THE KEY TO GOOD LIVING WAUKEE CITY COUNCIL MINUTES May 2, 2022 (A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor Pro Tern Bottenberg at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom. (B) Pledge of Allegiance (C) Roll Call — The following members were present: Council Members R. Charles Bottenberg, Chris Crone, Larry R. Lyon, Anna Bergman Pierce (electronically), Ben Sinclair. Absent: Mayor Courtney Clarke. Also in attendance: City Administrator Brad Deets, Finance Director Linda Burkhart, Public Works Director/City Engineer Rudy Koester, Planner II Melissa DeBoer, City Planner Bill Mettee, Economic Development Coordinator Jennifer Brown, IT Director Son Le (electronically), Police Chief John Quinn, Police Sgt. Brandon Pettit, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Open Forum (E) Agenda Approval — Council Member Crone moved to approve the agenda, removing consideration of Consent Agenda Item J1 H3 and tabling Consent Agenda Item J112 until the May 16 regular council meeting; seconded by Council Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0. (F) Monthly Mayor's Report — No report made. (G) Presentations: None (H) Public Hearings: 1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-1, a parcel to be known as Hamilton Ridge Plat 12 — Mayor Pro Tern Bottenberg opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk's office. Planner II DeBoer reviewed the application for an approximately 6.76- acre parcel. The applicant had originally proposed zoning the parcel as R-4 in 2020 but withdrew the application at that time, prior to council consideration. The applicant now requests the parcel be rezoned as R-1. Ms. DeBoer reviewed buffering requirements and parcel access, noting that the parkland dedication requirement was met as part of the overall Hamilton Ridge development. Erin 011endike, project engineer with Civil Design Advantage (participating electronically), introduced herself if there were any questions on the application. No comments were made by the public in attendance. 2) On an ordinance correcting a legal description error in Ordinance No. 3024, by repealing the ordinance and amending Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from C-1 to M-1, a property to be known as Legacy Park West — Mayor Pro Tern Bottenberg opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk's office. Planner II DeBoer stated that the rezoning was recently approved by council but there was an error in the legal description that would be corrected through the proposed ordinance. The actual rezoning request remains unchanged. No comments were made by the public in attendance. (1) Public Hearing Action Items: 1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-1, a parcel to be known as Hamilton Ridge Plat 12 [introduction; first reading] — Council Member Sinclair introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Lyon. Council Member Bottenberg stated that he was happy to see the rezoning changed to R-1, as it was more functional for the neighborhood. (J) Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0. 2) Ordinance: Consideration of approval of an ordinance correcting a legal description error in Ordinance No. 3024, by repealing the ordinance and amending Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from C-1 to M-1, a property to be known as Legacy Park West [introduction; first, second, third (final) readings] — Council Member Crone introduced the ordinance, moved to approve the first reading in title only, waive the second and third readings, and place the ordinance on final passage; seconded by Council Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0.
