WAUKEE CITY COUNCIL MINUTES
January 15, 2024
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members R.
Charles Bottenberg, Chris Crone, Rob Grove, Ben Sinclair. Absent: Council Member Anna
Bergman Pierce. (Council Member Pierce began participation electronically at 5:33 p.m.)
Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne,
Finance Director Linda Burkhart, Planning Coordinator Melissa DeBoer, Director of Economic
Development Jennifer Brown, Human Resources Director Michelle Lindsay, Public Works
Director/City Engineer Rudy Koester, Parks & Recreation Director Matt Jermier, Police Chief
Chad McCluskey, City Clerk Rebecca D. Schuett, City Attorney Steve Brick.

Council Member Crone. Results of vote: Ayes: Bottenberg, Crone, Grove, Sinclair. Nays: None.

(G) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to R-2, R-2/PD-1, R-3, and C-1; and from R-2 to R-
2/PD-1, a parcel to be known as Castleton Pointe — Mayor Clarke opened the public
hearing and asked if any written correspondence had been received; City Clerk Schuett
replied that none had been received in the clerk's office. (Council Member Pierce began
participation electronically at 5:33 p.m.) Planning Coordinator DeBoer reviewed the
proposed rezoning ordinance for property annexed into the City in 2023. Notifications were
mailed and signage was posted on the site; City staff received no correspondence for or
against the application. The parcel includes single family, duplex, multifamily and
commercial lots. The proposed planned development allows for some smaller single family
lots while also requiring a minimum two -car attached garage, minimum home square
footage, exterior building materials and yard plantings; vinyl siding is prohibited. Ms. DeBoer
reviewed public street alignment, recreational trails and public utilities. The developer
proposes a small portion of land adjacent to Waukee Commons to the south for parkland,
with the remaining requirement as a fee in lieu of parkland. While the proposed rezoning is
not consistent with the Comprehensive Development Plan, City staff believe it is appropriate
for the area and allows for a mix of development. Council Member Crone asked for
clarification on the smaller lot sizes within the planned development; Ms. DeBoer explained
that those lots were for single family development, adding that the adjacent Waukee
Commons development would have standard single family lot sizes. Mayor Clarke asked
how the proposal differed from the Comprehensive Development Plan; Ms. DeBoer replied
that the Plan called for single family development only but that commercial and multifamily
development along the future University Ave. was consistent with development along a
minor arterial road. Council Member Sinclair asked what kind of commercial development
was planned; Ms. DeBoer stated that it was unknown at this time. No comments were made
by the public in attendance.
2) On a proposal to enter into a Fourth Amendment to the Agreement for Private
Development and Minimum Assessment Agreement with The Quarter at Waukee, LLC
— Mayor Clarke opened the public hearing and asked if any written correspondence had
been received; City Clerk Schuett replied that none had been received in the clerk's office.
Director of Economic Development Brown reviewed the proposed amendment, which

adjusts the rebate schedule and minimum assessment dates due to the completion of The
Venue project. There are no changes to the rebate amounts. No comments were made by
the public in attendance.
3) On the transfer of interest in real property [Central Iowa Water Works] — Mayor Clarke
opened the public hearing and asked if any written correspondence had been received; City
Clerk Schuett replied that none had been received in the clerk's office. City Administrator
Deets reviewed the proposal to transfer the City's interest in the LP Moon Booster Station to
the Central Iowa Water Works. No comments were made by the public in attendance.
Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning

2) Resolution: Consideration of approval of a resolution approving and authorizing
execution of a Fourth Amendment to the Agreement for Private Development and
Minimum Assessment Agreement with The Quarter at Waukee, LLC — Council Member
Bottenberg moved to approve the resolution; seconded by Council Member Sinclair. Results
of vote: Ayes: Bottenberg, Crone, Grove, Pierce, Sinclair. Nays: None. Motion carried 5 — 0.

3) Resolution: Consideration of approval of a resolution conditionally approving the
transfer of interests in real property by the City of Waukee to Central Iowa Water
Works and confirming joinder by the City of Waukee as a founding member of Central
Iowa Water Works — Council Member Sinclair moved to approve the resolution; seconded
by Council Member Grove. Results of vote: Ayes: Bottenberg, Crone, Grove, Pierce,
Sinclair. Nays: None. Motion carried 5 — 0. (Resolution #2024-027)
