WAUKEE CITY COUNCIL MINUTES
February 22, 2022
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members
Chris Crone, Larry R. Lyon (electronically), Anna Bergman Pierce, Ben Sinclair (electronically).
Absent: Council Member R. Charles Bottenberg.

Agenda Approval — Council Member Crone moved to approve the agenda; seconded by
Council Member Pierce. Results of vote: Ayes: Crone, Lyon, Pierce, Sinclair. Nays: None.
Absent: Bottenberg. Motion carried 4 — 0 — 1.
Presentations:
1) Paving industry awards — Public Works Director/City Engineer Koester noted awards
presented to the City of Waukee by the Iowa Concrete Paving Association (ICPA) for the
Warrior Ln. Improvements Phase 1 and NW 10th St. Improvements projects.
Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 and K-MF Stacked Medium to K-MF Stacked
Medium /PD-1, a property to be known as Edencrest at Kettlestone — Mayor Clarke
opened the public hearing and asked if any written correspondence had been received; City
Clerk Schuett replied that none had been received in the clerk's office. Community
Development Director Kass reviewed the rezoning application, noting that the applicant has
obtained consent from property owners for 58.6% of the surrounding property. The
developer proposes a two-story senior housing facility, including independent, assisted and
memory care units. Mr. Kass discussed landscape buffering requirements and site
ingress/egress. The applicant requests a higher density due to the mix of unit types, a lower
minimum square footage per unit for the assisted and memory care units, and fewer parking
spaces. The proposed density is no greater than that allowed in standard R-3 zoning
districts. The applicant has developed other similar projects in the Des Moines metro. No
comments were made by the public in attendance.
2) On an ordinance to amend Chapter 165, Zoning Regulations, Definitions and General
Regulations, by adding provisions for Mobile Food Units — Mayor Clarke opened the
public hearing and asked if any written correspondence had been received; City Clerk
Schuett replied that none had been received in the clerk's office. Community Development
Director Kass reviewed the ordinance, which is similar to the food truck pilot program that
has been in place for the last several years. No comments were made by the public in
attendance.
3) On plans, specifications, form of contract and estimate of cost [Warrior Lane
Improvements Phase 2 Project] — Mayor Clarke opened the public hearing and asked if
any written correspondence had been received; City Clerk Schuett replied that none had
been received in the clerk's office. Public Works Director/City Engineer Koester reviewed
the project, which includes improvements from Park Rd./Ford Ln. to the northern entrance of
Waukee Middle School. The project also includes improvements to the Waukee Middle
School parking lot; a 28E agreement with the Waukee Community School District regarding
reimbursement for those improvements will be presented to the council at a future meeting.
No comments were made by the public in attendance.
(H) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 and K-MF

at Kett/estone [introduction; first reading] - Council Member Crone introduced the
ordinance and moved to approve the first reading in title only; seconded by Council Member

Bottenberg. Motion carried 4 — 0 — 1.
2) Ordinance: Consideration of approval of an ordinance to amend Chapter 165, Zoning

3) Warrior Lane Improvements Phase 2 Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost - Council Member Crone
moved to approve the resolution; seconded by Council Member Pierce. Public Works
Director/City Engineer Koester noted that the contract documents include a "no excuse"
enhancement payment as an incentive for the contractor to adhere to the August
completion date. Mr. Koester then reviewed the bid tabulation, noting the lowest bid from
Absolute Concrete Construction, Inc., of Slater, IA. Factoring in reimbursement from the
Waukee Community School District, the project is anticipated to come in under estimate.
Results of vote: Ayes: Crone, Lyon, Pierce, Sinclair. Nays: None. Absent: Bottenberg.
Motion carried 4 — 0 — 1. (Resolution #2022-056)
B. Resolution: Consideration of approval of a resolution awarding contract — Council
Member Pierce moved to approve the resolution; seconded by Council Member Crone.
Public Works Director/City Engineer Koester recommended awarding contract to
Absolute Concrete Construction, Inc., of Slater, IA, in the amount of $2,536,969.55.
Results of vote: Ayes: Crone, Lyon, Pierce, Sinclair. Nays: None. Absent: Bottenberg.
Motion carried 4 — 0 — 1. (Resolution #2022-057)
C. Resolution: Consideration of approval of a resolution approving contract and
bond — Council Member Crone moved to approve the resolution; seconded by Council
Member Pierce. Results of vote: Ayes: Crone, Lyon, Pierce, Sinclair. Nays: None.
Absent: Bottenberg. Motion carried 4 — 0 — 1. (Resolution #2022-058)
(1) Action Items:
1) Consent Agenda: Council Member Pierce moved to approve the Consent Agenda;
seconded by Council Member Crone. Council Member Crone asked for clarification on the
skydiving agreement (Item #11 E3); Parks & Recreation Director Jermier briefly reviewed the

an Iowa State Revolving Fund (SRF) Water Resource Sponsored Project [Little Walnut

resolution; seconded by Council Member Pierce. Public Works Director/City Engineer
Koester explained that the grant dollars would be used to help finance the NE Outfall Sewer
Project, which is a joint effort with the Cities of Clive and Urbandale. A 28E agreement
outlining project responsibilities will be presented at a future council meeting. Mayor Clarke
spoke in favor of projects such as this that help improve water quality through a collaborative
