WAUKEE CITY COUNCIL MINUTES
June 5, 2023
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Pro Tern Bottenberg at 5:31 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically
via Zoom.
(B) Pledge of Allegiance
(C) Roll Call — The following members were present: Council Members R. Charles Bottenberg,
Chris Crone, Larry R. Lyon, Anna Bergman Pierce (electronically). Absent: Mayor Courtney
Clarke, Council Member Ben Sinclair.
Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne,
Community Development Director Andy Kass, Director of Economic Development Jennifer
Brown, Human Resources Director Michelle Lindsay, Director of Marketing & Communications
Heather Behrens (electronically), Parks & Recreation Director Matt Jermier, Public Works

seconded by Council Member Lyon. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce.

(G) Public Hearings:
1) On plans, specifications, form of contract and estimate of cost [Transite Water Main
Replacement Phase 3 Project] — Mayor Pro Tern Bottenberg opened the public hearing
and asked if any written correspondence had been received; City Clerk Schuett replied that
none had been received in the clerk's office. Public Works Director/City Engineer Koester
reviewed the project to replace old asbestos water mains; there are no water quality
concerns. Replacement will be done through directional boring and the project is scheduled
for completion in May 2024. No comments were made by the public in attendance.
2) On a proposed Kettlestone Residential Urban Renewal Plan — Mayor Pro Tern
Bottenberg opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied that none had been received in the clerk's office.
Director of Economic Development Brown briefly reviewed plan objectives, including the
promotion of economic development, new multi -family residential development and
infrastructure installation. She reviewed a map of the Urban Renewal Plan area, noting that
the plan included the use of tax increment financing (TIF) to accomplish plan objectives.
Planning and project fees within the plan area will not exceed $200,000. No comments were
made by the public in attendance.
3) On a proposed Kettlestone Phase 1 Commercial Urban Renewal Plan — Mayor Pro Tern
Bottenberg opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied that none had been received in the clerk's office.
Director of Economic Development Brown reviewed plan objectives for the four proposed
phases of Commercial Urban Renewal Plans, as well as the types of activities within all four
plan areas. She reviewed a map of the Urban Renewal Plan area, noting that Phase 1
included a development agreement and that project and planning fees will not exceed
$1,000,000. No comments were made by the public in attendance.
4) On a proposed Kettlestone Phase 2 Commercial Urban Renewal Plan — Mayor Pro Tern
Bottenberg opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied that none had been received in the clerk's office.
Director of Economic Development Brown reviewed a map of the Urban Renewal Plan area,
noting that Phase 2 included a development agreement and that project and planning fees
will not exceed $1,000,000. No comments were made by the public in attendance.

Director of Economic Development Brown reviewed a map of the Urban Renewal Plan area,
noting that Phase 4 included a development agreement and that urban renewal project and
planning fees will not exceed $1,000,000 in reimbursement. No comments were made by
the public in attendance.
7) On a proposal to enter into a Development Agreement with Kettlestone Central, LC;
and Caliber Land Company, LLC — Mayor Pro Tern Bottenberg opened the public hearing
and asked if any written correspondence had been received; City Clerk Schuett replied that
none had been received in the clerk's office. Director of Economic Development Brown
briefly reviewed the proposed agreement for approximately 53 acres. The development
includes multi -family and townhome housing units at a nearly $100,000,000 investment by
the developer. Also included in the development are $10,000,000 in infrastructural
improvements with a December 2024 completion date. Ms. Brown then reviewed the
development incentives within the proposed agreement. No comments were made by the
public in attendance.
8) On a proposal to enter into a Development Agreement with Caliber Land Company,
LLC; Kettlestone Central, LC; and Iowa Youth Athletic Foundation — Mayor Pro Tern
Bottenberg opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied that none had been received in the clerk's office.
Director of Economic Development Brown briefly reviewed the proposed agreement for
approximately 100 acres. The development includes a 12-court basketball/volleyball sports
complex and surrounding commercial development, equaling a nearly $120,000,000
investment by the developer over the four phases of the project. Ms. Brown shared a video
with renderings of the proposed project. She added that the sports complex had an
anticipated $100,000,000 annual economic impact, then reviewed the development
incentives within the proposed agreement. Construction is scheduled for completion in June
2025. Developer Dickson Jensen addressed the council, stating that he was excited to bring
this project to Waukee. He noted his strong investment in time with kids and that his is one
of 32 clubs across the country that are associated with the Nike brand. The club events are
currently hosted in Ames and Des Moines. Mr. Jensen added that the proposed
development agreement gave the City use of the complex for some Parks & Recreation
programming. He introduced Nick Jensen with Caliber Land Company, LLC, and thanked
the council for their consideration. Council Member Lyon spoke favorably of the relationship
cultivated over the years between Mr. Jensen and the City and voiced his excitement for the
project; Council Member Crone echoed Council Member Lyon's comments, adding her
thanks to Mr. Jensen for caring for kids in this manner. No comments were made by the
public in attendance.
(H) Public Hearing Action Items:
1) Transite Water Main Replacement Phase 3 Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost — Council Member Lyon moved
to approve the resolution; seconded by Council Member Crone. Results of vote: Ayes:
Bottenberg, Crone, Lyon, Pierce. Nays: None. Absent: Sinclair. Motion carried 4 — 0 —

B. Resolution: Consideration of approval of a resolution awarding contract — Council
Member Crone moved to approve the resolution; seconded by Council Member Lyon.
Public Works Director/City Engineer Koester reviewed the bid tabulation and
recommended awarding contract to low bidder Busy Bee Construction, LLC, of Lewiston,
MO, in the amount of $703,688.31. Results of vote: Ayes: Bottenberg, Crone, Lyon,
Pierce. Nays: None. Absent: Sinclair. Motion carried 4 — 0 — 1. (Resolution #2023-227)
2) Urban Renewal Plans
A. Kettlestone Residential Urban Renewal Plan
1. Resolution: Consideration of approval of a resolution determining an area of
the City to be an economic development area, and that the rehabilitation,
conservation, redevelopment, development or a combination thereof, of such
area is necessary in the interest of the public health, safety or welfare of the
residents of the City; designating such area as appropriate for urban renewal
projects; and adopting the Plan — Council Member Lyon moved to approve the
resolution; seconded by Council Member Crone. Results of vote: Ayes: Bottenberg,
Crone, Lyon, Pierce. Nays: None. Absent: Sinclair. Motion carried 4 — 0 — 1.

B. Resolution: Consideration of approval of a resolution approving and authorizing
execution of a Development Agreement by and among the City of Waukee; Caliber

Member Lyon. Director of Economic Development Brown stated that the proposed
agreement would allow the City a certain amount of weekly gym time for the next 20

3) Motion: Consideration of approval of a motion approving Change Order No. 1 to
Grimes Asphalt and Paving Corporation for the 2023 Asphalt Overlay Improvement
Project, increasing the contract in the amount of $114,911.93 — Council Member Lyon
moved to approve; seconded by Council Member Crone. Public Works Director/City
Engineer Koester explained that the change order added Ashworth Dr. from 2nd to 4tn St. to
the project, as that segment was cracking after being overlayed last year. McClure
Engineering, the project engineer for last year's project, has agreed to pay the costs of the
change order. Council Member Lyon expressed his thanks to McClure for their payment of
the change order. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce. Nays: None.
Absent: Sinclair. Motion carried 4 — 0 — 1.
4) Resolution: Consideration of approval of a resolution approving construction
drawings [SE Waco Place Improvements] — Council Member Crone moved to approve the
resolution; seconded by Council Member Lyon. Community Development Director Kass
reviewed the project, which is required as part of the Kettlestone Central development.
