RESOLUTION 2023-119
RESOLUTION TO APPROVE AND EXECUTE AN AMENDMENT TO THE OPTION
TO PURCHASE AGREEMENT WITH NORTHPOINTE DEVELOPMENT II
CORPORATION FOR AFFORDABLE HOUSING PROJECT
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA UKEE, 10WA
WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS, the City of Waukee has chosen Northpointe Development II Corporation's
proposal to develop affordable housing on 6.44 acres of land near Douglas Parkway and North
Warrior Lane; AND,
WHEREAS, on March 6, 2023, the Waukee City Council approved an Option to Purchase
Agreement with Northpointe Development II Corporation for the purpose of developing an
affordable housing project (Resolution #2023-092); AND,
WHEREAS, the previous agreement granted Northpointe Development II Corporation the
option to purchase the above described land for $1 AND,
WHEREAS, after discovering a funding gap, Northpointe Development II Corporation has
approached a third party non-profit about developing a small amount of affordable owner
occupied units AND,
WHEREAS, the City proposes to amend the existing Option to Purchase Agreement to give the
City the authority to amend the approximate legal description and grant the third party non-profit
the ability to purchase their portion of the parcel for $1 via a separate Option Agreement AND,
WHEREAS, Code of Iowa §384.15(3) required a public hearing on the recommended
amendment to the Option to Purchase Agreement.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
Yd day of April, 2023, that the City of Waukee approve and execute an amendment to the Option
to Purchase Agreement with Northpointe Development II Corporati a purpose of
developing an affordable housing project.
