RESOLUTION 2023-192
APPROVING 28E AGREEMENT BETWEEN DALLAS COUNTY, IOWA, AND
CITY OF WAUKEE, IOWA FOR THE UTE AVENUE WIDENING AND
RESURFACING PROJECT
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA UKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, Dallas County, Iowa, by its Board of Supervisors and the City of Waukee, Iowa, an
Iowa municipal corporation ("Waukee") (Dallas County and Waukee together hereinafter
referred to as the "Parties"), propose entering into a 28E Agreement for the Ute Avenue
Resurfacing joint project with Dallas County, Iowa; AND
WHEREAS, the Ute Avenue Widening and Resurfacing project extents will be located on Ute
Avenue from the Eastbound On/Off Ramps of the I-80 and Ute Avenue Interchange in Waukee
to County Road F-90 in Dallas County; AND
WHEREAS, the contractor, Grimes Asphalt and Paving Corporation for and in consideration of
$1,084,997.97 payable as set forth in the specifications constituting a part of this contract, hereby
agrees to construct in accordance with the plans and specification therefore, and in the locations
designated in the notice to bidders, the various items of work as listed in the quantity and unit
price tabulation;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee approve
a 28E Agreement between Dallas County, Iowa and the City of Waukee, Iowa is hereby
approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 15"' day of May,
2023.
