda Approval — Council Member Bottenberg moved to approve the agenda; seconded by Council Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Pierce, Sinclair. Nays: None. Absent: Lyon. Motion carried 4 — 0 — 1. (F) Monthly Mayor's Report — Mayor Clarke noted a Jan. 31 City Council work session for visioning for the future Public Safety Facility. Elected officials and adminstrators have recently attended the Greater Des Moines Partnership and Waukee Area Chamber of Commerce annual dinners. The City is currently hiring for seasonal positions. All City offices are closed Feb. 21 in observance of Presidents' Day but trash and recycling collection dates are not impacted. (G) Presentations: 1) Ankeny Sanitation, Inc., annual report — Report made by Ankeny Sanitation General Manager Dave Massey, who also presented the City with a recycling rebate check. (H) Public Hearings: 1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-2, R-2/PD-1 and R-4, a property to be known as Painted Woods West Phase 2 — Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk's office. Community Development Director Kass reviewed the application, noting that owners for 50.14% of the surrounding property have consented to the application. Mr. Kass reviewed a development concept plan for single family and townhome lots. The planned development overlay addresses architectural standards, landscaping and building size. He then noted street extensions and improvements, and stated that the parkland dedication parcel would abut existing City parkland. Erin 011endike with Civil Design Advantage (CDA), addressed the council on behalf of the applicant, stating that she was available to answer any questions. No comments were made by the public in attendance. (J) 2) On an FY2023 proposed property tax levy pursuant to Iowa Code 384.15A — Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk's office. Finance Director Burkhart noted that the public hearing was required as the City plans to exceed 102% growth in the upcoming fiscal year. The hearing notice was posted as required and no comments were received pertaining to the levy. It is proposed to reduce the City's tax levy by $0.20. No comments were made by the public in attendance. Public Hearing Action Items: 1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-2, R- 21PD-1 and R-4, a property to be known as Painted Woods West Phase 2 [introduction; first reading] — Council Member Sinclair introduced the ordinance and move to approve the first reading in title only; seconded by Council Member Crone. Results of vote: Ayes: Bottenberg, Crone, Pierce, Sinclair. Nays: None. Absent: Lyon. Motion carried 4 — 0 — 1. 2) Resolution: Consideration of approval of a resolution approving FY2023 maximum property tax dollars — Council Member Bottenberg moved to approve the resolution; seconded by Council Member Crone. Results of vote: Ayes: Bottenberg, Crone, Pierce, Sinclair. Nays: None. Absent: Lyon. Motion carried 4 — 0 — 1. Community Development Director Kass reviewed the plat for detached, villa -style homes. Internal streets will be privately owned and maintained. The development will require the relocation of a sanitary sewer line. Parkland dedication will be through recreational trail installation that will eventually connect to the overall trail system. Council Member Bottenberg asked if City staff had any concerns with privately -owned streets in a single family development; Mr. Kass replied in the negative, noting that it was similar to townhome developments. Council Member Bottenberg asked if -City staff expected more developments of this nature; Mr. Kass replied that it was possible, as it seems to be a popular housing option. Council Member Sinclair asked if the sanitary sewer line relocation was a major project; Mr. Kass responded that only one section needed to be moved. Community Development Director Kass reviewed the preliminary plat, construction drawings, final plat and site plan for the subject property. The development will consist of multi -family and townhome units for rent and not ownership. The development also includes garage units, surface parking, a clubhouse and pool. (Council 15 Member Lyon began participating electronically at 6:10 p.m.) Mr. Kass reviewed exterior building elevations and noted a fee in lieu of parkland dedication. Mayor Clarke asked why the developer proposed a fee and not parkland; Mr. Kass explained that the City was looking to develop parkland and recreational trail extensions to the east of the subject property. He also noted the proximity of Triumph Park to the development. Council Member Crone voiced her pleasure with seeing townhome rental units.
