WAUKEE CITY COUNCIL MINUTES
July 10, 2023
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members R.
Charles Bottenberg, Chris Crone, Larry R. Lyon, Anna Bergman Pierce, Ben Sinclair. Absent:
None.
Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne,
Community Development Director Andy Kass, Planning Coordinator Melissa DeBoer, Finance
Director Linda Burkhart, Director of Economic Development Jennifer Brown, Human Resources
Director Michelle Lindsay, Director of Marketing & Communications Heather Behrens, Parks &
Recreation Director Matt Jermier, IT Director Son Le, Public Works Director/City Engineer Rudy
Koester, Police Chief Chad McCluskey, Police Officer Nick Gilchrist, City Clerk Rebecca D.
Schuett, City Attorney Steve Brick.
(D) Open Forum — Veronica Lack, a Dallas County Soil and Water Conservation commissioner,
addressed the council regarding nitrites in the water supply, stating that she hoped to obtain a
grant so that Des Moines Water Works can purchase the equipment to conduct local testing for
nitrites. She added that PFA chemicals cannot be safely filtered out of the water supply. Mayor
Clarke responded that the City had shared her concerns with Des Moines Water Works, whose
representative stated that their testing levels are consistent. She added that the City would
mention Ms. Lack's funding request to Des Moines Water Works in the near future.
(E) Agenda Approval — Council Member Lyon moved to approve the agenda; seconded by Council
Member Bottenberg. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays:
None. Motion carried 5 — 0.
(F) Monthly Mayor's Report — Mayor Clarke thanked the Waukee Parks Board and Parks &
Recreation Department staff for a great job on 4th of July festivities. She added that she has
issued a proclamation in recognition of July 2023 as Park and Recreation Month. The Waukee
Arts Festival will be held July 14-15. Mayor Clarke then shared some tips on water conservation
during dry summer months.
(G) Presentations: None — -
(H) Public Hearings:
1) On a proposal to enter into a Development Agreement with AP North, LC — Mayor
Clarke opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied that none had been received in the clerk's office.
Director of Economic Development Brown reviewed the proposed agreement for the
development of an approximately 50-acre parcel. Improvements include a regional
stormwater detention pond to be dedicated to the City. She then reviewed the proposed
economic development grants which shall not exceed $2 million. Stuart Ruddy, general
counsel for developer Knapp Properties, addressed the council to clarify that the detention
pond was part of an earlier agreement related to the UnityPoint Clinic development in the
area. No comments were made by the public in attendance.
2) On a proposal to enter into a Third Amendment to the Agreement for Private
Development and Minimum Assessment Agreement with The Quarter at Waukee, LLC
— Mayor Clarke opened the public hearing and asked if any written correspondence had
been received; City Clerk Schuett replied that none had been received in the clerk's office.
Director of Economic Development Brown reviewed the proposed agreement amendment,
which adjusts certain descriptions, minimum actual valuation schedules and economic
development grant schedules. There are no changes proposed to minimum assessed
valuation or TIF rebates. No comments were made by the public in attendance.

3) On the annexation of consenting and non -consenting properties by the City of
Waukee, Iowa [Waukee Commons, LC / Barbara Stanzyk] — Mayor Clarke opened the
public hearing and asked if any written correspondence had been received; City Clerk
Schuett replied that none had been received in the clerk's office. Community Development
Director Kass reviewed the proposed annexation area, which encompasses approximately
80 acres of land. He reviewed state code regarding the annexation of non -consenting
properties, adding that the larger Waukee Commons parcel cannot be annexed without the
Stanzyk property as it would create an island of unincorporated surrounded by incorporated
property. City staff continues to work with Ms. Stanzyk on agreements for voluntary
annexation. Mayor Clarke asked if anyone present wished to address the council on the
matter: 1) Veronica Lack (no address given) asked if there were any wetlands on the
Stanzyk property, if development would limit her drainage and if she would be required to
connect to city sewer. Mr. Kass answered that the Stanzyk property currently used a septic
system and could continue to do so until that system failed. As the Waukee Commons
property is developed, sanitary sewer lines will be added in the area, giving Ms. Stanzyk the
option to connect to the City sewer system.
Public Hearing Action Items:
1) Resolution: Consideration of approval of a resolution approving and authorizing
execution of a Development Agreement by and between the City of Waukee and AP
North, LC — Council Member Sinclair moved to approve the resolution; seconded by Council
Member Lyon. Council Member Bottenberg asked for clarification, as there are two ponds
shown on the development plan. Director of Economic Development Brown clarified that
only one pond was subject to the development agreement; Stuart Ruddy, addressing the
council on behalf of developer Knapp Properties, stated that the second pond was only
shown on the development concept plan; City Administrator Deets reviewed the location of
the subject pond. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays:
None. Motion carried 5 — 0. (Resolution #2023-286)
2) Resolution: Consideration of approval of a resolution approving and authorizing
