WAUKEE CITY COUNCIL MINUTES
July 5, 2022
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members R.
Charles Bottenberg, Chris Crone, Larry R. Lyon, Anna Bergman Pierce (electronically), Ben
Sinclair. Absent: None.
Also in attendance: City Administrator Brad Deets, Finance Director Linda Burkhart, Public
Works Director/City Engineer Rudy Koester, Community Development Director Andy Kass,
Director of Economic Development Jennifer Brown, Parks & Recreation Director Matt Jermier,
Police Lt. Jeff Mellencamp, City Clerk Rebecca D. Schuett, City Attorney Steve Brick
(electronically).
(D) Open Forum — Chris Kunej, 1695 SE Greentree Dr., asked the council to explore the option of
paying utility bills online without a service fee.
(E) Agenda Approval — Council Member Crone moved to approve the agenda; seconded by
Council Member Lyon. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays:
None. Motion carried 5 — 0.
(F) Monthly Mayor's Report — Mayor Clarke noted that Waukee was recently ranked #7 among
Iowa's safest cities by SafeWise. She expressed her thanks to the Parks & Recreation
Department and Park Board for a successful 4th of July celebration, then stated that the Waukee
Arts Fest would be held July 15-16.
(G) Presentations: None
(H) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to K-MF Stacked Med, a parcel to be known as
Launch Townhomes at Kettlestone — Mayor Clarke opened the public hearing and asked if
any written correspondence had been received; City Clerk Schuett replied that none had
been received in the clerk's office. Community Development Director Kass presented on the
rezoning application for just over 7 acres at the NE corner of Ashworth Rd. and SE L.A.
Grant Pkwy. The applicant received approximately 55% consent from adjacent property
owners. The development concept plan shows townhome units with 12.3 units per acre
density. No comments were made by the public in attendance.
2) On plans, specifications, form of contract and estimate of cost [West Area Trunk
Sewer Extension Phase 2 Project] — Mayor Clarke opened the public hearing, noting that it
was a continuation of the June 20 hearing, and asked if any written correspondence had
been received; City Clerk Schuett replied that none had been received in the clerk's office.
Public Works Director/City Engineer Koester briefly reviewed the project, noting a
September 2023 completion date. No comments were made by the public in attendance.
(1) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to K-MF
Stacked Med, a parcel to be known as Launch Townhomes at Kett/estone
[introduction; first reading] — Council Member Lyon introduced the ordinance and moved
to approve the first reading in title only; seconded by Council Member Sinclair. Council
Member Sinclair asked if there were plans to improve the Ashworth Rd./SE L.A. Grant Pkwy.
intersection; Community Development Director Kass replied that Ashworth Rd.
improvements in the area were scheduled for FY2028. Council Member Sinclair then noted
that the subject parcel had a lot of wooded area and asked if it could be used as parkland;
Mr. Kass stated that City staff had looked into the matter but the land has no good access

and a challenging grade. Council Member Lyon wondered why a developer would acquire
property like the wooded area and not develop it; Mr. Kass noted the unit density restrictions
and that the developer had stated that they wanted to preserve the trees and stream area.
Council Member Lyon asked if restrictions should be put in place to prevent the development
of the wooded area; City Administrator Deets answered that City staff could discuss
restrictive covenants that would address the wooded area. Public Works Director/City
Engineer Koester added that there were plans for a future lift station in the area and that the
developer is aware of those plans. Council Member Bottenberg stated that there should be
restrictive covenants against the development of the wooded area in light of the fact that the
developer was granted greater unit density on the rest of the parcel; Mr. Deets replied that
such restrictions would be addressed during platting. Results of vote: Ayes: Bottenberg,
Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0.
2) West Area Trunk Sewer Extension Phase 2 Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost — Council Member Crone
moved to approve the resolution; seconded by Council Member Lyon. Results of vote:
Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0.

B. Resolution: Consideration of approval of a resolution awarding contract — Council
Member Lyon moved to approve the resolution; seconded by Council Member Crone.
Public Works Director/City Engineer Koester reviewed the bid tabulation, noting that the
apparent low bidder had submitted a letter to the City stating that there was a significant
error in their bid and asking that it not be considered. City staff recommends awarding
contract to the second lowest bidder, Rognes Corp. of Ankeny, IA, in the amount of
$4,289,688.00. Mr. Koester stated that the sanitary sewer fund cash balance was
available to help finance the project, but that there may be an impact on future CIP
planning. Council Member Lyon asked why the engineer's estimate was so far off from
the bids received; Mr. Koester cited the risk of material pricing and availability, adding
that extending the project construction timeline was considered but likely would not
impact the cost. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays:
None. Motion carried 5 — 0. Contract awarded to Rognes Corp. of Ankeny, IA, in the
amount of $4,289,688.00. (Resolution #2022-280)

2) Ordinance: Consideration of approval of an ordinance to amend Chapter 68, Parking
Regulations, City of Waukee, Iowa, by amending Section 68.04, Angle Parking, as
specified [introduction; first reading] — Council Member Crone introduced the ordinance
and moved to approve the first reading in title only; seconded by Council Member Sinclair.
Public Works Director/City Engineer Koester reviewed the ordinance amendment, which was
requested by the Waukee Community School District to allow the extension of a parent pick-
up lane near Vince Meyer Learning Center. Following ordinance approval, the school district
will be responsible for striping and signage. Mayor Clarke asked that the signage state that
parking is available outside of school hours. Results of vote: Ayes: Bottenberg, Crone, Lyon,
Pierce, Sinclair. Nays: None. Motion carried 5 — 0.
3) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
