WAUKEE CITY COUNCIL MINUTES
April 4, 2022
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members R.
Charles Bottenberg, Chris Crone, Anna Bergman Pierce (electronically), Ben Sinclair. Absent:
Council Member Larry R. Lyon.
Also in attendance: City Administrator Brad Deets, Community Development Director Andy
Kass, Finance Director Linda Burkhart, Parks & Recreation Director Matt Jermier, Public Works
Director/City Engineer Rudy Koester, Human Resources Director Michelle Lindsay, IT Director
Son Le (electronically), Police Lt. Jeremy Long, Police Officer Kathryn Guess, City Clerk
Rebecca D. Schuett, City Attorney Steve Brick.

(E) Agenda Approval — Council Member Crone moved to approve the agenda; seconded by
Council Member Bottenberg. Results of vote: Ayes: Bottenberg, Crone, Pierce, Sinclair. Nays:
None. Absent: Lyon. Motion carried 4 — 0 — 1.
(F) Monthly Mayor's Report — Mayor Clarke noted that yard waste collection began today.
National Drug Take -Back Day is April 30 at the Waukee Public Safety Building. The annual
Spring Clean-up is May 2-7.
(G) Presentations: None
(H) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 and R-1/PD-1 to R-1, a parcel known as Broderick
Holdings Property — Mayor Clarke opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied that none had been received
in the clerk's office. Community Development Director Kass reviewed the application, which
requests rezoning in order to construct a single family home on the property. The applicant
received consent from property owners of approximately 59% of the surrounding property.
The City's comprehensive development plan shows the subject property as single family
residential. No comments were made by the public in attendance.
2) On the vacation and disposal of public property pursuant to Iowa Code Sections
354.23 and 364.7 (2021), a property known as Outlot Y of Clayton Estates Plat 2 —
Mayor Clarke opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied that none had been received in the clerk's office.
Community Development Director Kass reviewed the property location, stating that the City
had acquired the property for 101h St. right-of-way but the street alignment has since shifted.
The developer directly to the west of the property (Prairie Village of Iowa, LLC) submitted a
purchase offer to the City for the outlot. City staff notified the other abutting property owners
of the purchase offer; no other offers were received by the City. The future owner of the
outlot will still be required to extend Gray Ave. No comments were made by the public in
attendance.
3) On plans, specifications, form of contract and estimate of cost [NW Meredith Drive
Overlay Project, NW 10th Street to N Warrior Lane] — Mayor Clarke opened the public
hearing and asked if any written correspondence had been received; City Clerk Schuett
replied that none had been received in the clerk's office. Public Works Director/City
Engineer Koester reviewed the project for an asphalt overlay and replacement of some
deteriorating culverts. The segment will remain a rural section of roadway. The project
includes a late July 2022 completion date so that construction occurs during school summer
break. No comments were made by the public in attendance.

Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning

to R-1, a parcel known as Broderick Holdings Property [introduction; first reading] —
Council Member Sinclair introduced the ordinance and moved to approve the first reading in
title only; seconded by Council Member Crone. Council Member Bottenberg asked if the
applicant planned to construction only one single family residence; Community Development
Director Kass replied in the affirmative. Results of vote: Ayes: Bottenberg, Crone, Pierce,
Sinclair. Nays: None. Absent: Lyon. Motion carried 4 — 0 — 1.
2) Resolution: Consideration of approval of a resolution approving the vacation and
disposal of public property pursuant to Iowa Code Sections 354.23 and 364.7 (2021),
[Out/ot Y of Clayton Estates Plat 2] — Council Member Crone moved to approve the
resolution; seconded by Council Member Sinclair. Community Development Director Kass
recommended sale of the property to Prairie Village of Iowa, LLC, in the amount of
$25,730.00. Results of vote: Ayes: Bottenberg, Crone, Pierce, Sinclair. Nays: None.
Absent: Lyon. Motion carried 4 — 0 — 1. (Resolution #2022-124)
3) Public Works 2nd Floor Expansion Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost — Council Member Bottenberg
moved to approve the resolution; seconded by Council Member Crone. Results of vote:
Ayes: Bottenberg, Crone, Pierce, Sinclair. Nays: None. Absent: Lyon. Motion carried 4
— 0 — 1. (Resolution #2022-125)
B. Resolution: Consideration of approval of a resolution awarding contract — Council
Member Crone moved to approve the resolution; seconded by Council Member
Bottenberg. Public Works Director/City Engineer Koester reviewed the bid tabulation,
recommending award to InRoads, LLC, of Des Moines, IA, in the amount of $638,555.30.
Results of vote: Ayes: Bottenberg, Crone, Pierce, Sinclair. Nays: None. Absent: Lyon.
Motion carried 4 — 0 — 1. (Resolution #2022-126)

Tallgrass Ln. and SE Esker Ridge Dr.; Mr. Kass replied in the affirmative but added that the
sidewalks would only extend to the lot lines and not connect with SE Parkview Crossing Dr.

Kass briefly reviewed the site plan for the first phase of Apple Data Center development.
The proposed site plan includes a data center, administration, maintenance and network
distribution buildings, as well as a guard house. Site access will be provided by S Ave., to
