WAUKEE CITY COUNCIL MINUTES
June 6, 2022
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Pro Tern R. Charles Bottenberg at 5:31 p.m. at Waukee City Hall, 230 W. Hickman Rd. and
electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call — The following members were present: Council Members R. Charles Bottenberg,
Chris Crone, Larry R. Lyon, Anna Bergman Pierce, Ben Sinclair. Absent: Mayor Courtney
Clarke.
Also in attendance: City Administrator Brad Deets, Finance Director Linda Burkhart, Public
Works Director/City Engineer Rudy Koester, Community Development Director Andy Kass,
Parks & Recreation Director Matt Jermier, Human Resources Director Michelle Lindsay, Police
Chief John Quinn, Police Officer Kathryn Guess, City Clerk Rebecca D. Schuett, City Attorney
Steve Brick.

(E) Agenda Approval — Council Member Sinclair moved to approve the agenda; seconded by
Council Member Crone. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays:
None. Motion carried 5 — 0.
(F) Presentations: None
(G) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to R-2 and R-3, a parcel to be known as Fox Creek
Meadows — Mayor Pro Tern Bottenberg opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied that none had been received
in the clerk's office. Community Development Director Kass reviewed the proposed
rezoning application for property recently annexed into the City. A development concept
plan shows duplex lots and an outlot for future multi -family development. The applicant
received greater than 50% consent from adjacent property owners; City staff has received
no correspondence for or against the application. Parkland dedication includes a parcel to
be included in future greenbelt trail development. Mr. Kass reviewed proposed streets. He
added that the City's Comprehensive Development Plan shows single family homes in the
area but that the proposed duplex units meet the density requirement. City staff is
comfortable with the proposed multi -family parcel as it creates additional housing diversity
near schools. No comments were made by the public in attendance.
(H) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-2 and R-
3, a parcel to be known as Fox Creek Meadows [introduction; first reading] — Council
Member Crone introduced the ordinance and moved to approve the first reading in title only;
seconded by Council Member Sinclair. Council Member Bottenberg asked if the multi -family
parcel was considered an appropriate use due to its location along NW Douglas Pkwy.; Mr.
Kass reiterated that City staff was comfortable with the multi -family rezoning request.
Council Member Pierce questioned if the property to the north of the subject parcel has been
annexed; Mr. Kass replied in the affirmative. Results of vote: Ayes: Bottenberg, Crone,
Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0.

by Council Member Pierce. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair.

Rates and Charges, to correct a scrivener's error repealing Subsections 100.05(1) and
100.05(3) [introduction; first, second, third (final) readings] — Council Member Crone
introduced the ordinance, moved to approve the first reading in title only, waive the second
and third readings, and place the ordinance on final passage; seconded by Council Member
Pierce. Public Works Director/City Engineer Koester stated that certain subsection were
inadvertently deleted when stormwater rates were recently updated. The proposed
ordinance has no impact on those rates and City staff recommend the waiver of readings.

4) Resolution: Consideration of approval of a resolution directing sale of $11,755,000
(subject to adjustment per terms of offering) General Obligation Bonds, Series 2022A
— Prior to a motion, Matt Stoffel with PFM Financial Advisors, LLC, presented the bid
tabulation, noting the low bid from Morgan Stanley & Co. of New York, NY. He reviewed the
proposed interest rate of 3.3084% and net interest cost of $4,711,873, adding that the City
will keep the premium. Council Member Lyon asked about the interest rate the last time the
City sold bonds; Mr. Stoffel replied that the 2021 bonds sold in the 1.5% range, but added
that 3.3% is historically the lower end of the range. Council Member Sinclair moved to
approve the resolution; seconded by Council Member Lyon. Upon counsel from City
Attorney Brick, Council Member Sinclair amended the motion to approve the resolution,
awarding sale to Morgan Stanley & Co. of New York, NY; Council Member Lyon amended
the second. Council Member Bottenberg stated that he would abstain from voting due to a

made to the plan since that approval require reconsideration by council. He reviewed site

6) Resolution: Consideration of approval of a resolution approving preliminary plat for
New Creations — Council Member Lyon moved to approve the resolution; seconded by

buildings, with one for adult daycare and the other for child daycare. The proposed plat
splits one lot into two so both buildings would be on separate lots. Mr. Kass noted that a

final plat and site plan for the subject property. The final plat would create one lot, with the
remainder of the property as an outlot for future multi -family development. The site plan
proposes an 80-unit senior housing facility with a combination of independent, assisted and
memory care units. Mr. Kass reviewed site access, greenbelt trail connections, landscape
buffering and exterior building elevations. Council Member Bottenberg asked when
construction would begin; a representative from Hubbell Realty Company, who did not
identify himself, replied that the project was planned to begin late summer/early fall of this

approve the resolution; seconded by Council Member Sinclair. City Administrator Deets
reviewed the role of the construction manager as agent as the City nears completion of a
preliminary concept design for the new Public Safety Facility. Council Member Lyon asked
for clarification on the roles of owners representative, construction manager and architect;
Mr. Deets reviewed the different roles. Council Member Lyon said that it seemed a large
expense, but noted that the City of Clive followed a similar model to their satisfaction. Mr.
Deets replied that City staff anticipated fewer cost increases during construction by utilizing

16) Resolution: Consideration of approval of a resolution approving and adopting City of
Waukee Trails Master Plan — Council Member Sinclair moved to approve the resolution;
seconded by Council Member Crone. Parks & Recreation Director Jermier briefly
highlighted certain aspects of the proposed plan, including future trail networks, access
points, regional connections and plan implementation. Results of vote: Ayes: Bottenberg,
Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0. (Resolution #2022-249)
