WAUKEE CITY COUNCIL MINUTES
November 6, 2023
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Pro Tern Bottenberg at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically
via Zoom.
(B) Pledge of Allegiance
(C) Roll Call — The following members were present: Council Members R. Charles Bottenberg,
Chris Crone, Larry R. Lyon (electronically), Ben Sinclair. Absent: Mayor Courtney Clarke,
Council Member Anna Bergman Pierce.
Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne,
Finance Director Linda Burkhart, Community Development Director Andy Kass, Planning
Coordinator Melissa DeBoer, Director of Economic Development Jennifer Brown, Human
Resources Director Michelle Lindsay, Public Works Director/City Engineer Rudy Koester, Parks
& Recreation Director Matt Jermier, Director of Marketing & Communications Heather Behrens
(electronically), Police Chief Chad McCluskey, Police Sgt. Kelli Cichoski, City Clerk Rebecca D.

(E) Agenda Approval — Council Member Crone moved to approve the agenda, removing Consent
Agenda Item 11G13; seconded by Council Member Sinclair. Results of vote: Ayes: Bottenberg,
Crone, Lyon, Sinclair. Nays: None. Absent: Pierce. Motion carried 4 — 0 — 1.

(G) Public Hearings:
1) On a proposed Urban Renewal Plan for an Amendment No. 1 of the North Waukee
Residential Urban Renewal Plan in the City of Waukee, State of Iowa — Mayor Pro Tern
Bottenberg opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied that none had been received in the clerk's office.
Director of Economic Development Brown briefly reviewed the proposed amendment, which
removes undeveloped, commercially zoned parcels from the plan area. The amendment
also includes updates and revisions to eligible projects and financial information. A
consultation meeting was held on Oct. 9 with no one attending; no correspondence has been
received on the matter. No comments were made by the public in attendance.
2) On a proposed Urban Renewal Plan for an Amendment No. 13 of the Waukee Unified
Urban Renewal Plan in the City of Waukee, State of Iowa — Mayor Pro Tern Bottenberg
opened the public hearing and asked if any written correspondence had been received; City
Clerk Schuett replied that none had been received in the clerk's office. Director of Economic
Development Brown briefly reviewed the proposed amendment to remove certain properties
from the plan area. The amendment also includes updates and revisions to eligible projects
and financial information. A consultation meeting was held on Oct. 9 with no one attending;
no correspondence has been received on the matter. No comments were made by the
public in attendance.
3) On a proposed Urban Renewal Plan for an Amendment No. 8 of the Waukee
Consolidated Urban Renewal Plan in the City of Waukee, State of Iowa — Mayor Pro

conservation, redevelopment, development or a combination thereof, of such
area is necessary in the interest of the public health, safety or welfare of the
residents of the City; designating such area as appropriate for urban renewal
projects; and adopting the Plan - Council Member Sinclair moved to approve the
resolution; seconded by Council Member Crone. Results of vote: Ayes: Bottenberg,
Crone, Lyon, Sinclair. Nays: None. Absent: Pierce. Motion carried 4 - 0 - 1.

2. Ordinance: Consideration of approval of an ordinance for the division of
revenues under Section 403.19, Code of Iowa [introduction; first reading] -
Council Member Crone introduced the ordinance and moved to approve the first
reading in title only; seconded by Council Member Sinclair. Director of Economic
Development Brown noted that the proposed ordinance would allow for the collection
of TIF revenues for developed projects. Results of vote: Ayes: Bottenberg, Crone,
Lyon, Sinclair. Nays: None. Absent: Pierce. Motion carried 4 - 0 - 1.
B. Amendment No. 13 to the Waukee Unified Urban Renewal Plan

approve the resolution; seconded by Council Member Sinclair. Results of vote: Ayes:
Bottenberg, Crone, Lyon, Sinclair. Nays: None. Absent: Pierce. Motion carried 4 - 0

2. Ordinance: Consideration of approval of an ordinance for the division of
revenues under Section 403.19, Code of Iowa [introduction; first reading] -
Council Member Sinclair introduced the ordinance and moved to approve the first
reading in title only; seconded by Council Member Crone. Director of Economic
Development Brown stated that the proposed ordinance removed certain developed
parcels from the plan area. Results of vote: Ayes: Bottenberg, Crone, Lyon, Sinclair.
Nays: None. Absent: Pierce. Motion carried 4 - 0 - 1.

City of Waukee, Iowa, by amending Section 68.09, No Parking Zones [second, third
(final) readings] — Council Member Sinclair moved to approve the second reading of the
ordinance in title only, waive the third reading and place the ordinance on final passage;
seconded by Council Member Crone. Results of vote: Ayes: Bottenberg, Crone, Lyon,

4) Resolution: Consideration of approval of a resolution approving site plan for Prime
Carwash [355 E. Hickman Road] — Council Member Crone moved to approve the
resolution; seconded by Council Member Sinclair. Planning Coordinator DeBoer reviewed
the site plan for an 11,000-square-foot single story carwash with three lanes for detailing.
She reviewed site ingress/egress, landscaping and exterior building elevations. Council
Member Crone asked if the City's zoning ordinance placed any restrictions on how close to
each other carwashes can be built; Ms. DeBoer replied that there were no such restrictions.
Results of vote: Ayes: Bottenberg, Crone, Lyon, Sinclair. Nays: None. Absent: Pierce.

5) Resolution: Consideration of approval of a resolution approving final plat for Fox

6) Resolution: Consideration of approval of a resolution approving and adopting City of
Waukee Art and Culture Plan — Council Member Sinclair moved to approve the resolution;
seconded by Council Member Crone. Assistant City Administrator Osborne noted that the
proposed plan had been presented in depth to the council at a recent work session, adding
that adopting the plan would help the City qualify for certain public art grants. He stated that
the next step was a call for artists with the intent of having an artist under contract in
January. Results of vote: Ayes: Bottenberg, Crone, Lyon, Sinclair. Nays: None. Absent:
Pierce. Motion carried 4 — 0 — 1. (Resolution #2023-483)
