March 21, 2022
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members
Chris Crone, Anna Bergman Pierce (electronically), Ben Sinclair. Absent: Council Members R.
Charles Bottenberg, Larry R. Lyon.
Also in attendance: City Administrator Tim Moerman, Assistant City Administrator Brad Deets,
Finance Director Linda Burkhart, Public Works Director/City Engineer Rudy Koester, Community
Development Director Andy Kass, Parks & Recreation Director Matt Jermier, Human Resources
Director Michelle Lindsay, IT Director Son Le, Police Chief John Quinn, Police Officer Rod
Schettler, City Clerk Rebecca D. Schuett, City Attorney Steve Brick.

(E) Agenda Approval — Council Member Crone moved to approve the agenda; seconded by
Council Member Sinclair. Results of vote: Ayes: Crone, Pierce, Sinclair. Nays: None. Absent:
Bottenberg, Lyon. Motion carried 3 — 0 — 2.
(F) Presentations:
1) Waukee Leadership Institute class project review — Class members Drew Lewis and
Jasmine Leonard presented on plans and fundraising efforts to revitalize Triangle Park as
their class project.
(G) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to AR, a parcel known as the Dowell Property —
Mayor Clarke opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied that none had been received in the clerk's office.
Community Development Director Kass reviewed the rezoning application that will allow for
the future subdivision of the property into three separate parcels. The applicant has
obtained consent from property owners for 76% of the surrounding property. City staff has
received no formal correspondence for or against the rezoning. The Comprehensive
Development Plan shows the subject parcel as Urban Reserve and staff anticipates that the
existing homes will continue to be served by septic systems and rural water. The property is
currently an illegal, non -conforming use as there are two single family homes on one lot.
Mayor Clarke asked for public comment: 1) Denise Dowell Patterson, no address given
(participating electronically), stated that as a beneficiary of the estate, she opposed the
rezoning. She asked the council to table the matter until the beneficiaries have more
information and time to resolve the matter. 2) Applicant Dennis Dowell, no address given,
replied that he is the executor of the estate and has followed all the steps required by the
City for rezoning. Council Member Sinclair stated that the objection appeared to be a private
issue and there seemed to be no technical reason for the council to deny the application;
City Attorney Brick replied in the affirmative, adding that the issues raised by Ms. Dowell
Patterson must be addressed through the courts and not by council. 3) Ivan Dowell of
Edmonds, OK (participating electronically), stated that he was the eldest son of Evelyn
Dowell and a one-third owner of the property. He also asked the council to table the matter,
noting that a majority of the property owners were not interested in rezoning the parcel.
2) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to R-1, a parcel to be known as Tanglewoods
Acres Plat 3 — Mayor Clarke opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied that none had been received
in the clerk's office. Community Development Director Kass reviewed the rezoning
application and property location, adding that the parcel was platted prior to annexation by
the City. The applicant wishes to adjust the lot line between the two existing parcels to
create a second, more buildable lot. Due to the planned lot sizes, the parcel would be an
illegal, non -conforming use under the current zoning. The applicant has obtained consent
from property owners for 70% of the surrounding property. The second lot is currently
encumbered by FEMA flood plain areas. Erin 011endike with Civil Design Advantage (CDA)
(participating electronically), addressed the council on behalf of the applicant, stating that
she was available to answer any questions. No comments were made by the public in
attendance.
3) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 and C-1 to R-3/PD-1, a parcel to be known as West
Light — Mayor Clarke opened the public hearing and asked if any written correspondence
had been received; City Clerk Schuett replied that none had been received in the clerk's
office. Community Development Director Kass reviewed the rezoning application, noting
that the applicant has obtained consent from property owners for 55% of the surrounding
property; much of the adjoining property is in the City of Clive. Mr. Kass reviewed a
development concept plan for a four-story multi -family building with underground parking and
other amenities. Site access is proposed along the joint property line to the west; the
application will need to work with the adjoining property owner on roadway construction.
The PD-1 overlay includes a taller building, higher density and smaller studio square footage
than is required in an R-3 zoning district. There are only seven studio units proposed within
the building that would include the smaller square footage. Eric Cannon, project engineer,
introduced himself in the event of any questions from the council. Council Member Crone
asked if such small studio units have been approved in the past; Mr. Kass replied in the
affirmative. Council Member Sinclair wondered if there were any concerns with the right-
in/right-out only access planned for the site; Mr. Kass answered that a % access was
planned but when the property to the west is developed, cross easements will be required.
No comments were made by the public in attendance.
4) On a proposed City of Waukee FY2023 budget — Mayor Clarke opened the public hearing
and asked if any written correspondence had been received; City Clerk Schuett replied that
none had been received in the clerk's office. City Administrator Moerman reviewed the
proposed budget revenues and expenditures, noting that the proposal would reduce the
property tax levy by $0.20/1,000 valuation. He also reviewed proposed staffing changes,
one-year capital improvement projects and utility rate adjustments. No comments were
made by the public in attendance.
5) On a proposed Capital Improvement Program for Fiscal Years 2023-2027— Mayor
Clarke opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied that none had been received in the clerk's office. City
Administrator Moerman reviewed the proposed improvements for parks and trails, roads,
utilities and other projects. He then discussed major funding sources for the proposed
improvements. Mayor Clarke thanked City staff for their work on both the budget and CIP
program. No comments were made by the public in attendance.
6) On plans, specifications, form of contract and estimate of cost [Public Works 2"d Floor
Expansion Project] — Mayor Clarke opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied that none had been received
in the clerk's office. Public Works Director/City Engineer Koester reviewed the project, which
will create additional office and IT equipment space. The project is included in the proposed
Capital Improvement Program. No comments were made by the public in attendance.
(H) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to AR, a
parcel known as the Dowell Property [introduction; first reading] - Council Member
Crone introduced the ordinance and moved to approve the first reading in title only;
seconded by Council Member Sinclair. Council Member Crone cited the family concerns
related to the property but noted that she understood the council's role in the matter. Mayor
Clarke added that the rezoning request was made by the person legally allowed to do so.
Results of vote: Ayes: Crone, Pierce, Sinclair. Nays: None. Absent: Bottenberg, Lyon.
Motion carried 3 — 0 — 2.

5) Resolution: Consideration of approval of a resolution approving City of Waukee
Capital Improvement Program for Fiscal Years 2023-2027 - Council Member Crone
moved to approve the resolution; seconded by Council Member Sinclair. Results of vote:
Ayes: Crone, Pierce, Sinclair. Nays: None. Absent: Bottenberg, Lyon. Motion carried 3 — 0
— 2. (Resolution #2022-099)
6) Resolution: Consideration of approval of a resolution declaring an Official Intent
under Treasury Regulation 1.150-2 to issue debt to reimburse the City for certain
original expenditures paid in connection with specified projects - Council Member
Sinclair moved to approve the resolution; seconded by Council Member Crone. Finance
Director Burkhart noted that the resolution would give the City the authority to spend funds
on projects prior to bond issuance. Results of vote: Ayes: Crone, Pierce, Sinclair. Nays:
None. Absent: Bottenberg, Lyon. Motion carried 3 — 0 — 2. (Resolution #2022-100)
7) Resolution: Consideration of approval of a resolution adopting the City of Waukee
2022 Fee Schedule — Council Member Crone moved to approve the resolution; seconded
by Council Member Sinclair. City Clerk Schuett highlighted some of the proposed fee
amendments. Results of vote: Ayes: Crone, Pierce, Sinclair. Nays: None. Absent:
Bottenberg, Lyon. Motion carried 3 — 0 — 2. (Resolution #2022-101)
8) Public Works 2"d Floor Expansion Project
A. Resolution: Consideration of approval of a resolution approving plans,

B. Resolution: Consideration of approval of a resolution awarding contract — Council

Public Works Director/City Engineer Koester reviewed the bid tabulation, recommending
award of the base bid and Alternate 1 to Core Construction Services, LLC, of Des
Moines, IA, in the amount of $389,550.00. Results of vote: Ayes: Crone, Pierce, Sinclair.
