WAUKEE CITY COUNCIL MINUTES
December 4, 2023
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:31 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members R.
Charles Bottenberg, Chris Crone, Larry R. Lyon, Anna Bergman Pierce, Ben Sinclair. Absent:
None.
Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne,
Finance Director Linda Burkhart, Community Development Director Andy Kass, Planning
Coordinator Melissa DeBoer, Director of Economic Development Jennifer Brown, Human
Resources Director Michelle Lindsay, Public Works Director/City Engineer Rudy Koester, Fire
Chief Clint Robinson, Police Chief Chad McCluskey, City Clerk Rebecca D. Schuett, City
Attorney Steve Brick.

(E) Agenda Approval — Council Member Crone moved to approve the agenda; seconded by
Council Member Lyon. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays:
None. Motion carried 5 — 0.
(F) Presentations: None
(G) Public Hearings:
1) On consideration of an annexation moratorium agreement between the City of
Waukee, Iowa, and the City of Dallas Center, Iowa — Mayor Clarke opened the public
hearing and asked if any written correspondence had been received; City Clerk Schuett
replied that none had been received in the clerk's office. Community Development Director
Kass briefly reviewed the proposed agreement, showing a map with the previously adopted
annexation limits and the newly proposed limits. Dallas Center will consider the agreement
on Dec. 12. No comments were made by the public in attendance.
2) On plans, specifications, form of contract and estimate of cost [Waukee Public Safety
Building Project] — Mayor Clarke opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied that none had been received
in the clerk's office. City Administrator Deets discussed the need for a second Public Safety
Building to address growth. The council previously approved contracts for T Ave. roadway
improvements. The new building will house all of the police department and will provide a
second fire station; the current facility will continue to operate as a fire station. Mr. Deets
noted that many sustainability factors were incorporated into the new facility design. No
comments were made by the public in attendance.
(H) Public Hearing Action Items:
1) Resolution: Consideration of approval of a resolution approving a 28E agreement
providing for an annexing moratorium between the Cities of Waukee and Dallas
Center— Council Member Bottenberg moved to approve the resolution; seconded by
Council Member Lyon. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair.
Nays: None. Motion carried 5 — 0. (Resolution #2023-505)
2) Waukee Public Safety Building Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost — Council Member Crone
moved to approve the resolution; seconded by Council Member Pierce. Results of vote:
Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0.

B. Resolution: Consideration of approval of a resolution awarding contracts — Council
Member Lyon moved to approve the resolution; seconded by Council Member Sinclair.
Project Manager Angie Pfannkuch with Sidekick Development presented the bid
tabulation, noting that there were 88 bidders for the 18 different bid packages. The bid
total is approximately 9% below estimate; all the apparent low bidders are in good
standing and meet the minimum insurance requirements. Ms. Pfannkuch recommended
the inclusion of Bid Package #13 Alternate 1A for a 300kW solar array; the full solar
array can be added in the future, if desired. Ms. Pfannkuch then reviewed additional
project costs, such as furniture, fixtures and equipment. Mayor Clarke asked if bidder
references were checked; Mr. Pfannkuch replied that a litigation questionnaire was
included with the bid documents. Results of vote: Ayes: Bottenberg, Crone, Lyon,
Pierce, Sinclair. Nays: None. Motion carried 5 — 0. (Resolution #2023-507)

Weight Restrictions, by amending Section 66.05, Truck Routes, as specified
[introduction; first reading] — Council Member Pierce introduced the ordinance and moved
to approve the first reading in title only; seconded by Council Member Crone. Public Works
Director/City Engineer Koester noted that the proposed amendments added new streets to
the ordinance and also were needed for compliance with State law. Results of vote: Ayes:

3) Resolution: of approval of a resolution approving site plan for Brilliant Borders [1585
NW Vicksburg Court]— Council Member Sinclair moved to approve the resolution;
seconded by Council Member Bottenberg. Planning Coordinator DeBoer reviewed the
proposed site plan for a 12,000-square-foot building for a landscaping business. The site
includes a fenced outdoor storage area. Ms. DeBoer noted site ingress/egress, landscape
buffer requirements and exterior building elevations. Results of vote: Ayes: Bottenberg,
Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 — 0. (Resolution #2023-515)
4) Resolution: Consideration of approval of a resolution approving site plan for Lot 2 of
Waukee Towne Center Plat 4 [350 SE Alice's Road] — Council Member Crone moved to
approve the resolution; seconded by Council Member Lyon. Planning Coordinator DeBoer
reviewed plans for a 3,000-square-foot Chase Bank building with drive-thru canopy. She
noted site ingress/egress, underground stormwater detention and exterior building
elevations. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None.

5) Kettlestone Central Apartments/Kettlestone Central Apartments Plat 1
A. Resolution: Consideration of approval of a resolution approving preliminary plat —
Council Member Pierce moved to approve the resolution; seconded by Council Member
Bottenberg. Planning Coordinator DeBoer reviewed the preliminary plat, final plat and
site plan for six apartment buildings with a total of 360 units. The proposed buildings are
three stories in height; other planned site amenities include a clubhouse, two outdoor
swimming pools, garages and a maintenance building. The final plat includes two lots.
Ms. DeBoer reviewed site ingress/egress, recreational trail access, landscape buffer
requirements and exterior building elevations. She noted that the development would be
serviced by private utilities; stormwater detention will be provided by an onsite pond.
The developer has submitted a fee in lieu of parkland dedication. She added that
garages that face public streets are required to include windows. Council Member
Sinclair asked for clarification on the location of the stormwater detention pond. Results
of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 —
0. (Resolution #2023-517)

Member Crone moved to approve the resolution; seconded by Council Member Sinclair.
