WAUKEE CITY COUNCIL MINUTES
December 19, 2022
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Pro Tern Bottenberg at 5:31 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically
via Zoom.
(B) Pledge of Allegiance
(C) Roll Call — The following members were present: Council Members R. Charles Bottenberg,
Chris Crone, Larry R. Lyon, Anna Bergman Pierce, Ben Sinclair. Absent: Mayor Courtney
Clarke.

Agenda Approval — Council Member Lyon moved to approve the agenda; seconded by Council
Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None.

Presentations:
1) Independent Auditor's Final Report for the fiscal year ending June 30, 2022 —
Presentation made by David Ellis with Denman & Co. Audit Supervisor Joe Sparks with
Denman & Co. was also in attendance.
2) Resolution: Consideration of approval of the Independent Auditor's Final Report for
the fiscal year ending June 30, 2022 — Council Member Crone moved to approve the
resolution; seconded by Council Member Lyon. Results of vote: Ayes: Bottenberg, Crone,
Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0. (Resolution #2022-534)
Public Hearings:
1) On an ordinance to amend Chapter 166, Zoning Regulations, Administration and
Enforcement, Waukee, Iowa — Mayor Pro Tern Bottenberg opened the public hearing and
asked if any written correspondence had been received; City Clerk Schuett replied that none
had been received in the clerk's office. Community Development Director Kass reviewed the
proposed ordinance amendment to remove the requirement of 50% consent from adjoining
property owners to initiate a rezoning application. Mr. Kass noted issues with the current
requirement, specifically that granting consent is neither approval or denial of the application
and is therefore confusing, the consent is not required by State code, obtaining consent can
be problematic for applicants when adjoining property owners either cannot consent or
choose to remain neutral, and some adjoining properties may not be located within Waukee
city limits. The proposed ordinance amendment does not impact notification mailings,
signage or other requirements of the rezoning process. Some other minor clerical
modifications are also proposed. No comments were made by the public in attendance.
2) On a proposed The Quarter Commercial Urban Renewal Plan in the City of Waukee,
State of Iowa — Mayor Pro Tern Bottenberg opened the public hearing and asked if any
written correspondence had been received; City Clerk Schuett replied that none had been
received in the clerk's office. Director of Economic Development Brown reviewed the
proposed plan, noting that no one attended a Nov. 28 consultation meeting and that the plan
was reviewed by the Planning and Zoning Commission on Dec. 13. No comments were
made by the public in attendance.
3) On a proposal to enter into a Development Agreement with The Quarter at Waukee,
LLC — Mayor Pro Tern Bottenberg opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied that none had been received
in the clerk's office. Director of Economic Development Brown reviewed the proposed
agreement, which replaces the Second Amended and Restated Agreement approved earlier
in 2022. The proposed agreement includes minor modifications related to development
property, minimum assessed value, total valuation and economic development grant totals.
No comments were made by the public in attendance.
(H) Public Hearing Action Items:
1) Ordinance: Consideration of approval an ordinance to amend Chapter 166, Zoning
Regulations, Administration and Enforcement, Waukee, Iowa [introduction; first
reading]— Council Member Sinclair introduced the ordinance and moved to approve the first
reading in title only; seconded by Council Member Crone. Council Member Bottenberg
clarified that the only major difference in the process was that rezoning applicants no longer
would need to start the process with adjoining property owner consent; Community
Development Director Kass replied in the affirmative. Council Member Lyon stated that
communication throughout such processes is good but there were still plenty of opportunities
for participation in the rezoning process. City Administrator Deets noted that the City has
added many additional steps in the process over the last several years, including property
signage, as well as posting the information to the City website. Results of vote: Ayes:
Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0.
2) The Quarter Commercial Urban Renewal Plan/The Quarter at Waukee, LLC
A. Resolution: Consideration of approval of a resolution determining an area of the
City to be an economic development area, and that the rehabilitation,
conservation, redevelopment, development or a combination thereof, of such area
is necessary in the interest of the public health, safety or welfare of the residents
of the City; designating such area as appropriate for urban renewal projects; and
adopting The Quarter Commercial Urban Renewal Plan — Council Member Lyon
moved to approve the resolution; seconded by Council Member Pierce. Results of vote:
Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0.

B. Ordinance: Consideration of approval of an ordinance for the division of revenues
under Section 403.19, Code of Iowa, for The Quarter Commercial Urban Renewal
Plan [introduction; first reading] — Council Member Crone introduced the ordinance
and moved to approve the first reading in title only; seconded by Council Member
Sinclair. Director of Economic Development Brown stated that the proposed ordinance
established a TIF district. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce,
Sinclair. Nays: None. Motion carried 5 — 0.
C. Resolution: Consideration of approval of a resolution approving Development
Agreement with The Quarter at Waukee, LLC — Council Member Pierce moved to
approve the resolution; seconded by Council Member Crone. Results of vote: Ayes:
Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0.

DeBoer reviewed the site plan for an approximately 112,000-square-foot middle school
building that is planned to begin construction in 2023 and open in fall 2025. She then
reviewed site ingress/egress, including a shared drive with the school to the west, and
exterior building elevations. Council Member Sinclair noted additional traffic queueing space
and a roundabout, adding that he hoped to see more of this type of design. Results of vote:
